Jon,
Since the permit was issued based on the description in the PCN (see below) and details on the plans provided, the
agencies will need additional information if the City wishes to keep the riprap in place.
PCN Description below the impact table:
Temporary impacts associated with water line installation as open cut trench excavation. River/Stream beds
and banks to be returned to original
contours and stabilized with coir matting, seeded with native seed mix impacted stream bank areas outside of
the permanent maintenance corridor will
be live staked.
As discussed at our site meeting, there are 2 options:
1). Remove the riprap and stabilize the banks per the description above or
2). Provide a justification for using the riprap including calculations demonstrating that the size rock used will remain
stable during over bank events. Additionally, please submit a revised stream impact table with a permanent impact for
this location and a typical cross-section detail.

Hey Guys, I found the project description that was attached to the PCN submittal that calls for rip rap in the N Fork
Swannanoa. Not sure if this will help their case, but figured I'd give it a shot.

I would like to schedule a site visit. Let me know some dates that would work in the next week or so. Please also
remind the contractor and your construction manager of the following condition of the approved 401. To date, we have
not received any notifications of sediment impacts to waters.
6. The permittee shall report to the Asheville Regional Office any noncompliance with this certification,
any violation of stream or wetland standards [15A NCAC 02B .0200] including but not limited to
sediment impacts. Information shall be provided orally within 24 hours (or the next business day if a
weekend or holiday) from the time the applicant became aware of the circumstances. A written
submission shall also be provided within 5 business days of the time the applicant becomes aware of
the circumstances. The written submission shall contain a description of the noncompliance, and its
causes; the period of noncompliance, including exact dates and times, if the noncompliance has not
been corrected, the anticipated time compliance is expected to continue; and steps taken or planned to
reduce, eliminate, and prevent reoccurrence of the noncompliance. The Division may waive the
written submission requirement on a case -by -case basis.
