am responding in writing as requested by your Surface Water Protection Notice
of Violation Nov-2007-PC-0100, dated February 14, 2007 pertaining to noted
deficiencies covered by permit NCG030479.
I have drawn up a site map illustrating the locations of our outfalls, and
completed an update of our annual plan. These documents are available for
your review at our plant. A rain gauge has been installed, and the boiler room
floor drain has been plugged with concrete. Secondary containment has been
added for the hazardous waste oil drum in the compressor room. Pictures of
these improvements are included.
Analytical monitoring results have been obtained, and will go out with the permit
renewal application today.
Keeping your advice in mind, I paid a visit to Mr. John Reno of Rockwell
Automation in Weaverville on February 27th. It was most enlightening and
informative. I will duplicate his record keeping system so that we will be able to
present a more organized report on your next visit.

On Rescission requested, the Division of Water Quality received your request to rescind your coverage
under Certificate of Coverage Number NCG030479. In accordance with your request, Certificate of
Coverage Number NCG030479 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

Enclosed please find a copy of the Compliance Evaluation Inspection report from the inspection
conducted on February 2, 2007 by Ms. Laurie Moorhead of the Asheville Regional Office. Several permit
conditions are being met at the 90 Christ School location, however, deficiencies noted result in violations
of permit NCG030479.
Permit NCG030479 requires that a stormwater management plan be prepared and maintained by
the permittee. While a plan was prepared several years ago, it is a permit requirement to conduct an
annual review and update. Missing from required documentation are a site map showing stormwater
outfall locations and visual monitoring records for the 2003 to 2006 period, Secondary containment is
also required for the hazardous waste drum located in the compressor room.
Please refer to the enclosed inspection report for additional findings and recommendations. You
are requested to respond in writing to this office within the next 30 days of receipt of this letter to
establish a timeline for compliance with the noted violations. Should you have any questions related to

Inspection Summary:
The inspector was pleasantly greeted by corporate environmental specialists Ted Wells and Stephen Ward as well as by
Pat Holland and Kevin Parkhill of the Buncombe County plant. The site's spill pollution prevention plan was reviewed
along with available monitoring records. There was no evidence that the plan has been updated to reflect operation
changes. Missing from required documentation are a site map showing the outfalls and visual monitoring records from
2003 through 200& Note that analytical monitoring was conducted in 2002 and all levels were below cutoff
concentrations. Additional analytical monitoring is required for the last year of the permit (permit expires August 2007)
and is to be submitted with permit renewal materials. As a reminder, analytical monitoring is to be conducted during a
representative rainfall event as described in the permit (0.1 inches). Visual monitoring may be conducted during any
rainfall event. In order to determine when a representative rainfall event is occurring, it is recommended that a rain gage
be installed onsite.
Secondary containment is required for the hazardous waste drum located in the compressor room. It is recommended
that the scrap metal containers located outside be covered in some manner to eliminate exposure to the elements and
potential contaminated runoff. it is also recommend that the abandoned propane tank located onsite be decommissioned
and properly disposed.

Your facility is currently covered for stormwater discharge under General Permit NCG030000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by ]ate summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you trust apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. 'To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued.

Failure to request renewal within this time period may result in a civil assessment of at least $250,00. Larger
penalties may he assessed depending on the. delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply For the no exposure exclusion. For additional
