The proposed sewer easement is located within the Town of Apex Nature Park. This area is a forested, undisturbed park
site. The area surrounding the park site is comprised of single family, residential homes.

The purpose of the proposed sewer line is to provide sewer to existing residential development in the surround area.

The proposed sewer line will connect to the existing Hollands Crossing pump station located on the North side of Beaver
Creek. The location of the pump station necessitates the proposed temporary impacts to Beaver Creek and the adjacent
wetlands/beaver impoundments. Equipment typical to sewer installations will be utilized including a wide-tread track hoe
that only displaces 2.54 pounds per square inch (to limit wetland soil compaction).

It should be noted that the location of the proposed sewer line is on the Town of Apex Nature Park site. This park site
was part of the Town of Apex mitigation plan for impacts associated with the installation of the Evan's Road extension
(USACE AID 200800336; DWQ Project No. 08-0960). Per the Conservation Declaration, the Town of Apex reserved the
right for "Encroachment for New Utilities" through the Nature Park site (see attached Conservation Declaration, Article Il,
Section G., approved by the USACE and recorded with Wake County).

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
As stated earlier, the majority of the area adjacent to Beaver Creek is completely inundated due to beaver activity. The
Town of Apex and the project engineer conducted several site visits to determine the best locations for the proposed utility
crossing. The corridor chosen to install the sewer line utilized as much of the high ground/upland area as was feasible.
The location of the existing Hollands Crossing pump station necessitates the crossing of Beaver Creek, at the proposed
location. The majority of the location of the sewer line within the inundated/wetland area is devoid of trees due to on-
going beaver activity (see attached photographs). Directional drilling or boring is not feasible due to elevation issues at
the pump station tie in (i.e. the pump station is at a higher elevation than Beaver Creek and the adjacent
wetland/inundated areas). The applicant recognizes that the proposed temporary impacts for the sewer line installation
will be for the minimum period of time required to complete the activity and that the stream and wetland areas must be
returned to pre-impact conditions. The proposed sewer line construction corridor as well as the proposed permanent
easement corridor is only 20 feet wide (i.e. does not exceed 40 feet in width). The proposed sewer line is not anticipated
to interfere with navigation nor is it proposed to be aerial in nature. While the proposed sewer line does incur wetland
impact, the wetland and stream are completely inundated and devoid of trees due to on-going beaver activity (i.e. not
forested). It has been our experience that the USACE will not require compensatory mitigation for the maintenance
corridor within a non-forested wetland. No rip-rap is proposed for the stream crossing for the proposed sewer line
installation.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Per discussions with the engineer, all construction activities in the wetland area will be limited to a 20' wide corridor. As
each section of sewer main is installed the ground elevations will be restored and seeded with wetland type grasses
immediately. The sewer alignment was determined in the field to minimize the impacts to trees and wetlands while
allowing more efficient installation techniques to minimize negative impacts.

We have reviewed the "DRAFT Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated
Wetland Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The proposed
sewer line installation does not meet any of the "growth stimulating" criteria. Additionally, the proposed sewer line is
within a developed landscape; it is the surrounding residential area that necessitates the need for the sewer extension
and connection to the Hollands Crossing pump station. We anticipate that you will advise us if a qualitative or quantitative
impact analysis is required.

the proposed project, or available capacity of the subject facility.
It is not anticipated that this project will generate any waste water. Further, the Town of Apex will insure that the capacity

CONSERVATION DECLARATION
This DECLARATION OF CONSERVATION COVENANTS, CONDITIONS and
RESTRICTIONS ("Declaration" or "Conservation Declaration") is made and executed on. this the
-.20th, day of January 2009 by the TOWN OF APEX, a municipal corporation, organized and doing
business as authorized in Chapter 160A of the North Carolina General Statutes, with its principal office
located at PO Box 250, Apex, North Carolina 27502 ("Declarant").
RECITALS AND CONSERVATION PURPOSES
A. Declarant is the owner, in fee simple of that certain tract of land conveyed to it by the
deeds recorded in Deed Book 8309. Page 519 and Deed Boole 9002, Page 2333, Wake County Registry
(the "Town Tract"). The property subject to this Declaration is an 18.77 acre portion of the Town. Tract
being more particularly shown as that certain area designated as "Conservation Declaration Area" on that
certain survey dated September 25, 2008 entitled "Conservation Dedication Survey for Town of Apex"
and prepared by Smith and Smith surveyors and. being recorded in Book of Maps ?cCcl, Page b5 -Q
Wake County Register of Deeds (hereinafter the "Survey"). The Survey is hereby fully incorporated
herein by reference. The 18.77 acre area subject to the restrictions imposed by this Declaration is
hereinafter referred to as the "Conservation Declaration Arca" or "Declaration Area."
B. Declarant has agreed and desires to create the Conservation Declaration. Area in order to
preserve, enhance, restore, and maintain natural features and resources, to provide habitat for native plants
and animals, to improve, maintain. and protect water quality, and to control runoff of sediment,
(hereinafter referred to collectively as the "Conservation Values").
NOW, THEREFORE the Declarant hereby unconditionally and irrevocably declares that the
Declaration Area shall be held and subject to the following restrictions, covenants and conditions as set
out herein, to run with the Declaration Area and to be binding on all parties that have or shall have any
right, title, or interest in said Declaration Area.
ARTICLE I. PURPOSES & DURATION OF DECLARATION
The purposes of this Declaration is to protect wetlands, riparian areas and surface waters within
the watershed where the Declaration Area is located, and to protect and prwme the forested, wildlife,
natural heritage and other Conservation Values of the Declaration Area, to the end that the waters flowing
over it and the waters into which those waters flow may be preserved in quality and protected, without the
deleterious effects that may arise from the uses or development of the Declaration Area which are

prohibited herein. The preservation of the Declaration Area as provided herein is a condition of
Department of the Army permit Action ID SAW-2008-00336 issued by the Wilmington District Corps of
Engineers (Corps), required to mitigate for unavoidable impacts to waters of the United States authorized
by that permit, and this Conservation Declaration may therefore be enforced by the United States of
America.
ARTICLE IL RIGHTS RESERVED TO DECLARANT
Declarant reserves certain rights accruing from the fee simple ownership of the Declaration Area,
including the right to engage in or permit others to engage in the uses of the Declaration Area that are not
inconsistent with the purpose(s) of this Conservation Declaration. All rights reserved by the Declarant,
are reserved for Declarant, its representatives, successors, and assigns, and are considered to be consistent
with the conservation purposes of this Conservation Declaration. The provisions, conditions, and
restrictions of this Conservation Declaration apply only to the Conservation Declaration Area. Declarant
shall continue to own and may use the Town Tract outside the Conservation Declaration Area in any
lawful. manner. With respect to the Declaration Area, Declarant expressly reserves the following rights:
A. Passive Recreational Use. Declarant reserves the right to engage and to permit others
to engage in passive recreational uses of the Declaration Area for activities requiring no or minimal
surface alteration of the land, so long as related alterations, construction, improvements, maintenance,
activities and uses do not pose a threat to the Conservation Values of the Declaration Area.
B. Public Use and Access. Declarant reserves the right to allow public access and use of the
Declaration Area for purposes consistent with those associated with. a public park including recreational
activities such as: conducting educational tours, scientific study, animal/plant observation, walking,
biking, fishing, picnicking, and any other purposes consistent with these accepted uses. To accomplish
the above uses, the Declarant may construct paved or unpaved greenway trails, foot bridges, picnicking
areas, and utility improvements as provided and permitted by this Conservation Declaration.
C. Greenway 'T'rails. Declarant reserves the right to construct paved or unpaved greenway
trails within the Declaration Area with up to six (6) stream crossings. The greenway trails shall have a
maximum width of fifteen (15) feet wide inclusive of the trail surface and the shoulders consistent with
the Town of Apex Standards for Public Greenway Trails. Except for crossings, all trails must be located
at a minimum distance of fifteen. (15) feet from the top of the bank of Beaver Creek, unless such locations
are physically impracticable. In the construction of such trails and when required by the terrain,
boardwalks, ramps and handrails are permitted herein. All trails and associated improvements must
comply, and are permitted by this Declaration to comply, with the rules and regulations of the Americans
with Disabilities Act 1990, and amendments thereto. The Declarant may also construct and maintain parr
benches, litter receptacles, and trail/feature signs along the greenway trails; any of these features must be
constructed no closer than 15 feet from the top of bank of Heaver Creek. The stream crossings shall be
bridged :From top of bank to top of bank in order to protect the stream, and no footings will be placed
within five feet of top of bank.. The Town agrees to go through all required permit processes and utilize
recommended review agency construction methodology for any stream. crossings.

D. Pedestrian Foot Bridges. Declarant reserves the right to construct and maintain
pedestrian foot bridges with a maximum of fifteen (15) feet including all rails and supports in compliance
with the American Association of State Highway and Transportation Officials ("AASHTO") and with the
Americans with Disabilities Act 1990, and amendments thereto. Such bridges may be constructed across
Beaver Creek, provided such bridges are connected to the greenway trails permitted herein. All necessary
care shall be taken to complete the construction of such features in a manner so as not to cause or allow
sedimentation either during or after construction. Bridges and boardwalks will be constructed using pile
driven, timber pier, construction (i.e. non-impact). Concrete bridge footings for, stream crossings will be
placed at least five (S) feet from top of bank of the stream to avoid impact to the stream. Any walkways
within a wetland area shall follow requirements of the Army Corp of Engineers ("ACOE") for
construction (eg. boardwalk, natural surfacing, etc.); before construction of any walkway within a wetland
area, permits, or a written statement that permits are not required, will be obtained from the ACOE.)
E. Storm water Management Features. Declarant may construct and maintain storm
water control measures within the Conservation Declaration Area. Declarant may not construct storm
water control measures within the Conservation Declaration Area that are required for structures
constructed outside the Declaration Area (e.g., stormwater ponds required for structures, outside the
Declaration Area may not be placed within the Declaration Area).
F. Cleanup, Mewing and Landscaping. Declarant shall perform all activities necessary to
limit erosion, reduce runoff, filter sediment, and reduce mowing, in order to minimize risk to the
Declaration Area and the environment. All improved areas shall be maintained at the minimum level
required for the uses permitted herein. Outside of such areas, the Declarant shall take steps as appropriate
to encourage and promote natural forest and vegetative succession. In order to accomplish these actions,
Declarant agrees to implement Best Management Practices, as provided by the Land Quality Section,
Division of Land Resources, North Carolina Department of Environment and Natural Resource.
G. Encroachment for New Utilities. The Parties acknowledge that the Town may in the
future be required to construct, install, and maintain new utility lines, which may be required to run
across, through, over or under the Declaration Area. These utilities may include electric, water, sewer,
phone, cable, data or gas facilities. With respect to stream crossings by utilities, the combined length of
all utility corridors located by the Town of Apex within the Declaration Area shall not exceed 400 linear
feet. Additionally, with respect to the Town of Apex utility corridor that needs to run through the
Declaration Area south of and roughly parallel to Beaver Creek, the total length. of utility corridor shall
not exceed 1350 linear feet and said corridor shall not be more than. 40 feet wide. The following
conditions shall apply to the construction, installation and maintenance of such new utility lines.
(1) Pipe and utility fines and corridor and clearing widths for all such construction will. be limited
to the minimum area necessary to construct the needed utilities, subject to size, equipment
sizes and work zone.
(2) All such improvements and uses shall minimize adverse impacts upon the Conservation
Values of the Declaration Area.
(3) All such improvements lines shall be maintained according to the regulations of local and
State governing authorities.

(4) During the course of its design, construction, review and inspection, the Town will take
reasonable steps to ensure that construction and excavation on the Declaration Area will not
harm or impair the permanent ecological, water quality and Conservation Values of the area
under construction.
(5) Following construction, the construction area shall be restored and, re-vegetated to the extent
practical, using, whenever appropriate, suitable grass vegetation, indigenous plant material or
other environmentally appropriate vegetative material. Areas subject to periodic mowing or
clearing for purposes of maintenance, inspection. or repair of the improvements shall be
maintained at the minimum level consistent with applicable regulatory requirements. If
disturbance occurs in order to maintain service or repair the utility lines, the Declaration Area
will be restored to the condition existing prior to the construction to the extent practical and
consistent with the permitted use. Erosion control devices shall be utilized to contain.
disturbed materials and will conform to State requirements.
(5) The depth of underground construction shall be to a sufficient depth to avoid future exposure
due to scouring to the greatest extent reasonably practical and shall be determined acceptable
by an Engineer licensed in North Carolina.
(7) Town and. its authorized representatives shall have the right to enter the Declaration Area ai
all reasonable times to undertake any activities to restore, manage maintain, enhance, and
monitor all such utilities on. the Declaration Area.
(S) The Declarant shall leave the Declaration Area in a clean, natural and undisturbed state
except as otherwise permitted under this Conservation Declaration, and shall comply with
applicable land use regulations, and other applicable laws and ordinances.
Declarant is not prevented by this Declaration from, using, maintaining, repairing and replacing utilities in
the Declaration Area that predated this Declaration.
ARTICLE III. PROHIBITED & RESTRIC'T'ED ACTIVITIES
The Declaration Area shall be left in its natural, scenic, wooded, and, open condition, and
restricted from any development or use that would impair or interfere with the water quality protection
and conservation purposes of this Conservation Declaration, except for those rights specifically reserved
to Declarant in Article lI and the permitted activities outlined herein. The following is a listing of
activities and uses which are prohibited and which, where expressly stated, are permitted, within the
Declaration Area. Declarant and the United States of America have agreed that the activities specifically
allowed do not and will not impair the Conservation Values of the Declaration Area:
A. Industrial and Commercial Use. All industrial and commercial, activities and uses, and
any right of passage for such purposes, are prohibited except for the utilities allowed in Article 11, Section
G.

B. Agricultural, Timber Harvesting, Grazing and Horticultural Use. Agricultural,
timber harvesting, grazing, horticultural and animal, husbandry operations are prohibited within the
Declaration Area.
C. Disturbance of Natural Features. No trees may be cut or removed, and the natural
features of the Declaration Area may not be disturbed, except for: (1) as may be incidental to boundary
marking, fencing, and signage allowed or required hereunder; (2) the selective cutting and prescribed
burning or clearing of vegetation, the minimal application of approved pesticides, for the purposes of fire
containment and protection, disease control, restoration of hydrology, wetlands enhancement and/or
control of non-native plants, and (3) as may be incidental to the Declarant's exercising the rights reserved
in Article II or in furtherance of a permitted activity or use under this Article III.
D. Construction of Buildings and Recreational Use. Except as permitted 'by Article 11 or
III, there shall be no construction or placement of any building, mobile home, asphalt or concrete
pavement, billboard. or other advertising display, antenna, utility pole, tower, conduit, line, pier, landing,
dock or other temporary or permanent structure or facility on, above, or below the surface of the
Declaration Area, except for the following: placing and display of safety, no trespassing signs, local, state
or federal tra'lic or similar information signs, fencing, signs identifying the Conservation Values of the
Property, educational and interpretive signs, identification labels or any other similar temporary or
permanent signs.
E. Mneral Use, Excavation, Dredging. There shall be no filling, excavation, dredging,
mining or drilling; no removal of topsoil, sand, gravel., rock, peat, minerals or other materials, and no
change in the topography of the Declaration Area in any manner, except as may be necessary for the
purpose of combating erosion or incidental. to the permitted activities provided by Article 11 or III or other
provision of this Conservation Declaration or incidental to any conservation management practices
otherwise permitted by this Conservation Declaration.
F. Wetlands and Water Quality. No activities causing or contributing to pollution of or
alteration of water bodies will be conducted, permitted, or allowed to continue on the Declaration Area;
furthermore, no activities will. be conducted, permitted, or allowed to continue within the Declaration
Area to the detriment of water purity or that alter natural water levels or drainage, or that contribute to
sedimentation, or that alter surface water flow. This Section shall not prevent the activities allowed in
Article TT or III. Declarant is not prevented by this Declaration from removing obstructions from streams
that would interfere with or cause interference with Declarant's exercising the rights reserved in Article II
or a permitted activity or use under this Article III.
G. Dumping. Dumping of soil, trash, ashes, garbage, or waste, abandonment of vehicles,
appliances, or machinery, or other waste or discarded materials are prohibited within the Declaration
Area.

ARTICLF, Iv. ENFORCEMENT & REMEDIES
A. This Declaration is intended to ensure continued compliance with the mitigation
condition, of authorizations issued by the United States of America, U.S. Army Corps of Engineers,
Wilmington District, and therefore may be enforced by the United States of America. This covenant is to
run with the land and shall be binding on all parties and all persons claiming under the Declarant.
B. Corps, its employees and agents and its successors and assigns, have the right, with
reasonable notice, to enter the Property at reasonable tunes for the purpose of inspecting the property to
determine whether the Declarant, Declarant's representatives, or assigns are complying with the terms,
conditions and restrictions of this Conservation Declaration-
C. Nothing contained. in. this Conservation Declaration shall be construed to entitle Corps to
bring any action against Declarant for any injury or change in the Conservation Property caused by third
parties, resulting from causes beyond the Declarant's control, including, without limitation, fire, flood,
storm, and earth movement, or from any prudent action taken in good faith by the Declarant under
emergency conditions to prevent, abate, or mitigate significant injury to life, damage to Property or harm

Dear Mr. lannone:
In September and October 2009, S&EC conducted a review of records at the North Carolina State Historic
Preservation Office (SHPO) and North Carolina Office of State Archaeology (OSA). The in-depth review
included consultation with cultural resources staff and map room searches for sites and structures of
historical, cultural, and archaeological significance within a 1-mile radius of the subject property. In addition,
a file search for state or federally protected species and significant natural communities within a 5-mile radius
was performed through the Natural Heritage Program (NHP) office located in Raleigh, North Carolina. These
records were updated utilizing the NHP Virtual Workroom (NHP 2009) and by requesting element occurrence
identifications from NHP staff. The USGS map and location of the project site with respect to these
occurrences accompanies this report.
Findings - NC State Historic Preservation Office
North Carolina SHPO maintains records and locations of buildings, structures, and objects that are listed by
local governments as historic landmarks or those which are listed or eligible for listing on the National
Register of Historic Places. The records check at the State Historic Preservation Office revealed no
structures on the property or within a 1-mile radius of the property that appear on the National Registry (NR),
Determination of Eligibility (DOE), Study List (SL), or Locally Designated (LD) lists. North Carolina state law
does not provide protection for properties that are determined eligible but not listed in the National Register.
Neither placement on the Study List nor a formal determination of eligibility by the Keeper of the National
Register has an official role in state environmental review procedures. No structures appearing on the
National Registry list will be impacted by this project. The following list are structures and sites that are
within a one mile radius of the proposed site:

There are no other registered significant historic sites documented within one mile of the property

Findings - NC Office of State Archaeology
The North Carolina Office of State Archaeology records archaeological sites and excavations. The OSA
record check was performed in October 2009. The area surrounding the Apex Sewer Line Expansion Project
has been reviewed by OSA staff and has been determined to be of no archaeological significance. No
significant sites or artifacts are recorded within the site boundaries, and there are no significant or Nationally
Registered historic archaeological locations recorded near the site.

"Threatened Species" (T) means any native species documented by biological research and inventory to be
likely to become an endangered species within the foreseeable future throughout all or a significant portion of
its range within the sate and to have no more than nine occurrences in the state, and any species determined
to be a "threatened species" pursuant to the federal Endangered Species Act, except for such species
determined to be endangered by the Commissioner in accordance with section 4 of this act.

"Candidate" (C) "Taxa for which the [Fish and Wildlife] Service has on file enough substantial information on
biological vulnerability and threat(s) to support proposals to list them as endangered or threatened. Proposed
rules have not yet been issued because this action is precluded at present by other listing activity.
Development and publication of proposed rules on these taxa are anticipated. The Service encourages State
and other Federal agencies as well as other affected parties to give consideration to these taxa in
environmental planning." (Federal Register, February 28, 1996). Taxa formerly in 'Category 1' are now
considered as 'Candidate'.
"Species of Special Concern" (SC) means any native plant species or any native nonharvested wildlife
species documented by scientific research and inventory to have a naturally restricted range or habitat in the
state, to be at a low population level, to be in such high demand by man that its unregulated taking would be
detrimental to the conservation of its population or has been extirpated from the state.
"Significantly Rare" (SR) Species which are very rare in North Carolina, generally with 1-20 populations in the
state, generally substantially reduced in numbers by habitat destruction (and sometimes also by direct
exploitation or disease). These species are generally more common somewhere else in their ranges,
occurring in North Carolina peripherally to their main ranges, mostly in habitats which are unusual in North
Carolina. Also included are some species with 20-100 populations in North Carolina, if they also have only
50-100 populations rangewide and are declining.
Site-specific Findings - NC Natural Heritage Program Records Review
The subject property is located on the New Hill USGS quadrangle. Two federally protected species are
documented within a 5-mile radius of the property. Several Significant Natural Heritage Areas and other
element occurrences of rare plants and animals are located within a 5-mile radius of the property. These
areas and occurrences are listed below. Due to the sensitivity of the locations of rare species, the element
occurrences for plants and animals within a 5-mile radius of the Apex Sewer Line Expansion site are listed
solely by their category on the attached map.

any rare species overlap with the evaluated portion of the Olive Chapel Road Sidewalk Expansion project
(NHP 2009a). No federally listed species are documented within the property boundaries.
Summary
The records search at the Natural Heritage Program revealed that the above-listed species occur within a 5-
mile radius of the project boundaries. No federally listed or other rare species are documented within the
property boundaries; however, several federally and state listed species are documented within a 5-mile

radius of the project boundary. The file search at the State Historic Preservation Office produced no records
of structures on or within a 1-mile radius of the property listed on the National Registry (NR), Determination of

Office of State Archaeology revealed no documented historical archaeological sites, surveys, or artifacts
within or adjacent to the project boundaries. This project will not occur in an area of essential fish habitat
(NOAA 2009), nor will this project impact an area that is designated critical habitat for endangered species.
