The following is the response to item 1 of your previous email:
The entrance was moved further toward the intersection of Highway 280 by the applicant in order to take traffic
off the shared private road as soon as possible. The entrance to Hunter Automotive will have heavy individual
customer use but also frequent large vehicle such as trailers, tow -trucks, other over -sized vehicles. The
applicant is going to the added cost trying to minimize the impact to the shared road and the adjacent business
by moving their entrance to the north.
In addition, the applicants preferred alternative was to modify the project by redesigning the road further to the
north and connecting to Highway 280 at the current intersection with French Broad Lane. However, this
alternative was abandoned when it as determined that a driveway further north would impact approximately 80
linear feet of stream.
Please let us know is a site visit would be beneficial, we would be more than happy to set up a time to meet you on -site.

Tyson,
On October 16, 2019, the Division of Water Resources (Division) received your application requesting a 401 Water
Quality Certification from the Division for the subject project. The Division has determined that your application is
incomplete and cannot be processed. The application is on hold until the following item is addressed:
1. It appears from Google Earth imagery that the previously proposed northern access road alignment is currently
being used for construction access. Please clearly explain why the previously proposed northern access road
alignment cannot be used for permanent access and why it is necessary to re -align the road resulting in
additional wetland impacts. [15A NCAC 02H .0506(f) and (g)]
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the
proper consideration of the application. If all of the requested information is not received, the Division will be unable to
approve the application and it will be returned.
