Skvarla, III Secretary Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are forwarding the attached NPDES permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). The Division reviewed your comments on the draft permit. Your comments are summarized below followed by the Division's response: • Revise the flow trigger for the effluent monitoring requirements to go from 24 MGD to 26.5 MGD to reflect language in 15A NCAC 02H .0223 (from 90% of permitted flow on a maximum monthly basis to 90% of permitted flow on annual average flow basis) — The 90% rule in 15A NCAC 02H .0223 is designed to insure that WWTPs don't exceed the hydraulic treatment capacity of the treatment system. Based on this rule the permittee must initiate permitting when flow reaches 90% of average annual flow to allow for enough time to obtain the necessary permits and complete construction of new facilities. Your permit was modified in 2010 to allow for the higher flow tier. An Authorization to Construct was approved in 2011 and an Engineering Certification received for the modification of the WWTP to handle the interim flow of 26.5 MGD, therefore the trigger was established as 90% of the permitted flow on a monthly average basis. 1617 Mail Service Center, Raleigh, North Carolina 27699-1617 Location: 512 N. The three year data period used for the evaluation was April 2010 to April 2013 which corresponded to the same data period used for your RPA and permit renewal. All the parameters except TSS meet the criteria for monitoring reduction. The three year arithmetic mean of effluent data for TSS is higher than fifty percent of the monthly average permit limit. Monitoring frequencies for CBOD, NH3N and fecal coliform were reduced to 2/week. • Change sample type for mercury from composite to grab - The Division agrees that the sample type was incorrect and the change is reflected in the final permit. • Modify monitoring frequency for Total Mercury and Selenium to quarterly for two years, then annually for the remainder of the permit term — Quarterly sampling will remain in the permit. After collecting 2 years of data you can request that the Division modifies the permit to reduce monitoring based on the results of the collected data. • Reduce monitoring frequency for CBOD, TSS, NH3N, and fecal coliform (26.5 MGD & 34 MGD) — The Division can't grant this request until the facility has been operating and collecting data for three years at the higher flow tiers. • Modify instream monitoring frequency to correspond with the monitoring frequencies specified in the YPDRBA Memorandum of Agreement with the DWR —The frequencies specified in the permit for instream monitoring follow monitoring frequencies established in 15A NCAC 2B .0508. The frequencies established in the agreement are less stringent than the permit so that the collaborative monitoring efforts are more efficient and effective. By participating in the YPDRBA the permittee is exempted from the instream monitoring requirements in the permits (See A.(L) note 6 on your permit). • Revise note 7 in in Condition A.(2) to reduce record retention period specified in 7(a) and delete 7(c) — The requirements included in note 7 were developed at the time of the WWTP re -rate to ensure that the pump stations are adequately sized to handle the higher flow. This condition was agreed upon with WSACC at the time the permit was modified. As the facility is still operating at the lower flow tier of 24 MGD and the system has not been tested for the higher flows note 7 will remain in the permit as previously written. • Delete last paragraph in Chronic Toxicity test condition that states "If the Permittee monitors any pollutant more frequently than required by this permit, the results of such monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT Form submitted." — This language comes from requirements in 40 CFR 122 and is included in the whole effluent toxicity special condition as it applies to data collected for the WET tests as well as data collected for the DMRs. The whole effluent toxicity special conditions are standard for every permit therefore the Division will not modify the language in the permit at this time. • Delay development of Mercury Minimization Plan (MMP) — The Division can't delay the implementation of the MMP. As part of the implementation strategy of the Statewide Mercury TMDL the Division implemented a permitting guidance approved by the Environmental Management Commission and the EPA establishing criteria to develop a Water and Sewer Authority of Cabarrus County November 8, 2013 Page 3 of 4 MMP. Your facility meets the criteria of discharging greater than 2 MGD and has detected mercury in the effluent above 1 ng/l. • Review reasonable potential analysis for copper and nickel — The Division found a transcription error in the data used for the RPA for copper and nickel and reviewed the calculations with the correct values. The high values for nickel (33 ug/1) and copper (43 ug/1) were corrected to 4 ug/l for copper and 3 ug/l for nickel. The results of the RPA did not change after the revision was made therefore no changes are necessary in the permit for these parameters. In addition to the modifications to the permit in response to your comments the permit includes a special condition describing new requirements for electronic reporting. Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and specify that, if a state does not establish a system to receive such submittals, then permittees must submit DMRs electronically to the Environmental Protection Agency (EPA). The Division anticipates that these regulations will be adopted and is beginning implementation. The requirement to begin reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR) internet application has been added to your final NPDES permit. [See Special Condition A. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Resources or permits required by the Division of Land Resources, the Coastal Area Management Act or any other federal or local governmental permits that may be required. As of this permit issuance, any previously issued permit bearing this number is no longer effective. Additional Influent Pump Station/Flow Monitoring Requirements specific to 26.5 MGD Rerate Effluent Sheet: a. Flow monitoring for the two influent pump stations (Lower Rocky River and Main) including peak hourly flow, and daily flow. Monitoring shall also include pump run times, both for individual pumps and pumps running in combination, in order to establish the number of pumps required to run for peak flow events. Records shall be maintained for 10 years and made available to the Division upon request. b. Annual reporting for each influent pump station outlining all wet weather events where all pumps were required to run to handle peak flows. This annual report shall be submitted to the Mooresville Regional Office along with rainfall amounts specific to the wet weather flow event. This report does not supersede any other reporting requirements. The report shall also indicate whether any reportable overflows occurred at either pump station. c. Flow monitoring of individual jurisdictional bulk customers (i.e., local government units) that are tributary to the WSACC system. Records shall be maintained for 10 years and made available to the Division upon request. Basins with the highest peak flows compared to average daily flow shall be discussed with the local government unit and the WSACC Board with respect to targeted sewer rehabilitation in those specific individual drainage basins. (3) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS [34.0 MGD] During the period beginning with the receipt of an Engineer's Certification of Completion for expansion to 34 MGD, and lasting until permit expiration, the Permittee is authorized to discharge from Outfall 001. Variable Frequency — The Permittee shall collect instream samples three times per week (3/week) during the summer months of June, July, August, and September; and once per week (1/ week) during the months of April, May, and October only. Effluent shall contain no floating solids or foam visible in other than trace amounts. A. (4) CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 59.6% (24 MGD); 62% (26.5 MGD) and 67.7% (34 MGD). The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised December 2010, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised- December 2010) or subsequent versions. The tests will be performed during the months of February, May, August and November. These months signify the first month of each three month toxicity testing quarter assigned to the facility. Effluent sampling for this testing must be obtained during representative effluent discharge and shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -December 2010) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, Form AT-3 (original) is to be sent to the following address: Attention: North Carolina Division of Water Resources Environmental Sciences Section 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Assessment of toxicity compliance is based on the toxicity testing quarter, Page 8 of 14 Permit NC0036269 which is the three month time interval that begins on the first day of the month in which toxicity testing is required by this permit and continues until the final day of the third month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Resources indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently than required by this permit, the results of such monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT Form submitted. (6) CLARIFICATION OF COMPLIANCE WITH PERMIT LIMITS SET AT OR BELOW MINIMUM LABORATORY PROCEDURE LEVELS The following definitions apply to this permit [REF: EPA National Guidance for the Permittiniz, Monitoring and Enforcement of Water Quality -Based Effluent Limitations Set below Analytical Detection/ Quantitation Levels (DRAFT), March 22, 1994]. The Method Detection Limit (MDL), as defined by a specific laboratory method, is the minimum concentration that can be measured and reported with 99 percent confidence that the parameter is greater than zero (i.e., the analyte is detectable or identifiable at this level, but not quantifiable). The Minimum Level (ML) is higher than the MDL, and is defined as the sample concentration equivalent to the lowest detectable level of the calibration standard not requiring extrapolation, i.e. the lowest quantifiable level, as defined by a specific analytical procedure. 2. In cases where the Division sets a parameter limit at the ML (as required to protect the receiving -stream environment), the Division shall consider any report of that parameter at or below the ML to be in compliance. Example 1: If the ML is 10.0 µg/L and the permit limit is 10.0 µg/L, any report of 10.0 µg/L or <10.0 µg/L shall be considered compliant with the permit. 3. In cases where the Division sets a parameter limit below the ML (as required to protect the receiving - stream environment), the Division shall consider any report of that parameter below the ML to be in compliance. Example 2: If the ML is 10.0 µg/L and the permit limit is 2.0 µg/L, a report of IOgg/L shall not be compliant, but a report of <10.0 shall be considered compliant. A. (7) CLARIFICATION OF SAMPLE COLLECTING UNDER HAZARDOUS CONDITIONS In accordance with North Carolina State Regulations 15A NCAC 213.0505(c)(4), the Permittee may discontinue receiving -stream monitoring and sample collecting when flow conditions or extreme weather conditions could result in injury or death of the person(s) collecting the samples. In such cases on the day of sampling, the Permittee shall record and justify the discontinuance, and furthermore, shall include this justification in that month's monitoring report. This provision shall also apply to influent and effluent sampling. Page 11 of 14 Permit NCO036269 A. (8) MERCURY MINIMIZATION PLAN The permittee will develop and implement a mercury minimization plan during the term of this permit. The MMP shall be developed 180 days from the effective day of the permit, and shall be available for inspection on - site. A sample MMP was developed through a stakeholder review process and has been placed on the Division website for guidance (http://portal.ncdenr.org/web/wq/swM/ps/npdes, under Mercury Minimization Plan). The MMP should place emphasis on identification of mercury contributors and goals for reduction. Results shall be summarized and submitted with the next permit renewal. A. (9) ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and specify that, if a state does not establish a system to receive such submittals, then permittees must submit DMRs electronically to the Environmental Protection Agency (EPA). The Division anticipates that these regulations will be adopted and is beginning implementation in late 2013. NOTE: This special condition supplements or supersedes the following sections within Part II of this permit (Standard Conditions for NPDES Permits): • Section B. (11.) (a)1 Beginning no later than 90 days from the effective date of this permit, the permittee shall begin reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR) internet application. Monitoring results obtained during the previous month(s) shall be summarized for each month and submitted electronically using eDMR. The eDMR system allows permitted facilities to enter monitoring data and submit DMRs electronically using the internet. Until such time that the state's eDMR application is compliant with EPA's Cross -Media Electronic Reporting Regulation (CROMERR), permittees will be required to submit all discharge monitoring data to the state electronically using eDMR and will be required to complete the eDMR submission by printing, signing, and submitting one signed original and a copy of the computer printed eDMR to the following address: NC DENR / DWR / Information Processing Unit ATTENTION: Central Files / eDMR 1617 Mail Service Center Raleigh, North Carolina 27699-1617 If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being physically located in an area where less than 10 percent of the households have broadband access, then a temporary waiver from the NPDES electronic reporting requirements may be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1. 1, 2, 3) or alternative forms approved by the Director. Duplicate signed copies shall be submitted to the mailing address above. Requests for temporary waivers from the NPDES electronic reporting requirements must be submitted in writing to the Division for written approval at least sixty (60) days prior to the date the facility would be required under this permit to begin using eDMR. Temporary waivers shall be valid for twelve (12) months Page 12 of 14 Permit NC0036269 and shall thereupon expire. At such time, DMRs shall be submitted electronically to the Division unless the permittee re -applies for and is granted a new temporary waiver by the Division. (d)1 All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part II, Section B. (11.)(a) or by a duly authorized representative of that person as described in Part II, Section B. (I 1.)(b). A person, and not a position, must be delegated signatory authority for eDMR reporting purposes. For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user account and login credentials to access the eDMR system.
