In accordance with your application for a discharge permit received on July 26 2011 we
are forwarding herewith the subject certificate of coverage to discharge under the subject state —
NPDES general permit This permit is issued pursuant to the requirements of North Carolina
General Statute l 43-215 1 and the Memorandum of Agreement between North Carolina and the
US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended)
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage
Please be aware that mine dewatering at your site has the potential to impact adjacent
wetlands The specific requirements for mine dewatering at facilities near wetlands can be found
in Part Ill, Section E of your permit You must operate under your approved Operation and
Monitoring Plan at your facility
Please note that mine dewatering wastewater includes wet pit overflows caused solely
by direct rainfall and groundwater seepage for this type of mining operation Any discharge of
this water (and any stormwater commingled with it) is subject to the effluent limitations in this
permit
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land
Resources Coastal Area Management Act or any other federal or local governmental permit that
may be required

On September 21, 2011 1 visited Miller Mine No 2 site in Carteret County and took the elevations that you
ask for, which are attached, attached regarding the wetland elevations, pond water elevation, and invert
elevation of culvert
1 I assumed an elevation of 10 00' at the highest point of the wetland area which was approximately 27 feet
from the water line of the pond At this point I dug a hole with hole diggers and with 3 minutes the groundwater
level in the hole was within 3' of the ground surface
2, The water elevation at edge of pond was 9,53' which results in a reading of 47' below the highest elevation
point of the wetlands
3, Average elevation of the I 1 acres of wetlands is around 9 60' above mean sea level
4 The culvert invert is 9 47' above MSL which results in the culvert invert being 13' below average elevation
of the wetlands
As a result of the findings, I feel the 1 1 acres of wetlands are at this time being provided with enough water
and feel this will continued during the operations of the mine

Representatives from this office, Linda Willis and Dean Hunkele, conducted a site visit at this mine pit
located off Rams Horn Road on March 22, 2011 The USACOE was at the site conducting a wetlands
survey to determine the extent of any wetland impacts as the result of the mining activity at the site
I spoke with Floyd Williams on August 22, 2011 It is my understanding he is providing consulting
services for the NPDES and Mine permit for this site Floyd indicated that the USACOE determined
there to be wetlands on the site that were already impacted due to the land disturbing activities on site
Floyd indicated that the existing pit will be used as a settling basin and any further mine pit water from
future excavations will be pumped to this settling pond The settling basin has an outlet to roadside
ditches that will eventually discharge to surface waters of the State (Northwest Prong of the Newport
River) I discussed the situation with Floyd and indicated that as long as he maintains a water level in
the settling pond that is at or above the elevation of the adjacent wetland, the wetland should be
protected I asked him to provide a plan that will demonstrate adequate protection for the wetland area
Please provide a plan that shows the elevations of the permanent pool that will be maintained in the
settling pond, the elevation of the bottom of the outlet structure and the elevation of the wetland located
next to the pit Be sure that the permanent pool elevation in the settling pond will be high enough to
recharge the wetland Please forward the plan to my attention (see address below)

The Division of Water Quality's Stormwater Permitting Unit received a National Pollutant Discharge
Elimination System (NPDES) permit application for Miller Mine No 2 on July 26, 2011 The application
included information that a mining permit has been applied for from the Division of Land Resources
(DLR) Please be aware that the issuance of an NPDES permit is contingent upon the issuance of the
associated mining permit from DLR Our office will process your stormwater permit application once a
DLR mining permit has been issued for your project
Please provide the following additional information
1 Information must be provided to demonstrate that mine dewatering will not have adverse
effects on the wetlands
Diease also be aware that your project is located near wetlands Your NPDES permit will require
dewatering operations without wetland impacts The specific requirements for mine dewatering at
facilities near wetlands can be found in the text of the general NPDES mining permit number NCG

of the permit An approved Operation and Monitoring Plan is required for NPDES-permitted mining

Maintenance inspect sediment fences at least once a week and after each rainfall. Make any
required repairs immediately.
Shouid the fabric of a sediment fence collapse, tear, decompose or become
ineffective, replace it promptly.
Remove sediment deposits as necessary to provide adequate storage volume
for the next rain and to reduce pressure on the fence. Take care to avoid
undermining the fence during cleanout.
Remove all fencing materials and unstable sediment deposits and bring the
area to grade and stabilize it after the contributing drainfagc area has been
properly stabilized.

Maintenance Maintain the gravel pad in a condition to prevent mud or sediment from leav-
ing the construction site. This may require periodic topdrexsing with 2-inch
stone. After each rainfall, inspect any structure used to trap sediment and clean
it out as necessary. Immediately remove all objectionable materials spilled,
washed, or tracked onto public roadways.

NOI is also an APPLICATION FOR an ATC for new wastewater treatment facilities ATC requests must be
submitted at least 90 days prior to construction'

This NOI is also an APPLICATION FOR an ATO for wastewater treatment facilities in place
Construction, modification, or installation of any new treatment components at an existing stte requires an
ATC (If the site is already covered by NCG020000, the ATC request may be submitted without an NOI)
Some wastewater treatment facilities used to treat or recycle wastewater at mining sites will require an ATC prior
to construction per 15A NCAC 2H 0135 Please see the NCG020000 General Permit for details about which
treatment facilities require an ATC (summarized in Table 1 below) The authorization to construct or continue
to operate will be issued at the same time as the Certificate of Coverage (COC) for the NCG02 permit Design of
