For purposes of this permit the definition of Total Toxic Organics is that definition contained in the EPA Effluent Guidelines for the facility subject to the requirement to sample (for metal finishing use the definition as found in 40 CFR 433,11; for semiconductor manufacture use the definition as found in 40 CFR 469.12; for electronic crystal manufacture use the definition as found in 40 CFR 469.22; and for cathode ray tube manufacture use the definition found in 40 CFR 469.31). *Facility was excused from monthly monitoring for Cu & Zn per DEMLR-WSRO letter dated 3/6/2014. Guilford County Dear Mr. McCandless Aana Taylor -Smith of the Winston-Salem Regional Office of the NC Division of Energy, Mineral, and Land Resources (DEMLR or the Division) conducted a compliance evaluation inspection at the subject facility on 6 March 2014. Your assistance and cooperation, as well as that of Mr. John Andrews, were greatly appreciated. An Inspection checklist is attached for your records and the findings are summarized below. This facility is located at 1239 Rock -Creek Dairy Road in Whitsett, Guilford County, North Carolina. Stormwater related to industrial activity is discharged from the site to Little Alamance Creek, this segment of which is currently classified as WS-IV, NSW, CA waters in the Cape Fear River Basin. Documentation & Monitoring Review The facility's Stormwater Pollution Prevention Plan (SPPP) contained all of the required elements and is up to date and fully implemented. Both qualitative and analytical monitoring have been completed as required. The facility has one Stormwater Discharge Outfall (SDO) that discharges Stormwater related to industrial activity, which is a retention pond. Atiered response has been instituted for copper and zinc benchmarks at this time. Sample results from outfall 001 exceeded benchmarks for copper and zinc. Engineered Controls international has complied with permit requirements to increase sampling, identify potential sources of pollution, and attempt to eliminate them. As a result, sample results have been on a downward trend over the past sampling events. Site Review The facility is very clean and well -maintained. Secondary containment Is implemented as required. The outfall was inspected and found to be in good order. No evidence of erosion or instability at the SDO was observed and the retention pond was free of pollution Indicators. During the inspection, it was noted that this facility would only need to make a few adjustments to qualify for No Exposure Certification, which would eliminate the need for the NCG030000 General Stormwater Permit. Exceedences of copper and zinc benchmarks have continued at Outfall 001 despite the facility's proactive attempts to identify and eliminate any source of pollutants, Including changes In the use of the chip silos and pH controls at the retention pond. At this time, the Division concurs that more frequent monitoring at this site would be Ineffective, The DivIsIon relieves you of the additional monitoring frequencies required in the Tiered Response section of this permit for the parameters specified. You must continue to monitor semi-annually as required by the permit, but you will not be required to Institute monthly monitoring for any future exceedences of the copper and zinc parameters at Outfall 001. Tiered response requirements still apply for ail other parameters, should exceedences occur. Additionally, the Division highly recommends that Engineered Controls International, Inc. consider options for malting modifications to the facility to become eligible for No Exposure Certification, Coverage underthe No Exposure Certification would eliminate the need for analytical monitoring altogether as long as the facility abides by No Exposure requirements. If No Exposure conditions cannot be met, the Division strongly recommends modifying chip silos to reduce potential exposure of metal materials to stormwater.
