This permit, issued on r1 -- 11-31 --- q11 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. 1) The project authorized herein must be carried out in strict compliance with work plan for upland development dated 5/2/97, with dock alignment deleted by DCM, and work plan for modified dock layout, "Revised Slip Layout" dated 6/17/97. 2) This permit does not authorize excavation at the boat lift or any other excavation or filling in the Northeast Cape Fear River and adjacent coastal wetlands. Docking Facility Construction 3) Prior to any construction of the docking facility, an Easement must be obtained from the State Property Office, Department of Administration, telephone: 919/733-4346. Attached sheet for Additional Conditions Signed by the authority of the Secretary of DEHNR and the Chairman of the Coastal Resources Commission. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. Archaeological Investigation Relic Warf and Crib Structures 5) If these archaeological remains cannot be avoided during construction and thus, destruction or disturbance is imminent, then the following requirements apply: a) Wharf and crib structure. An archaeologist shall record the details of this structure. Portions of the original backfill should be screened to determine the date of construction. Archival research should be conducted to comple- ment the archaeological findings. b) Piling removal. Prior to the removal of any pilings, each shall be surveyed and plotted on the project map. C) If the permittee discovers any previously unknown historic or archaeological remains while accomplishing the authorized work, he will immediately notify DCM and the Wilmington District Engineer who will initiate the required State/ Federal coordination. Upland Development 6) The Division of Water Quality approved the project proposal on June 23, 1997 under Stormwater Management Permit No. SW8976403. Any violation of this SWMP will be considered a violation of this CAMA permit. NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land-disturbing activity. Submit this plan to the Dept. of Environment, Health, and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405-3845. Bennett Brothers Yachts, Inc. NOTE: The Division of Water Quality approved the wetland fill aspect of this project on February 7, 1997 under Water Quality Certification #3131. NOTE: The permittee is advised to contact the New Hanover Mosquito Control Office for consultation on the prevention of mosquito breeding on the project property. 7) No wetlands will be filled on the permittee's tract, except that delineated in the planview dated 5/2/97. Marina and Facility Operation 8) A Pre-Treatment Permit must be obtained from the City of Wilmington prior to initiating construction. Contact the Wilmington Pre-Treatment Coordinator. 9) The washing of vessels, equipment, etc., shall be done in such a manner which will not result in runoff of wash water into surface waters. All accumulated solids from the washing of boats must be collected and properly disposed of in keeping with local and/or state rules. 10) Prior to the occupancy of any slips authorized under this permit, the marina will install and maintain for the life of the project a sewage pumpout facility to service boats with holding tanks. 11) The marina will display a sign showing the location of the onsite pumpout facility, and other appropriate waste disposal information, at the entrance and exit from the main piers. 12) No sewage, whether treated or untreated, shall be discharged at any time from boats using the marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Bennett Brothers Yachts, Inc. ADDITIONAL CONDITIONS Permit ##90-97 Page 4 of 4 NOTE: It is strongly recommended that the permittee exercise all available pre- cautions in the day-to-day operation of the facility to prevent sand blasting residue and/or other facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene state water quality standards, thereby violating state laVv. 13) This permit does not authorize the interference with any existing or proposed Federal project. The permittee will not be entitled to compensation from existing or future operations undertaken by the United States in the public interest. 14) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or next to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 15) The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U. S. Coast Guard, through regulations or otherwise, on authorized facilities. At a minimum, permanent reflectors or reflective material will be affixed to the ends of all piers and maintained for the life of the project. 16) It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats. The permittee will not hold the United States liable for any such damage. 17) The permittee will maintain the authorized work in good condition and in concordance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having the permit transferred to a third party. Cape Fear River at 3rd Street Bridge, as you described in your application dated 15 November 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3025. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. CERTIFICATION THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of Water Quality (DWQ) Regulations in 15 NCAC 2H, Section .0500 to Bennett Brothers Yacht, Inc. resulting in 0.32 acres of wetland impact in New Hanover County pursuant to an application filed on the 16th day of January of 1997 to construct a yacht manufacturing and maintenance facility. The application provides adequate assurance that the discharge of fill material into the waters of the Northeast Cape Fear River in conjunction with the proposed development will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. This approval is only valid for the purpose and design that you submitted in your application, as described in the Public Notice or as modified below. If you change your project, you must notify us and you may be required to submit a revised application. PROJECT SUMMARY: Applicant proposes to construct a yacht manufacturing and maintenance facility, including a 52 slip marina. Bennett Brother's Yachts, Inc. Page 2 9. PROJECT DESCRIPTION 11/08/96 The project site is located adjacent to the Northeast Cape Fear River, approximately .85 miles north of its division with the Cape Fear River. This property abuts the state right-of-way for the 3rd street bridge on the north side, and fronts J.E.L. Wade Drive. The tract is approximately 19.73'acres in size, and extends from 6' to 35' above mean sea level. The soils are sandy, and support Loblolly Pine, Wax Myrtle, Red Maple, Privet, and various vines such as Poison Ivy, Catbrier, and Micheaux Grapes. There are some foundation remnants on the property along with a brick shed. There are no existing sewer or water utilities serving the site. As the elevation drops, there is a significant amount of Section 404 Wetlands on the tract, which have been delineated and approved by the US Army Corps of Engineers on 4/24/96 (approved survey on file). Closer to the river, there are coastal wetlands, predominantly vegetated with S artina alterniflora and S artina cynosoroides. Toward the southern end of the property, there is Ty hha latifolia and Cladium jamaicense. As this wetland fringe widens, the proposed development narrows and terminates. The Northeast Cape Fear River is approximately 740' across at the project site. The New Hanover County Land Use Plan classifies the area as Conservation/Developed; the Division of Marine Fisheries has designated the waters of the river at this point as Primary Nursery Area; there is no shellfish resource; the Division of Water Quality classifies the waters of the river at this location as SC swamp. There has been no archeological assessment done on the project site. An Environmental Assessment has been submitted for this project, and is in circulation. No Stormwater or Sedimentation/Erosion Control Plans have been submitted for this project yet. The proposed project is the Bennett Brothers yacht manufacturing and repair facility, complete with a 52 slip marina. The facility will consist of a building to house offices, four public toilets, and a shop for the sale of marine supplies, and a factory building for the manufacture and repair of large sail and motor yachts, typically 70 in length with a maximum of 100' in length expected. The facility will utilize existing public mains to tie into the city sewer and water systems. The proposal is to grade approximately 8 acres of the tract, which includes approximately 14,180 square feet of adjacent delineated Section 404 Wetlands in two sections. The existing elevation of these wetlands is approximately +8.5' msl. The intent is to add 3.5' to 6.5' for a finished elevation of +12' to + 15' msl. The graded area is to be used for the lift roadway and workyard. There is to be a 3:1 vegetated slope along the sides of the roadways. Concrete and ABC stone will be used for the paved areas, constituting approximately 8.3 % impervious surface coverage within the 75' Estuarine Shoreline AEC. A stormwater pond, approximately 1 acre, is proposed at the northwest side of the tract. A "Novachem" system is proposed as the wastewater treatment system, providing an oil/water separator. Wastewater is to be discharged after treatment into the City's sanitary sewer system. Information about the Novachem system is available in the file, however, no engineering spec's or performance data were provided. Solid waste will be hauled offsite by contract. A marina will be constructed for the purpose of mooring client vessels and new vessels, as well as renting slips and providing transient dockage. Fifty two slips are proposed. The marina is composed of three piers, 150' x 8', 40' x 8' and 30' x 8', elevated over and extending across the wetlands, connecting to two main floating docks, 1086' x 8' and 631' x 8'. From these, 54 finger docks extend, ranging from 60' to 100' in length, all to be 4' wide. There is a lift slip proposed between the two floats that is 132' x 30'. The structure terminates 90' short of the federal channel at its watermost point. The river depth is approximately -25' mlw at the project terminus. The project stops approximately 25' short of the riparian corridor to the north, and approximately 175' short of the riparian corridor to the south. The project extends approximately 240' into the body of water at its southern end, 130' at mid-point, and 110' for the northern half of the project. Although the applicant states that the project supports 52 slips, there is sufficient water depth and distance from the shoreline and vegetation to moor approximately 10 vessels of the proposed sizes behind the float for the southern portion of the dock (appr 750'). Indeed, the artist rendering on the submitted platwork shows vessels at this location. There is a proposed fuel dispenser to be located on the dock south of the lift slip. The connecting tanks are to be housed within block walls above ground in the lower work yard. A portable holding tank is proposed to be located on the floating docks. There will be 2 "Pumpout Available" signs on the dock, as well as 2 "No sewage Discharge" signs. The marina policy will be "Closed Head" by contractual agreement, as well as by signage on the docks. Overnight dockage will be allowed, but the policy will not allow "Live-aboards". 10. ANTICIPATED IMPACTS This proposal is in keeping with the historical commercial use of the riverfront property in this area. As proposed, the facility will shade approximately 480 square feet of Section 404 Wetlands and 640 square feet of coastal wetlands. The marina will incorporate approximately 3.67 acres of Public Trust Area in the Northeast Cape Fear River. Improvements for the work yard area will fill and/or pave approximately 14,180 square feet of Section 404 Wetlands, and approximately 7.98 acres of high ground. The south end of the property appears to be ideally suited for mitigation of this loss. A total area of approximately 12 acres will be disturbed for this project. The facility will bring about an increase in boat traffic at this part of the river. The storage and use of the chemicals involved in the manufacture and repair of large vessels may present a hazard to the estuarine system. This aspect of the project needs to be tightly controlled and monitored. The human error consideration probably provides the greatest risk. The proposed facility will upgrade the community by eliminating the current use of the property. The Division of Environmental Management (DEM) is responsible for the issuance of the Section 401 Water Quality Certification for activities which impact waters of the state including wetlands. The following comments are offered in response to the EA. The DEM concurs with the applicant that the project location will not significantly impact wetlands. The stormwater issues as mentioned in this document will be handled during the permit process. The applicant may contact Linda Lewis of the DEM Wilmington Regional Office regarding stormwater issues. The applicant is reminded that endorsement of an EA/FONSI by DEM would not preclude the denial of a 401 Certification upon application if wetland impacts have not been avoided and minimized to the maximum extent practicable.
