inspection on March 22, 2012, at your mine site located off Highway 70 in Carteret County Your mining application submitted to the Division of Land Resources (DLR) indicates you propose to discharge 95,000 gallons per day (gpd) Please be advised, a discharge greater than 100,000 gpd will require a capacity use permit from Division of Water Resource's (DWR) Central Coastal Plain Capacity Use Area Program Unless you have a permit from DWR that allows a discharge greater than 100,000 gpd, DWQ cannot support a discharge greater than 100,000 gpd Please correct your O & M plan to reflect a maximum discharge of 95,000 gpd and forward a signed copy of the modified O & M to Linda Willis at 127 Cardinal Drive Extension, Wilmington, NC 28405 You are reminded of the following permit requirements, quarterly analytical monitoring is required for your pit dewatering discharge, semi-annual qualitative and analytical momtonng is required for all stormwater discharges, and you must follow your Robert Preston Willis Inspection Date 03/22/2012 Inspection Type Compliance Evaluation Reason for Visit Other Inspection Summary A site visit was conducted by the Inspector to help with the development of an approvable O & M plan for dewatering the pit There are two streams in the vicinity of this mine pit Discharges occunng to the north and northwest of the pit will drain to a large wetland area that Is contiguous with a network of mosquito ditches, contiguous with Williston Creek Williston Creek the network of mosquito ditches and the unnamed tributary (UT) to Williston Creek are all classified SA HQW waters of the state and are functioning primary nursery areas (PNA) Determining a 7Q10 for the UT to Williston Creek or the mosquito ditches is impossible without a boat or hip waders The permittee and his consultant (Mark Eakes)proposed a discharge to the large wetland due west of the discharge location (see attached map), using a level spreader This wetland had standing water in it the day of the site visit due to a recent large rain The wetland area takes in a large area adjacent to Williston Creek and will be used to provide Infiltration The Division of Land Resources (DLR) mining application for this mine pit (DLR #16-74) indicates no more than 95 000 gpd will be discharged from the pit if the discharge exceeds 100 000 gpd a water use permit from the Division of Water Resources (DWR) Central Coastal Plain Capacity Use Area Program will be required The permittee proposes 4 potential stormwater settling basins along the west and south edge of the pit that could drain to UT's to Howland Creek (classified SA ORW HQW waters of the State) Wastewater discharges from pit dewatering can not be discharged to Howland Creek due to it s ORW classification The current O & M plan needs to reflect a pump rate equal to that specified In the DLR application All monitoring requirements In the permit apply Page 2 Permit NCG020817 Owner Facility Road in this Jacksonville area of Qnslow County The purpose of this evaluation was to determine the effect of the mine on the adjacent wetlands The wetland boundary was flagged in the field and has been surveyed by Parker and Associates A detailed survey has also treat provided which shows the pit, wetlands and pit water elevation at the time of the survey At this time the dewatering has not drained the wetlands This was apparent by the standing water, saturation in first 12' of profile, wetland vegetation present, and the presence of hydric soils Auger borings were dug around the edge of the pit adjacent to the wetlands and the water level in the mine.
