Mr. Ruocco mentioned that NWP12 had been used for similar projects in North Carolina. NWP39 (Commercial and Institutional Developments) is commonly used for projects similar to this one; however, the proposed project location is within the 100-year floodplain, which excludes the use of this permit. The Wilmington District strives for consistency, so please provide examples of NWP 12 being utilized for a culvert crossing, an access road, and platform, completely constructed in Waters, including wetlands of the United States. This email serves as official notice that the PCN application you submitted on behalf of Vertical Bridge, LLC for the project in Pamlico County, North Carolina, is incomplete. Please address the following: 1. The cross-section of fill in the Permit Drawings shows two (2) feet of fill. Will there be a slope, or how will this fill be stabilized? One of the drawings shows silt fencing on the southern boundary of the impact area; however, this is not sufficient. A more detailed cross-section needs to be provided. 2. The proposed WOUS crossing was not included in the impacts table. This needs to be calculated, and include a cross-section of the crossing and culvert specifications. 3. In NWP 12 under the Access Roads section, it states that access roads must be constructed so that the length of the road minimizes any adverse effects on waters of the U.S and must be as near as possible to pre -construction contour and elevations. If not, they must be properly bridged or culverted to maintain surface flows. a. There needs to be justification as to why the square platform area needs to be that far from the road and why the access road cannot be shorter. b. There are discrepancies between the PCN and the drawings of how wide the access road will be - will the road be 12 feet or 24 feet wide? c. A cross-section of the top, bottom, and slope height/widths of the road will be necessary to know if it will be to grade, as referenced above. c. The impacts table needs to separate the impacts (area) for the culverted crossing, access road, and square platform after any changes occur from 3a. and 3b. above. 4. Once avoidance and minimization of impacts to aquatic resources have been applied, the Wilmington District requires 2:1 for permanent impacts. The only exception is if an NCWAM form is prepared and shows that the area is low quality, can the 2:1 ratio be reconsidered. The PCN will be considered incomplete until the requested information is received. Based upon review of the information you provide, additional information may be requested. The feature you intend to cross would be considered a Waters of the U.S.; therefore, it would require a NWP 14 (Linear Transportation Projects). NWP14 Regional Condition 4.8.2 authorizes 'only upland to upland crossings..." and based on the project plans provided, there are no uplands. The Corps follows the mitigation types in this order: avoidance, minimization, and compensatory mitigation. Avoidance means avoiding an aquatic resource altogether by selecting the least damaging construction type, spatial location, etc. Minimization means managing the severity of the impact on aquatic resources at the site through, for example, project design. Lastly, compensatory mitigation is required after avoidance and minimization measures have been applied. Applicants must first check to see if a private bank is available, but if not, in -lieu (DMS) is the next option. A 2:1 requirement would be necessary to maintain consistency with our program. For the cross -sectional fill slopes, are you specifically talking around the culvert placement or at any area of the site being filled? The location in review is an approximately 0.43-acre site located off Lowland Road in Hobucken, Pamlico County, North Carolina. The approximate center of the review area is located at 35.2553370N,-76.5766570W. Please find the attached additional information: ACOE Request for Additional Information Updated Exhibit 11 — Letter Dated October 23, 2019 Proposed Impacts Updated Impacts Table to include Grading and Erosion Control WOTUS crossing Plan Cross-section of road crossing/detailed culvert drawings The site was selected based on availability and because it appeared to be uplands based on the adjacent water tower and readily available desktop data such as the National Wetlands Inventory. Based on conditions observed during the site visit, the entire site appeared to be wetlands based partly on the overwhelming amount of Phragmites australis covering the site. The area proposed to be developed will have less impact on hydrology with the current access road length running adjacent to the water tower located immediately north and northwest of the site. If the access road length was altered and shortened, the square tower compound would have to be placed where it will cause a greater impact to the local hydrology as surface water becomes evident further south of the proposed access road location. Please refer to the aerial photographs in the attachments, which shows marsh wetlands south of the proposed access road location. In conclusion, we believe the access road length and square tower placement is the ideal location to minimize hydrological impacts based on the surrounding site conditions. The proposed access road will be 12' wide. The access road is packaged together with the utility easement thus will be 24' wide total. The utility easement is necessary in order to connect to utilities located along Lowland Road. In order to minimize wetland impacts, the proposed access road / utility easement was reduced from 36' wide to 24' wide. All stormwater runoff from the site will sheet flow to the south towards the receiving water body. During construction, sediment control measures will be installed on the down -gradient side of land disturbance activities as shown in the attached drawings.
