I appreciate your information, but unfortunately the buffer rules are not implemented in accordance with the USACE
Jurisdictional determinations. Features are determined to be subject to the buffer rules, or not, based on the language
within the rules themselves. In this case, a DWR buffer determination was completed for the entire project at the time
of initial development. I have attached that determination to this email. In accordance with the determination
conducted the pond in question is subject to the buffer rules as far as I can tell.

Upon further review of the Kingsboro site and the previously completed Jurisdictional Determination
completed by the Army Corps in August 2013, it is shown that the pond in question does not show up on
the report. Therefore we retract the requested PCN Modification. The pond has constructed outlet

structures and is believed to be manmade. Attached (link below) is a copy of the JD with the pertinent
pages occurring on 23 and 42.
The pond on the east is included in the JD; however, we will be the west side of the road and will not have
any impacts to the top of bank or immediate buffers to that pond.
