Land Quality • Geodetic Survey Division of Land Resources 1612 Mail Service Center, Raleigh North Carolina 27699 1612 512 North Salisbury Street Raleigh North Carolina 27604 Telephone 919 733 38331 FAX 919 715 8801 • Internet http Hwww dlr enr state no us/index h1rd An Equal Opportunely I Affirmative Action Employer — 50% Recycled 1 10% Post Consumer Paper Certified Mail Mr Norris Page Two The haul road has been cut into the side of a hill There is an approximate 15- foot cut bank that has been eroding The haul road has a ditch on the uphill side that is not stable The ditch drains to a pipe under the haul road There is a steep bank on the downhill side of the haul road that has no means of stabilization The silt fence that was installed on site was not properly anchored according to the detail shown on the map There are inadequate measures in place to prevent off -site sedimentation 3) Operating Condition No 4C Mining activities shall occur as indicated on the mine map received by the Land Quality Section on July 15, 2009 and the supplemental information received by the Land Quality Section on October 17, 2008, October 23, 2008, December 17, 2008, February 5, 2009, February 10, 2009, June 8, 2009, July 7, 2009 and July 15, 2009 The approved mine map indicates that the haul road was existing and approximately 12 feet wide The haul road is now approximately 45 feet wide as measured with a measuring wheel and appears to have been recently graded The haul road has been cut into a hill and the area designated on the approved mine map as unexcavated buffer In addition, an additional area has been mined outside the limits of disturbance shown on the mine map Widening of the road and expansion of the mine excavation has not been approved by the Department prior to land disturbance 4) Operating Condition No 6 The angle for graded slopes and fills shall be no greater than the angle, which can be retained by vegetative cover or other adequate erosion control measures, structure or device In any event, exposed slopes or any excavated channels, the erosion of which may cause off -site damage because of siltation, shall be planted or otherwise provided with groundcover, devices or structures sufficient to restrain erosion The slopes on the uphill side of the haul road are nearly vertical in some areas and appeared to be steeper than 2 1 in other areas The downhill slopes of the haul road also appeared to be 1 1 to vertical The slopes on the mined area outside the limits of disturbance are vertical or concave All slopes noted above are at an angle that cannot be retained by vegetative cover or other adequate erosion control measures, structure or device 5) Operating Condition No ^9 Sufficient buffer (minimum 50 foot undisturbed except for the placement of any necessary screening berms or tree planting) shall be maintained between any excavation and any mining permit boundary to protect adjacent property i Certified Mail Mr Norris Page Three -
