PROJECT SUMMARY: The McCurdy's project is for the reconfiguration of the existing slip areas and dock infrastructure with the addition of three new slips and all associated infrastructure for a total of 7 slips as well as new dredging of the basin. Field Investigation Report: McCurdy's Restaurant Page 02 9. Narrative Description: The McCurdy's Restaurant project is located at 505 Atlantic Beach Causeway. McCurdy's Restaurant is found by turning south off of Highway 70 East in Morehead City onto the Atlantic Beach Causeway. The site is located on the right less than a 1/a of a mile once the Atlantic Beach High Rise Bridge has been crossed. It is located in what is commonly known as the "Moonlight Bay"/ "Fish and Lake" area which is a series of canals and basins that connect to Bogue Sound. The McCurdy's Restaurant site is 14,660 square feet in its entirety and is an average of 2' above NHW. A fringe of Coastal Wetlands is present along the south west shoreline of the site. This fringe contains Smooth Coordgrass (Spartina alterniflora). The high ground portion south of the existing restaurant is mostly void of vegetation other than a few Sega Palms, Pompas Grass and the existing lawn. There is an existing 50' bulkhead landward of the existing coastal wetlands. The water depths in the south basin area, according to the applicant, reach an average of -1.94' NLW within the excavation area and the waterward end of the proposed structures. The water depths within the north basin area are -4' to -6'nlw. Field verification confirms the soundings. The substrate in this area is a sand and silt mixture. This section of Moonlight Bay is not a Primary Nursery Area as designated by the Division of Marine Fisheries and the Division of Water Quality classifies it as SA/HQW waters. The area in which the proposed project would take place is closed to the taking of shellfish. Atlantic Beach's Land Use Plan dated 1994 classifies this area as Developed Commercial and Conservation within the AECs. The Town of Atlantic Beach also considers this section of the Causeway as an "Urban Waterfront", DCM concurs. 10. Project Description: The applicant is proposing to reconfigure the existing dock and slip areas, add three new slips with the associated infrastructure, and add one new boardwalk. Currently there is an existing restaurant with decks partially located on high ground and partially over open water. No work is proposed for the existing restaurant or decks other than the placement of a 6' x 28' boardwalk on the south side of the existing building, which would be located entirely over high ground. The boardwalk would be of elevated slatted wood design. The existing piers and fingers would be reconfigured for a better fit and design per the applicant. Due to the amount of existing platform square footage the main access dock to the north would be cut down from 8' x 38' to 6' x 36' and changed from fixed to floating and would be a minimum of 15' from the riparian corridor. This will connect to a shore parallel dock which would be reduced from a 7' x 56.5' fixed dock to a 6' x 56.5'floating dock. It would be accessed by a 3' x12' aluminum gangway on the north side of the property. The existing fingers and pilings would be shifted to the south for 5' to allow the slip areas to be 11' wide instead of 9' wide and maintain a straighter alignment. There would be four new fingers in place for slips 1-4 which would be 3' x 20' each. This access pier would be 4' x12' and connect with a new floating access dock for the new slip areas 5-7. This dock would be 6' x 46' and have two 3' x 20' fingers extending from it. This dock would also be able to be accessed from the proposed boardwalk by way of a 3' x16' aluminum gangway. Two new pilings would be located directing south of slip area 7. The most waterward piling would be a distance of 5' from the riparian corridor (waiver is on file), and 19' waterward (west) of the new dock. The water depths in the new slip areas are an average of -1.94' at NLW with an average of 4' to -6' nlw within the existing slip areas. The typical boats to be served would be mixed types, mainly open runabout, with a typical boat length of 20'. There would be no discharge allowed and no overnight live aboard. The applicant is proposing excavation within the 3 new slip areas to the south. The excavation area would be 32' x 50' with a total of 122 cubic yards of material removed. The most landward extent of the excavation would be located a distance of 35' from the edge of the coastal wetlands. The average water depths are -1.94' NLW with a proposed final depth of -4' NLW. The connecting channel depth is an average of -4.9' NLW. A bucket to barge method would be used with the spoils trucked off site to a preapproved location. The new slip areas (including the outer most tie pilings) should not be a hindrance to navigation because they are located 5' landward of the existing slips and pilings. The width of the water body in the new slip area is 160' from the waterward end of the marsh to the adjacent bulkhead. The most waterward portion of the new structure (slips 5-7) and the most northern access dock are a reconfiguration of an existing non-conforming use due to the existing restaurant being located over open water. Currently this most northern dock is 83' waterward of nhw. Riparian corridors were determined through field visits, aerial photography and division concurrence. 11. Anticipated Impacts: The existing docking facility is currently incorporating an area of 1,984 square feet of open water. However after the reconfiguration of the existing slip and dock areas this amount of incorporated area would be reduced to 1,650 square feet. The new slip and dock areas would incorporate 1,196 ft2 of open water while shading 396 ft2. The shoreline length for this project is 125 feet. The docking facility is currently utilizes 827.5 square feet of platform, however after the reconfiguration of the existing docks with the addition of the new docks, this would be reduced to a total of 360 square feet. A total area of 1,600 ft2 of shallow bottom habitat would be disturbed during the excavation process. The boardwalk would cover a 168 ft2 area of high ground. The excavation process as well as the piling placement would cause temporary turbidity. The reconfiguration and new slip and dock areas should not cause a hindrance to navigation and meet all required setbacks. Currently the existing most northern dock extends 83' into the waterbody and is 3' landward of the channel.
