(Wildlands) is requesting written verification from the U.S. Army Corps of Engineers (USACE) regarding the extent of potential waters of the United States within the subject project area. The Daniels Creek Mitigation Site is located northeast of the intersection of Highway 421 and Seminole Road east of Sanford in western Harnett County, NC (Figures 1 and 2). The Site is in the planning and design phase for a stream and wetland mitigation bank. To date, a draft mitigation plan is being developed and Wildlands is currently in the process of finalizing easement boundaries. Methodology Wildlands delineated potential waters of the United States within the proposed project easement area between November 2017 and May 2018. These areas were delineated using the USACE Routine On-Site Determination Method. This method is defined by the 1987 Corps of Engineers Wetlands Delineation Manual and subsequent Atlantic and Gulf Coastal Plain Regional Supplement. Wetland Determination Data Forms representative of on-site wetland areas as well as upland areas have been enclosed. Stream channels were classified according to USACE and NCDWR guidance. NCDWR Stream Classification Forms representative of on-site stream channels are enclosed. Potential Waters of the United States The results of the on-site field investigation indicate that there are 15 non-wetland waters within the proposed project area which include Daniels Creek and unnamed tributaries to Daniels Creek; hereafter referred to as T1, UT1A, T2, T3, T3A, T4, T5, T6, T7, T8, T9, T9A, T10, and T10A. Fifty-two wetland areas were identified within the proposed project area (Figure 3). Daniels Creek [NCDWR Index No. 18-10-(2)] which is classified as Class C waters. On-site stream channels are located within NCDWR Subbasin 03-06-07 of the Cape Fear River Basin (HU# 03030004). Approximate linear footage and acreage of on-site waters are summarized in Table 1. The scores on the NCDWR Stream Classification Form ranged from 27.5 to 40.5 out of 61.5 possible points. Throughout the majority of the project area, the stream channels and riparian corridors have been affected by active livestock grazing and hoof shear. As a result, degraded channel beds and banks as well as riparian communities are persistent along these reaches. Wetlands There are 52 wetlands located within the project area. These wetland features; while degraded, best fit the classifications of seeps, headwater forest, and bottomland hardwood forest using the North Carolina Wetland Assessment Method (NCWAM) classification key and the evaluator’s best professional judgment. The wetlands occur in the side slopes and floodplains that drain to the on-site stream channels. These features exhibited a saturation within the upper 12 inches of the soil profile, wetland plant communities, and a low chroma matrix. Wetland Determination Data Forms representative of the wetlands and the associated upland points are enclosed. Table 1 shows the acreage of on-site wetland areas. Soils Soil types within the study area include Bibb complex (Bb), Blaney loamy sand complex (BnB & BnD), Gilead loamy sand complex (GaB), Lillington very gravelly sandy loam complex (LnD), and Vaucluse gravelly loamy sand complex (VeB & VeD). Bibb complex soils are frequently flooded and are primarily associated with the Daniels Creek and associated tributary floodplains from the T7 downstream. Blaney loamy sand complex soils are well drained and are primarily associated with headwater streams and associated wetlands. Gilead loamy sand complex soils are moderately well drained and are primarily associated with the upper left floodplain of Daniels Creek and lower portion ofT7. Lillington very gravelly sandy loam complex soils are well drained and limited to the upper extent of Wetland A. Vaucluse gravelly loamy sand complex soils are well drained and associated with the headwater floodplains an wetlands with the southern project area. On-site soils are mapped in Figure 4. JURISDICTIONAL DETERMINATION (JD) TYPE (Select One) I am requesting that the Corps provide a preliminary JD for the property identified herein. A Preliminary Jurisdictional Determination (PJD) provides an indication that there may be “waters of the United States” or “navigable waters of the United States”on a property. PJDs are sufficient as the basis for permit decisions. For the purposes of permitting, all waters and wetlands on the property will be treated as if they are jurisdictional “waters of the United States”. If, during an administrative appeal, it becomes appropriate to make an official determination whether geographic jurisdiction exists over aquatic resources in the review area, or to provide an official delineation of jurisdictional aquatic resources in the review area, the Corps will provide an AJD to accomplish that result, as soon as is practicable.
