PDF Hey Jenny, Attached are the results of our storm water sample for the second half of 2011. We are working on the issue of aluminum saw chips outside the building in the tractor trailer lot. The plan is to first move chip hopper to a location further away from outflow that requires less forklift travel and spilling of chips. Then we will clean up outside storage areas and have street sweeper come and clean up chips outside (this will be a quarterly event). Finally will have to eliminate/ reduce the amount of chips that are left in extrusions stored outside. This last step is the most difficult of the three and will take time develop prevention apparatus/ procedure. Sullins Dee Freeman Governor Director Secretary September 8, 2011 Mr. Mike Faust, Plant Manager SAPA Burlington, LLC 1507 Industry Drive Burlington, North Carolina 27215 Subject: NOTICE OF VIOLATION - Failure to Perform Monitoring Requirements General Stormwater Inspection NPDES General Permit No. NCG030188 SAPA Burlington, LLC Alamance County Dear Mr. Faust: On September 7, 2011, Jenny Graznak of this office performed a General Stormwater Permit Inspection at Sapa Extrusions located at 1507 Industry Drive in Alamance County, North Carolina. This facility holds General Stormwater Permit No. NCG030188 under the National Pollutant Discharge Elimination System (NPDES) to discharge Stormwater from metal fabrication activities. Michael Riley, EHS coordinator, was present for the inspection. This type of inspection consists of two basic parts: a review of facility files and self -monitoring data, and an on -site inspection of the facility and its outfalls. This particular inspection evaluated five (5) areas as designated on the attached inspection form, and observations from each area are addressed below: 1. Permit The permit became effective November 1, 2007 and expires October 31, 2012. 2._ Records/Reports As required by the Permit, the facility has a Stormwater Pollution Prevention Plan (SPPP) that was prepared by Strata Environmental and dated September 2006. The SPPP appeared to be thorough and complete, including a location map of the outfalls and a site plan listing potential stormwater pollutants and best management practices used at the site. The SPPP has been updated to reflect recent changes to staff and ownership. All employees are briefed on company safety and environmental issues on an annual basis, and this process is documented in the SPPP. 3. Facility Site Review SAPA is an aluminum extruder. Raw materials and finished products (all aluminum) are stored outside in the vicinity of Buildings 2 and 3. The main concern from the on -site inspection of the facility is a housekeeping issue. Aluminum fines and shreds are scattered on the property, blowing and falling from the finished product that is stored outside. These small pieces of aluminum drain to Outfall 002, and there is no catch basin for their collection. This is a potential violation of water quality standards. Mr. Riley explained that the inside industrial process could be enhanced to reduce these fines and shreds outside the building. Please evaluate this housekeeping issue and let our office know your immediate plan for improving this problem. North Carolina Division of Water Quality, Winston-Salem Regional Office Location: 585 Waughtown St Winston-Salem, North Carolina 27107 Phone: 336-771.50001 FAX: 336-771-46301 Customer Service: 1-877-623-6748 Internet www.ncwaterquality.org An Equal Opportunity 1 Affirmative Action Employer NorthCarolina Aatura!!y All petroleum storage is in secondary containment. The largest tanks on the property are two 3,000- gallon tanks for new and used hydraulic oil, which are located behind Building 1. Used oil is reclaimed. 4. Effluent/Receiving Waters Stormwater discharges from this site drain to Little Alamance Creek (Class C; NSW) in the Cape Fear River Basin. The site has five outfalls, however Outfal[s 004 and 005 drain from adjacent property where no industrial activity occurs. Outfall 001 discharges at the southeast corner of the property, draining the materials storage area behind Building 1. Outfall 002 drains the surface area surrounding Buildings 2 and 3. Outfall 003 drains the front of Building 1, which is mainly just employee parking. 5. Self -Monitoring Program The stormwater permit requires semi-annual qualitative and analytical monitoring at stormwater outfalls. On -site vehicle maintenance monitoring requirements at the site are waived, since these activities are performed by an off -site vendor. An on -site review of the monitoring data during the inspection showed that semi-annual qualitative monitoring has been performed per the specifications of the permit. However, analytical monitoring was last performed in 2007 (these results met all cut- off concentrations), and has not been done again since. You are found in violation of your Stormwater Permit for failure to perform the monitoring requirements of the Permit. In order to avoid a civil penalty, you are required to perform one Stormwater monitoring event before the end of.2011 and provide these results to our office upon their receipt. If you have any questions concerning this letter or your required action, please contact Ms. Graznak or me at (336) 771-5000. Sincerely, W. The Debtors will remain in possession of their property and will continue to operate their businesses unless a trustee is appointed. CREDITORS MAY NOT TAKE CERTAIN ACTIONS. A creditor is anyone to whom the Debtors owe money or property. Under the Bankruptcy Code, the Debtors are granted certain protections against creditors. Common examples of prohibited actions by creditors are contacting the Debtors to demand repayment, taking action against the Debtors to collect money owed to creditors or to take property of the Debtors, and starting or continuing foreclosure actions or repossessions. If unauthorized actions are taken by a creditor against the Debtors, the Court may penalize that creditor. A creditor who is considering taking action against the Debtors or the property of the Debtors should review section 362 of the Bankruptcy Code and may wish to seek legal advice. The staff of the Clerk's Office is not permitted to give legal advice. CLAIMS. Schedules of creditors will be filed pursuant to Bankruptcy Rule 1007. Any creditor holding a scheduled claim, which is not listed as disputed, contingent, or unliquidated as to amount, may, but is not required to, file a proof of claim in these cases. Creditors whose claims are not scheduled or whose claims are listed as disputed, contingent, or unliquidated as to amount and who desire to participate in these cases or share in any distribution must file their proofs of claim. A creditor who desires to rely on.the schedules of creditors has the responsibility for determining that its claim is listed accurately. Separate notice of the deadlines to file proofs of claim and proofs of claim forms will be provided to the Debtors' known creditors. Proofs of claim forms also are available in the clerk's office of any United DB02:808 l 576.2 2 068136.1001 States Bankruptcy Court and from the Court's website at www.deb.uscourts.gov or through the website of Epiq Bankruptcy Solutions LLC, the claims agent in these cases, at hqp://chapterl i.epiasystems.com/Indalex. DISCHARGE OF DEBTS. Confirmation of a chapter 11 case may result in a discharge of debts, which may include all or part of your debt. See 11 U.S.C. § 1141(d). A discharge means that you may never try to collect the debt from the Debtors, except as provided in the plan. For the Court: Is/David D.
