require that the facility immediately begin monthly monitoring. During the inspection, it was noed that the area associated
with loadinglunloading and forklift traffic may be the reason for those issues.

In response to your request for No Exposure (NE) in 2014 and the non -compliant
inspection related to that request, NCDENR-Land Quality Section staff conducted a site
inspection on July 13, 2015. The primary goal of this inspection was to evaluate
compliance with the conditions of the NCG030000 General Permit, to discuss any
actions that have been or could be taken to identify and limit potential sources of zinc
and copper related to process operations, and to discuss potential for NE status. At the
time of this inspection the facility was found to be in compliance with permit
NCG030317 and no illicit discharges were discovered.
Some of the conditions noted in the 2014 inspection were addressed; other conditions
that still exist do not allow for a NE permit at this time. Southwire (formerly Coleman
Cable) initiated housekeeping actions and a recycling program as a result of the 2014
inspection. However, Copper levels in both the 2014 and 2015 samples were. above
the benchmark. Please keep in mind that benchmark exceedances are NOT limit
violations or violations of permit conditions; however, you are obligated to follow the
response actions outlined in your permit.
Southwire must continue the permit specified semi-annual analytical monitoring for the
remainder of the current permit term, or until the outstanding exposure conditions are
addressed. Your current permit is set to expire on October 31, 2017. A benchmark
exceedance of any parameter listed in your permit can trigger tiered response
actions as described in the general permit.

1. This inspection was conducted to assess the results of the Tier 1 sampling and request for no exposure (NE). The
facility was previously inspected in January 2014 in response to a NE request and was found to be non compliant and the
NE request was not granted based on site coonditions.
2. A recycling program has been instituted at the facility, as well as some housekeeping practices. These changes have
resulted in Iower.Zn levels (2014 = .080 mg/L and 2015 = .045 mg/L) and lower Cu levels (2014 = .048 mg/L and 2015 =
.020 mg/L). Current benchmarks for these metals are: Zn = .067 mg/L and Cu = .007 mg/L. Upon permit renewal, these
benchmarks will increase to Zn = .126 mg/L and Cu = .010 mg/L.
3. The facility appears to not exceed the Zn benchmark, but is above the benchmark for Cu. Given that the facility has
copper on site for processing, there appears to be a need for further investigation as to the source of the copper.
4. There are still two large uncovered dumpsters that now contain primarily waste that can not be recycled. These
uncovered dumpsters constitute an exposure, Covering or placing the dumpsters under cover would remove this exposure.
5. The new pallets stored on site are not considered to be an exposure; however, the used pallets on site are an exposure.
Storing used pallets under cover would eliminate this exposure.
6. The previously noted floor drains were inspected and determined to be in the location of a removed restroom. These
drains discharge to a municipal wastewater system.
7, The facility will need to cover and/or remove the two dumpsters and the used pallets to be considered for a no exposure
permit. Additional effort may be needed to investigate the source of Cu to assure smaple values are at or below benchmark
levels. Semi-annual analytical monitoring should be continued.

Here's another twister for you (or someone):
was asked by Dickie Caldwell of Southwire (formerly Coleman Cable — Hayesville with NCG030317 permit) to do a
follow-up inspection on their 'no exposure' request. I visited the site on July 13 and would like to provide them a 'no
exposure'. They have one outfall. Here's the details:
1. We had nothing in the files under Southwire (!) but I did find a green file folder for Coleman Cable. The folder
was empty and there is nothing on the g: drive. We need Name Change Form and documents submitted to
Central Office to do this.
2. During the inspection, Dickie provided me with a copy of their permit, sampling analysis for 2014 and 2015, and
a copy of an inspection that Jonathon Stepp and Jeff Wait did in January 2014 in regards to their request for no
exposure. They were found to be in noncompliance for only sampling Ix/year for 2011-2013 and minor
housekeeping issues.
3. They did semi-annual sampling in 2014 and have done one sample thus far in 2015. So they're good on that
note.
4. Cu in 2014 = .048 and 2015 = .020; Zn in 2014 = .080 and2015 = .045. They have galvanized roofing, which
seems to be an issue in these parts. Not sure galvanized roofing explains the copper? Is there copper coming
off the roof too, or is that unexplained? Challenge here is if they have one outfall, and it includes the parking
lot, it could just as easily be vehicle traffic contribution.
They buy in rolls of copper and cut into lengths of 1000' and then coat it with a plastic.
They sweep floors at the end of each shift and place sweepings in recycle bins indoors. They started the
recycling as a result of the previous inspection. Any evidence of track -out of the building anywhere? I'm not
sure about this (the Cu) because they do have a source of Cu here ... copper residue from wire cutting. I think
they need to explore whether Cu is coming from somewhere other than building entrances or loading docks, for
example, where this material could escape. I've seen a place that works with copper almost entirely indoors,
and yet there was green discoloration from oxidized copper along the curbs outside of the building. It was
getting out somehow, probably as fine dust. That's not to say that's what is happening here, but I would
consider whether this can be ruled out before approving an NCGNE.
7. They still have two large dumpsters outdoors on site. There are no liquids and no longer any metals in
them. They contain cardboard tubes that can't be recycled due to wood interior frames. They are looking into a
new packaging so they can eliminate this waste. They intend to make this facility 100% recycle and the other
facilities they have in GA are already at 100% recycle. Are the dumpsters completely covered? If they are not,
even though it's rather benign cardboard tubes, it's still a material used in their manufacturing process, and it
can't be exposed in a dumpster--especially one that used to have metals. If they are not open but closed
dumpsters, then this shouldn't be an issue.
8. They keep roughly 100 pallets on site outdoors. The pallets are mostly new and unused. They have found a
church group that is taking the used pallets to make furniture, etc. The used pallets are on site for about a
week. How mostly? All of them, or they can't always be sure? I hate to be a stickler here, but our guidance
document on this is clear about used pallets outside normally meaning Exposure. I know "normally" implies
some wiggle room in situations, but consistency across the Regions would be important here; after years and
years of not writing this down (and getting the question over and over and over —and probably LOTS of
inconsistency in the past), we finally documented our policy/guidance on used pallets. We are trying to stick to
it. How many pallets is that? Could they build a cover? Could they ensure that all the pallets they receive from
now on will be unused? Could they just store the used pallets inside or cover those somehow, if there aren't
that many anyway? Seems like there could be an easy to solve the problem (without an investment in a big
shelter).
9. Jonathon mentioned a floor drain in the chiller room and these drains are from an old bathroom that was
removed. They are connected to the sanitary system. Sounds good.
10. They have 'no exposure' permits at their other facilities in GA. That's great, but that's not a reason for us to
approve it. It does mean that they're committed to attaining it, though, and that's great.
In my opinion, this facility should receive a 'no exposure' permit given the work they have done to address inspection
issues and given the type of processing they do. What do you think?

We appreciate this opportunity to respond to your letter dated January 9, 2014.
Per the issue of the pallets, there is a directive in the Good Housekeeping prograrn detail on Page C-3 (see highlighted
sentence in the Attached Appendix C) instructing the operator to not store pallets so as to be exposed. We have also
addressed the pallets in our semi-annual inspection reports (see attached example). In the past, the quantity of pallets
has not been feasible to provide cover for all of them. An improved pallet BMP will be developed and implemented.
They have also been instructed to keep dumpsters closed, and to request new ones that don't leak from their trash
hauler as needed.
We did not think the open -topped scrap bin was a significant concern as only inert material (e.g., trash, plastic wrapping,
and wood skid scraps) are placed into it. An appropriate BMP will be developed and implemented.
I developed the original SWPPP for this facility in 2006 and was told at that time by Lee Ferguson that the chiller room
drain connected to the sanitary sewer. We will flow test this drain to verify. (Dickie — On a day preceded by at least 72
hours of dry weather, put a water hose into the drain, open it full flow, wait at least 15 minutes and see if a flow appears
at any of the outfalls. Also check the appropriate sewer clean -out for a flow).
We will be under contract with Coleman Cable within ten days to update their SWPPP in accordance with the new
Permit and your comments in your report. We will also assist them with the stormwater discharge sampling task, and
will ensure that two samples are collected this year.

January 7, 2014. Several items were identified during the inspection that prevents Coleman
Cable from qualifying for a no exposure permit at this time. These items can be addressed
through housekeeping measures, minor site work and stormwater pollution prevention plan
updates. The facility was found not to be in compliance with permit NCG030317 due to
incomplete analytical data from 2011 to 2013.
Coleman Cable should immediately reinstate semiannual analytical monitoring. If you would
like to reapply for a no exposure permit, please address the items listed in the enclosed report
and demonstrate compliance with your current permit for 2014.

There are two large dumpsters outside of the facility that contain various debris from the facility. At the time of this
inspection, most of the debris consisted of wood, cardboard and plastic. There were other various materials intermixed of
unknown composition.
There are some new and used pallets stored outside of the facility that are exposed to stormwater. According to Mr.
Caldwell, these pallets are removed weekly. The handling of these pallets is not addressed in the BMPlhousekeeping
summary. Please detail this practice in your BMPlhousekeeping summary. Used pallets should be inspected so that
soiled pallets can be stored in a location that is not exposed to stormwater.
At the time of this inspection the procedure for sweeping the inside of the facility and disposing of the swept debris was as
follows:

Per our conversation this morning, I am sending you this e-mail to comment on the compliance status of Coleman Cable
with regard to coverage under general permit NCG030000 and Coleman Cable's corresponding certificate of coverage
(NCG030317). At the time of this request, Coleman Cable has no outstanding violations with NCG030317 and no record
of any past violations.
Coleman Cable has submitted a request for coverage under a No Exposure Certification. The request is pending a site
visit by the Asheville Regional Office. The visit will be scheduled in the near future.

• Bradley spoke with Sheri this morning. She reports that while we did send some things electronically, we didn't
send NCGNEs electronically. We sent those in paper format. So, there's no electronic record of the NOI to
search for. We can't find a paper record here.
• It's still possible that we've had a failure in the mail delivery to ARO, or that any number of other things occurred
to mis-direct the paper.
• As Bradley noted earlier, however, there is a record that we received it. RIMS is already prepped to receive
additional input to accomplish the issuance of the NCGNE and the rescission of NCG030317.
• Given that there has not been a site inspection yet, it seems like one path forward is this:
o Have the permittee send another copy of the NOL Since it apparently has already been through our
office, and we have prepped RIMS for it, he could send it straight to you in order to save a few
days. Actually, he could alert you when it's ready, and you might be able to pick up the re -executed
NCGNE Certification from him during the inspection.
o Conduct the site visit;
o Issue the letter, copy us, copy Fran with the alert that NCG030317 is rescinded.
o Complete the BIMS data entry for both the issuance the NCGNE and the rescission of NCG030317. If you
don't have RIMS access for any of these steps, let us know.

Just to pile on on your question:
• As you already know, BIMS reports that the current COC, NCG030317 is still active.
• BIMS does not show an Event under that permit for: Rescission Requested, RO Response to Rescission Request,
or Rescission Complete (all of which would be part of the necessary follow-up BIMS actions if we issue the No
Exposure Exclusion from Permitting.)
• Typically Bradley logs in every incoming bit of correspondence that asks for a permit action, either issuance, or
rescission, or conversion to NCGNE. He usually does that within a day or two of the incoming paper. He's close
to 100% on keeping that record.
• 1 have pulled our paper skeleton file in the Stormwater Permitting Program for NCG030317, and there is no
record in it of a NCGNE request. Some of us typically double -file the incoming NCGNE request with the old
permit file, just for this sort of question. We moy not keep this record procedure of the 100% level.
0 1 see we renewed Coleman's coverage under NCG03 via our December 4, 2012 letter.
see that they are paid up on fees through January 31, 2014,
do not see any violations or inspections recorded in BIMS back through three versions of the permit.
SPP staff keep a 'Permit Returns' spreadsheet, and I do not see an entry for Coble, indicating that we did not
receive this NCGNE request and deliberately return it for some deficiency. This is another one of our records
that may not be maintained at the 100% level.
Just to corroborate what you probably have already concluded, if their NCGNE application is up here in Raleigh, we don't
know it. It is always possible that it got here and fell in a crack. But if so, we still can't act on it if we don't know where it
is. Presuming that the permittee wants to pursue NCGNE, perhaps he could take the copy he kept (?) of the NCGNE NOI,
and send it to us again.

I just spoke with Dickey Caldwell of Coleman Cable. According to Mr. Caldwell, he applied for no -exposure in May of this
year and hasn't heard anything on the status yet. I just spoke with Kevin Barnett in our office (he used to have Clay
county) and he was aware that they have applied but said he hasn't seen the application yet. Do you know who I need
to speak with in order to track this down. Coleman Cable has a potential buyer coming in tomorrow and the buyer
wants to do an environmental audit as part of their due diligence. Mr. Coleman says he hasn't collected any samples
since he submitted the application for NE (Kevin advised him he didn't have to). Thanks for the help on this one I am
shooting for a quick turnaround.

The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.org/web/wq/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

Some of the changes include:
Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical Stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DIVIR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,

Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of' stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215. l and
could result in assessments of civil penalties of'up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the 1 I categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

If the sub.lect stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions are listed on the bottom of the form. You will be notified when the
rescission process has been completed.

dated December 6, 1983.
The following information is included with your permit package:

■ A Stormwater Pollution Prevention Plan Certification Form. This form certifies that you have
developed and implemented the Stormwater Pollution Prevention Plan (SPPP) required in your
permit. This form must be completed and returned to the Division within 30 days of receipt of
this letter. DO NOT send the SPPP with the signed form.
■ Five copies of Analytical Monitoring forms.
■ Five copies of Qualitative Monitoring forms.
m A copy of a Technical Bulletin on the stormwater program with outlines program components
and addresses frequently asked questions. '
■ A corrected Certificate of Coverage if you indicated a name or address change on the Renewal
Form returned to the Division.
Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
DWQ or permits required by the Division of Land Resources, Division of Air Quality, Coastal Area
Management Act or any other Federal or Local governmental permits that may be required.
