Originally this mine pit was determined to not have a permit due to the fact that a scan for the permit was
conducted based upon the name of the pit used for the DLR permit 10-62 Lakes of Lockwood Mine The
permittee, Wayne Smith, applied for the NPDES permit in 2003 using the mine name "Holden Beach Sandpit
No 2 The initial review of this mine pit was conducted in 2009 DLR's Proiect name for the pit was "Wavne's
Backhoe Service"

The operation and monitoring of wastewater from The Lakes of Lockwood II
Sand Mine shall adhere to the following limitations All wastewater that collects
within the pit area through groundwater seepage and/or direct rainfall shall be
extracted out of the pit area on an as need basis All wastewater that is
extracted will be routed through the stilling basin I level spreader BMP
The level spreader diffuses discharged wastewater through the required fifty (50)
foot vegetated buffer The diffusion of flow through the vegetated buffer will allow
for both infiltration and pollutant removal The infiltration process will continually
recharge the water table and also protect the wetland areas from any impacts
associated with the mining operations
The stilling basin 1 level spreader BMP will be required to be inspected either
quarterly and after any discharge operation or on a monthly basis The stilling
basin should be inspected for sediment accumulation If sediment is found to be
25% or more of the original design depth then all sediment shall be removed and
the basin will be returned to original design conditions An inspection of the level
spreader should verify that the spreader lip has not been bypassed and that the
filter strip remains vegetated and channelized flow does not occur during
operation If needed, the vegetated buffer should be reestablished and
channelization should be removed Vegetation should remain, at all times, a
minimum six (6) inches in height All silt fencing shall remain at the excavation
limits as specified by site plans Any accumulated sediment should be removed
from the base when the depth reaches one (1) foot
Any discharge from dewatering activities shall not exceed 70,000 gpd All
discharge shall be directed to the identified isolated wetlands for containment
and infiltration as previously mentioned No discharge shall overwhelm and
overflow from these isolated wetlands therefore preventing any discharge to
waters of the state Four isolated wetland areas are identified as 0 38 acres,
0 62 acres, 1 64 acres, and 2 39 acres respectively
All waters that are discharged should be done so from the existing lake area/cell
By doing so this should limit the likelihood that contaminated water is being
discharged and routed through the BMP's to wetlands
A sample of the dewatenng discharge should be taken from the pump outlet for
testing in accordance with the regulations set forth in the dewatenng permit A
log of dates indicating when dewatenng has taken place shall be kept in the
mining office Quarterly reports are required to be submitted to NCDENR DWQ
If no dewaterng has taken place during the quarter, then a statement should be
submitted indicating that no discharge occurred during the quarter

A site visit by Division Representative, Linda Willis, from the Division of Water Quality, Surface Water Protection
Section, was conducted on October 20, 2009, at the Simmons Mine off McMilly Road in Brunswick County The
Dix ision Representative noticed an area to which you had been dea atering your mine pit This area is hydrologically
connected to an unnamed tributary of the Shallotte River classified C-Sw, HQW waters of the State in the Lumber River
Basin The Division of Land Resources had requested on May 11, 2009, that you discontinue the dewatering activity, and
it appears you have complied with this request Dewatering is allowable if needed, but only by permit Enclosed is a
notice of intent (application form) and a technical bulletin, should you determine mine dewatering is necessary in the
future Please be advised, any dewatering activity is prohibited at this mine site unless you have applied for and obtained
an NDPES General Permit for mine deNNatering (NCG020000) Discharging without a permit is a violation of the North
Carolina General Statute 143-215 1(a)(1) and is subject to a civil penalty assessment of up to $25,000 00 per day

mine site However, the following information is needed to continue processing your
application
Revise the mine plan to show the locations and dimensions of the stilling basin
and level spreader The stilling basin should have proper energy dissipation at
the outlet structure
2 Provide proof that the wetland delineation on the mine plan has been approved
by the Army Corps of Engineers
3 Provide proof your company is in the process of obtaining an NPDES permit from
the Division of Water Quality Please contact Linda Willis at (910) 796-7343 to
