On November 4, 2019, Duke Energy Progress, LLC (Duke Energy) received the subject Notice
of Violation & Intent to Assess Civil Penalty letter dated October 30, 2019. In accordance with
the letter, Duke Energy submits this response regarding Outfall 005 effluent Oil & Grease
results for August 2019.
Within the August 2019 Discharge Monitoring Report (DMR), we explained results for the
primary and backup samples collected August 10, 2019 for Outfall 005 (batch radwaste
treatment system) Oil & Grease from Treated Laundry and Hot Shower Tank B (TL&HS
Tank B) were 25.0 mgll and 26.6 mgll, respectively. Results from our contract lab were not
received until August 26 and 29 which did not support for any additional compliance sampling.
Notification of the effluent limit for Oil & Grease was communicated to the Raleigh Regional
Office (Bolick) on August 30, 2019.
Outfall 005. is an internal outfall tributary to the main combined discharge outfall (Outfall 006)
serving HNP which discharges into Harris Reservoir. Multiple processing tanks are part of
Outfall 005. These tanks are processed, isolated and sampled individually before each tank is
batched released. Only one tank is released at a time. On August 10, 2019, batch discharge
flow from Outfall 005 was reported as 0.02 mgd. Flow for the combined discharge (Outfall 006)
for August 10, 2019 was reported as 12.841 mgd. Outfall 005 represented less than 0.2% of
the total flows discharged to Harris Reservoir on this date. Due to this minor composition of
batch radwaste treatment system Oil & Grease (26.6 MGIL; <0.2%) in the overall discharge to
Harris Reservoir, we feel confident stating no potential threat to public health or the environment
was created as a result of these Oil & Grease daily maximum and monthly average

exceedances. Also, subsequent Oil & Grease monitoring for internal Outfall 005 has
consistently complied with the daily maximum and monthly average Oil & Grease limitations.
Additional actions taken by HNP included:
1. The TL&HS Tank B with Oil & Grease in the release has been taken out of service and
will be cleaned prior to returning to service;
2. The carbon filters in the Outfall 005 batch radwaste treatment system have been
changed;
3. The presence of resin in the radwaste treatment system may have made Oil & Grease
removal less effective, the resin vessel has been taken out of service for repairs;
4. Operational Oil & Grease samples are being taken to ensure Outfall 005 batch radwaste
treatment system is removing Oil & Grease to within regulatory limits; and
5. Other radwaste associated tankage was inspected and tested for Oil & Grease to ensure
no oil or grease was present in the tanks.

proceed forward with a civil penalty assessment for the daily maximum and monthly average Oil
& Grease exceedances.

Statute (G.S.) 143-215.1 and the facility's NPDES WW Permit. Pursuant to G.S. 143-215.6A, a civil penalty of
not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or
fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S.
143-215.1.

If you wish to provide additional information regarding the noted violations, request technical assistance, or
discuss overall compliance please respond in writing within ten (10) business days after receipt of this Notice. A
review of your response will be considered along with any Information provided on the submitted Monitoring
Report(s). You will then be notified of any civil penalties that may be assessed regarding the violations. If no
response is received in this Office within the 10-day period, a civil penalty assessment may be
prepared.
Remedial actions should have already been taken to correct this problem and prevent further occurrences in the
future. The Division of Water Resources may pursue enforcement action for this and any additional violations of
State law. If the violations are of a continuing nature, not related to operation and/or maintenance problems,
and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by
Consent.
Reminder: Pursuant to Permit Condition 6 in Section E, the Permittee is required to verbally notify the Regional
Office as soon as possible, not to exceed 24 hours, from first knowledge of any non-compliance at
the facility including limit violations, bypasses of, or failure of a treatment unit. A written report may
be required within 5 days if directed by Division staff. Prior notice should be given for anticipated or
potential problems due to planned maintenance activities, taking units off-line, etc.

Outfall WS Oil & Grease Exceeded
On August 26, 2019, Harris Plant received preliminary notification from GEL Labs that the Oil & Grease
for Outfall 005 was 25.0 mg/L for August 08, 2019 sample. The duplicate sample collected on August 08,
2019 was then shipped to GEL Labs. This result was determined to be 26.6 mg/I Oil & Grease on August
29, 2019. The Daily Max of 20 mg/I and the monthly max of 15 mg/1 for Oil & Grease were both
exceeded because this was the only Oil & Grease sample for the month.
The July 04, 2019 and the September 11, 2019 oil and Grease samples were < 4.17 mg/L for Outfall 005.
HNP Chemistry then obtained multiple operational Oil & Grease samples. These Oil & Grease samples
indicated no abnormal conditions (< 1.23 mg/1). Follow-up operational checks on the system noted no
system challenges to corroborate an elevated result and all other NPOES values were in expected trends,
There were no apparent equipment malfunctions.
This event was reported to the NC DEQ DWR — Raleigh Regional Office on August 30, 2019. The event
was determined not to require a 5-day follow-up report.
Possible Causes:
Residue oil and grease released on the wall of the tank, after the tank was processed and before the
time of the tank's release.
Corrective Actions:
1— Plant Operations has changed the Carbon filters In the Outfall 005 treatment system that Is used to
remove Oil & Grease. IBNctl
2 —Chemistry will take operational Oil & Grease Sample to ensure that the Outfall 005 system is
removing the oil and grease to within regulatory limits.
3 —This Tank has been removed from service (CAU-1-19-6245-B TLHS-0079). A work request has been
Issued to inspect the tank Internals to verify no oil or grease remains in the tank (WR 20153983).
