Aana Taylor -Smith of the Winston-Salem Regional Office of the NC Division of Energy, Mineral, and Land
Resources (DEMLR) conducted a compliance evaluation inspection at the subject facility on 28 February 2014.
Your assistance and cooperation during the inspection were greatly appreciated. An inspection checklist is
attached foryour records and the inspection findings are summarized below.
This facility is located at 2941 Indiana Avenue in Forsyth County, North Carolina. Stormwater related to industrial
activity is discharged from the site to an unnamed tributary to Brushy Fork Creek, this segment of which is
currently classified as Class C waters, in the Yadkin -Pee Dee River Basin.
Documentation & Monitoring Review
The facility's Stormwater Pollution Prevention Plan (SPPP) is extremely thorough, up to date, and fully
implemented. Qualitative monitoring has been completed as required. Analytical monitoring has also been
completed as required. The facility has one Stormwater Discharge Outfall (SDO) that discharges Stormwater
related to industrial activity.
This inspection was conducted primarily to evaluate compliance with the tiered response required by the
NCG030000 permit. Kaba Ilco is currently in Tier Three for metals exceedances and has completed all action items
as required. The facility has taken steps to identify and eliminate sources of pollution through general
housekeeping, evaluating containment areas, cleaning roof areas, and cleaning scrubbers. At this time, DEMLR
strongly recommends the following action(s):
Take steps to achieve No Exposure status at the site, including installing cover over all pallets, skids,
materials, and dumpsters. More information on No Exposure can be found at the following website:

Site Review
The facility is orderly and well -maintained. Secondary containment has been implemented as required.
Accumulated water from the secondary containment areas is treated at the on -site wastewater treatment unit.
The outfall was inspected and found to be in good order. No evidence of erosion or instability at the SDO was
observed.
We appreciate your efforts to comply with the stormwater permit and the proactive steps taken to identify and
eliminate potential sources of pollution. Please contact the Division when the facility qualifies for No Exposure
and an inspection will be conducted at that time to ensure No Exposure status. Should you have any questions

This letter is being submitted in response to the Notice of Violation (NOV) for the Kaba Ilco facility located at 2941
Indiana Ave., Winston-Salem, Forsyth county, North Carolina issued by North Carolina Department of Environment
and Natural Resources (NCDENR), Division of Water Quality (DWQ), Winston-Salem Region on February 25,
2010. In response to the NOV, Kaba llco has taken the following actions to ensure compliance with NPDES
General Permit NCG030000:
Compliance Issue 1: Failure to include annual recertification that outfalls do not contain non-stormwater
discharges.
Response 1: The non-stormwater discharge assessment and certification was completed on March 15, 2010.
Outfalls B and C were directly observed during the test. No non-stormwater discharges were observed. A copy of
the non-stormwater discharge assessment and certification is provided as Worksheet No. 5 in Appendix F of the
enclosed Stormwater Pollution Prevention Plan (SPPP), updated in March 2010.
Compliance Issue 2: The map does not list the drainage areas to each outfall nor the percentage of impervious area.
Response 2: An updated site map is provided as Figure 2 in the enclosed SPPP. The map lists the drainage areas
and percentage of impervious area for each drainage area.
Compliance Issue 3: The feasibility study of changing methods of operation to eliminate or reduce exposure
appears to need an update.
Response 3: In response to the comments on page 3 of the February 23, 2010 Compliance Inspection Report, Kaba
llco has taken the following actions:
1. The 55-gallon drums containing nitric acid and the 15-gallon drums containing sulfuric acid and
hydrochloric acid that were observed outside the wastewater treatment building have been transferred to the
secondary hazardous material area (chemical storage room inside the main building). Section 1.2 of the
SPPP has been updated with this storage practice. The 55-gallon drums of ammonia remain outside under
shelter until determination that storage in the chemical storage room is an appropriate storage practice.
2. The two 250-gallon, double -walled polyethylene tanks utilized for transferring wastewater to the
wastewater treatment building remain empty when not in use and are tightly sealed to prevent stormwater
exposure.

The empty drums that were observed in several locations, including near the south loading bay (20+), have
been removed from the facility.
The exposed wood pallets on the east and north sides of the plant and the open top dumpster containing
scrap metal equipment on the south end of the plant have been implemented into the SPPP as exposed
materials. These materials are itemized on Worksheet No.'s 3a and 7 in Appendix F of the SPPP. The
scrap metal dumpster was removed from the site in March 2010. Kaba Ilco is currently evaluating the
potential for construction of a canopy at the south end of the main building. The canopy would provide
sufficient cover for any future scrap metal waste generated and wood pallets stored at the facility.
Worksheet No. 4 (Significant Spills/Leaks) was updated on March 15, 2010 and is provided in Appendix F
of the SPPP.
Compliance Issue 4 Stormwater data was not submitted for this facility in 2008 or 2009.
Response 4_: Kaba Ilco is working in conjunction with a North Carolina certified laboratory to collect stormwater
samples from the Outfall B sampling location on a semi-annual basis. Qualitative and analytical stormwater
monitoring will coincide during a representative storm event. Copies of the Analytical and Qualitative Stormwater
Discharge Outfall (SDO) Monitoring Reports are contained on file at the office of the main building at the facility.
Completed Qualitative and Analytical SDO Monitoring Reports will be mailed to the NCDENR-DWQ, Winston-
Salem Region within thirty days of receipt of laboratory results. The updated stormwater sampling protocol is
provided as Appendix E in the SPPP.
The first comment on page 4 of the February 23, 2010 Compliance Inspection Report states that the Kaba Ilco
facility in Winston-Salem, North Carolina did not have a copy of the NPDES General Permit or Certificate of
Coverage issued in October 2007. It has been determined that NCDENR-DWQ, Winston-Salem Region
inadvertently sent the 2007 NPDES General Permit and Certificate of Coverage to the Kaba Ilco facility in Rocky
Mount, North Carolina. Copies of the 2007 NPDES General Permit No. NCG030000 and Certificate of Coverage
No. NCG030245 are now contained on file at the office of the Kaba Ilco facility in Winston-Salem, North Carolina.
In order to ensure satisfaction of the requirements of the NPDES General Permit and to prevent the recurrence of
similar compliance issues in the future, Kaba Ilco personnel roles have been clearly defined as it pertains to the
SPPP. Personnel roles and responsibilities as it pertains to the SPPP will be reinforced and evaluated on a quarterly
basis. Stormwater monitoring timelines have been clearly defined and Kaba Ilco has contracted with a state -
certified laboratory to ensure the requirements of the NPDES General Permit are fulfilled. The SPPP will be
reviewed and updated annually or as facility conditions or processes warrant.

North Carolina to receiving waters designated as an Unnamed Tributary to Brushy Fork Creek, a

General Permit NTCG030000 requires certain monitoring to be documented and the records
maintained at the facility.
The following records are required at this site per the NPDES permit:
Stormwater Pollution Prevention Plan as specified per Part II, Section A.
2. Stormwater Discharge Outfalls (SDO) shall have Qualitative monitoring performed as
described in Part 11, Section C and Table 4 and shall be conducted during the analytical
monitoring event.
Stormwater Discharge Outfalls (SDO) shall have Analytical monitoring performed as
described in Part II, Section B and Tables I &: 2.
A review was made of the supplied records and reports for the Kaba Ilco Corporation facility
for the period March 2008 through the present.
This review indicated deficiencies in the foll1mvinj! records:
The Storm-,vater pollution prevention plan was incomplete.
o The plan should have been reviewed annually since 2004 but it did not include, " re-
certification that the stormwater outfalls have been evaluated for the presence of non-
stormwater discharges." The Contingency Plan section was updated in July 2008.
o The Feasibility Study as required in Part I1, Section A., 2. (a) of the permit should be
updated to evaluate current conditions.
o The percentage of impervious area draining to each outfall and the total drainage area
for each outfall must be listed on the man. Permit condition II.A.1.(c).}
o The North Carolina spill reporting requirements for petroleum include any spills that
reach surface waters, any spills that exceed 25 gallons, any spills that are closer than
100 feet from surface waters and any spills that are not cleaned up within 24 hours of
the discharge. Attached is GS 143-215.85 (b).

of the building. The east outfall was observed to be free of industrial litter or debris.

Comment: Page 5 of the SWPPP indicates that wood pallets are in a dumpster under
a permanent cover. Exposed pallets were on the east & north sides of the plant. The
plan notes that no outside operations occur except for moving drums from the main
building to the hazardous storage building. There were 55 gallon drums of ammonia and
nitric acid stored outside near the wastetreatment building. There were also 15 gallon
tanks of sulfuric and hydrochloric acid stored outside Two 250+ gal. doublewalled
drums were also located outside. Storage under roof with a berm would eliminate
potential exposure. Transfer of liquids from drums outside is a potential expopsure path.
Empty drums were also located outside at several locations. (20 or more in one spot). A
dumpster located on the south end of the property was full of scrap metal equipment. It
was noted that no spills have occurred in the last 3 years, but this must be included in
the annual plan update. --Plan implementation is not fully effective,

1. Need to re -certify the annual certification that the stormwater outfalls have been evaluated for
the presence of non-stormwater discharges.
2. Conduct the annual review of the technical and economic feasibility study.
3. Document that there were no Secondary containment release, complete a table or summary of
all such tanks and what materials are stored in the tanks.
4. Complete a table or summary of all BMP's structural and non-structural where install and
there implementation for each BMPs.
5. Document Kaba's semi-annual facility inspections.
6. Provide this office with s summery of training that was conducted and the number of
employees that were trained.
7. Kaba-Access has a great stormwater management plan. It is very organized, detailed, and
concise. We were impressed with Mr. Flaherty cooperation and understanding. The
