I. Introduction
Terraces Development, LLC, herein referred to as the "Applicant", is seeking to secure Department of the Army (DoA)
and NC Division of Water Resources (DWR) approvals, in the form of an Individual Permit (IP) and Major Water
Quality Certification (MWQC) respectively, to permanently impact 0.713-acre of Section 404 wetlands, on land
currently owned by Hwy. 17 Properties, LLC and for the purpose of constructing a small-scale, single family residential
subdivision, with infrastructure and attendant features.
II. Authority
The US Army Corps of Engineers (USACE) will evaluate this application and decide whether to issue, conditionally
issue, or deny the proposed work pursuant to applicable procedures of Section 404 of the Clean Water Act (33 U.S.C.
1344).
III. Location
The site is a 39.87-acre tract of land, located off Hwy. 17, in Pender County, North Carolina. From the intersection of
US Hwy 210 and US Hwy 17, go east on US Hwy 210. Travel approximately 0.30 mile and take a right, onto Alston
Boulevard. Travel 0.40 mile and take a right onto Trellis Road. Trellis road dead ends at the entrance into the proposed
project site (see Appendix A). The site is located within the incorporated area of Surf City, NC and is surround by
residential development, to the south, undeveloped commercial and residential land, to the northwest and east
respectively, and commercial development, to the north (see Appendix B).

IV. Existing Site Conditions:
Hwy. 17 Holdings, LLC acquired the property, in the summer of 2017 (see Appendix C). The decision to purchase the
property was based upon the location of the property being within the incorporated area of Surf City, it's close
proximity to two metropolitan areas (i.e. Camp Lejeune and Wilmington), proximity to shopping centers, schools and
US Hwy 17., as well as the ability to easily connect to sewer and water lines. The Pender County portion of Surf City
is part of the Wilmington Metropolitan Statistical Area, while the Onslow County portion is part of the Jacksonville
Metropolitan Statistical Area. According to worldpopulationreview.com', in 2019, the population, in Surf City, was
estimated at 2400.
A. Water Classification
Geographically, Surf City is located in the Outer Coastal Plain of North Carolina, which is low, flat land along the
Atlantic Ocean. The Outer Coastal Plain is made up of the Outer Banks and the Tidewater region. The Tidewater
is the area along the coast close to sea level. The mouths, of major streams and rivers, empty into sounds or the
ocean. Waters, at the project site, are part of the White Oak River system (see Appendix D). The origin of an
intermittent, unnamed tributary begins in the northeast corner of the project site. It transitions into a perennial
stream approximately 250 linear feet downstream and flows south, approximately 0.6 mile downstream, into
Virginia Creek, which then flows into the Atlantic Intracoastal Waterway. The White Oak River and its tributaries
contain some of the most pristine and high -quality waters in the North Carolina. As designated by the North
Carolina Department of Environmental Quality (NCDEQ) — Division of Water Resources (DWR), the stream
located at this site is classified as fresh water, secondary recreation -aquatic life class C (see Appendix E).

There are Section 404 and 401 wetlands, and one stream located within the project boundary (see Appendix F).
The project boundary contains the following amounts of jurisdictional Waters of the US (WoUS).

To date, a large portion of the site has been logged and mowed (see Appendix B). A Headwater Forest, a large
Pocosin and upper reaches of a Swamp Forest wetland are contained within the project site (see Appendix F). The
main factor contributing to hydrology in these wetlands is geomorphic position, a high water table, drainage
patterns and downstream blockages.
C. Vegetation
Since most of the site, specifically the uplands and Pocosin areas, has been cleared of large trees, only small
saplings and shrubs, such as summersweet (Clethra alnifolia), fetterbush (Lyonia lucida) and Swamp Bay (Persea
palustris), have emerged, within the areas designated as Pocosin. The wetter Headwater Forest and Swamp Forest
wetlands have not been mowed, thus the overstory of the Headwater Forest consist mostly of red maple (Acer
rubrum), water oak (Nyssa aquatica) and sweet gum (Liquidambar styraciva), while the Swamp Forest is devoid
of an overstory. The understory of the Headwater Forest is comprised of muscadine (Vitis rotundifolia) and laurel
greenbrier (Smilax laurifolia). The Swamp Forest is mostly comprised of Cattails (Typha) and common reeds
(Phragmites).
D. Streams
There is one stream within the property limits. Fresh, warm -water stream habitats include the streambeds, banks,
and stream corridor. The stream, at the project site, varies from 1 to 4 feet wide. Permanently rooted aquatic plants
are practically non-existent within the stream. The stream bed substrate is predominantly sand, with an abundance
of woody debris, which has been knocked down during past and more recent hurricanes (see Appendix G).
E. Biological Resources/Endangered Species
SEGi conducted a file review of records maintained by the U.S. Fish and Wildlife Service (FWS) and the North
Carolina Natural Heritage Program (NHP). The desktop literature review involved a review of the FWS list of
protected species and Critical Habitat in Pender County, and the NHP Element Occurrence (EO) Data, on which
NHP identifies current and historic occurrences of listed species and for a specific locale. The FWS lists 8 species,
as occurring in Pender County, that are subject to Endangered Species Act (ESA) Section 7 consultation. There are
no Critical Habitat occurrences within the project limits. The NHP database identifies 35 element occurrences
(EO), within a 1-mile radius of the project site. However, due to the fact that the site has been mostly cleared of
larger trees and previous evaluations of the USFWS and NHP EO data, performed as part of the permitting process
for the adjacent Arbors Subdivision, SEGi concluded that the proposed development would not adversely affect
any known Endangered Species.
F. Cultural Resources
SEGi reviewed the Online SHPO GIS database (http://gis.ncdcr.gov/hpoweb/). During the database review, SEGi
did not identify recorded historical sites, on the subject site. The database review did not identify recorded historical
sites on the subject site or within 1,500 feet of the site (see Figure 3). The database review did not identify other
Indian religious sites, historic structures or historic places located within 1,500 feet from the site. A copy of the
viewer image is included as Appendix H.
Based on observations made in the field and the review of the Online SHPO GIS, SEGi did not identify significant
architectural or archaeological resources on the subject site or in the surrounding vicinity, therefore, the project is
not anticipated to have an adverse effect on cultural resources.

V. Project Description
The Applicant proposes to develop the subject property into a 76-lot, single family residential community. The
proposed development is consistent with the local zoning (i.e. residential) and is in harmony with surrounding land
uses. The applicant proposes to permanently impact 0.713-acre of wetlands and temporarily impact 0.104-acre of
wetlands and 10 linear feet of stream, to achieve the previously stated project purpose.
The proposed installation of the sewer lines, grading activities for proposed culverts and roadway crossings will be
implemented broadly in the following sequences:
1. The limits of waters of the U.S. and the extents of the disturbance limits will be surveyed and marked in the
field.
2. Install temporary and permanent sediment control devices.
3. Clear and grub.
4. Construct coffer dams and install pump around system.
5. Begin placement of fill.
6. Install culverts, utilities, etc.
7. Remove coffer dams and pump around system.
8. Restore stream banks to similar pre -construction conditions.
9. Place stabilization matting, live stakes, and seed.
10. Install roadway storm drainage and utilities.
11. Seed per NCDEQ requirements.
12. Finalize desired grades and devices:
• For permanent devices, finish construction, filling, grading, and paving (if necessary) to designed elevations.
• For temporary disturbances and devices, return to existing grades and remove equipment and materials from
locations.
13. Once disturbed areas are stabilized, the temporary control devices will be removed and the area seeded.
The sequence of the construction phases has been designed to minimize areas of bare and exposed soil. Erosion and
control measures will be inspected and maintained as needed to prevent issues with distribution of sediments to nearby
surface waters, including streams. Exposed and bare soil will be temporarily stockpiled and will be moved as quickly
as possible, with relation to project timelines. Disturbed areas will be reseeded in an effort to prevent erosion and
capture sediments.
Heavy machinery, such as a bulldozers, graders, back hoes, and excavators, will be utilized during the construction
process. The machinery will be used to clear the land, establish grade, stabilize the soil and to transport and deposit
the fill material into those areas denoted on the site plan. Only the minimal amount of vegetation will be removed from
the proposed impacts areas, within the Headwater and Swamp Forest resources.
VI. Proposed Impacts:
The construction of the proposed residential development would require permanently filling approximately 0.713-acre
of 404 jurisdictional wetlands and temporarily impacting 0.107-acre. There are fifteen permanent wetland impacts, six
temporary wetland impacts and one temporary stream impact associated with the development of The Terraces
Subdivision. The fifteen permanent wetland impacts are for road crossings. The two temporary wetland impacts are
associated with the installation of sewer and water lines. These utility lines will be installed using the "trench -cut"
method and, upon completion, stream beds and banks would be returned to original contours and stabilized with coir
matting. Work within the stream utility crossing areas will occur in the dry, via a pump around system/apparatus.
Sediment and erosion control devices and best management practices would be utilized during utility line installation
as well. These proposed impacts are summarized in the Table 2, on the following page:

In total, 0.22-acre of riparian wetlands and 0.493-acre of non -riparian wetlands will be permanently impacted. For
details of the proposed impacts, please see Appendix F.
VII. Purpose and Need:
The purpose of the project is to provide small-scale, single family housing development, in Surf City, a rapidly growing
area of Pender County, North Carolina.
VIII. Alternative Analysis:
Comprehensive off -site and on -site alternatives analysis has been conducted, as part of the Individual Permit process.
Section 404(b)(1) guidelines were relied upon, to perform the analysis. When evaluating off -site alternatives,
considerations, such as the presence, quantity and quality or functional value of wetlands and/or other waters of the
U.S.; the presence of any federally -listed Threatened and/or Endangered Species or their Critical Habitat; state listed
Threatened and/or Endangered Species, or other natural or regionally important resource factors that may be
significantly impacted, were explored.
A. Off -site Alternatives
Current Pender County Zoning Maps, Public or Private utility company service area information, historical aerial
photography, topographic and soils maps, and available current land use records, were used, to best determine if any
of the alternative sites met some or all of the following criteria:
1. Be located within the incorporated area of Surf City;
2. Provides sufficient buildable area for a small scale, single-family subdivision (i.e. min. 30 acres, max. 60
acres);
3. Minimal distance to sewer and water connection;
4. Has adequate access;
5. Appropriately zoned for single-family residential;
6. Close to schools;
7. Close to shopping centers; and
8. Close to Hwy. 17.
Table 3, below and on the next page, summarizes the alternative sites that met either some or all of the site selection
criterion:

Of the sites listed in Table 3, only the highlighted sites met the Applicant's size and zoning criterion and, therefore,
were the only sites evaluated for practicability. Alternatives that are practicable are those that are available and
capable of being undertaken, after considering cost, logistics and existing technology. The table, on the following
page, summarizes each of the highlighted sites, for practicability.

Alternative Site 8: This site also appears to meet most of the Applicant's criterion, but it abuts US Hwy 17 North,
which is a busy, 4-lane highway, and undesirable for residential development. Therefore, this site was rejected.
Proposed Site — The proposed site meets all of the Applicant's criterion, for development of a small scale, single
family subdivision, with associated infrastructure and amenities. Additionally, the Applicant already owns the
property and has invested a significant amount of time and money vet it. Therefore, this is the only alternative that
was accepted.
B. On -Site Alternatives Analysis
The following alternatives were explored:
Alternative 1— Utilization of other uplands within the tract to avoid impacts: This alternative was reviewed, but
utilization of the remining uplands would require significant additional wetland and stream impacts (see Appendix
I). Therefore, this alternative was rejected.
Alternative 2 — Minimizing the impact area:
The following strategies, to avoid and minimize wetland and stream impacts, were considered during the design
phase:
• Tactical road design;

• Utilization of retaining walls;
• Utilization of bottomless -culverts;
• Utilization of shared driveways;
• Dedicating available buildable uplands to Open Space: and
• Reducing the number of lots.
With these strategies in mind, the following alternative site plans were explored:
Preferred Plan — TRC approved plan with 1 bottomless -culvert and retaining walls, at Impact Area B, and
shared driveways 1014119 (Proposed Plan — See Appendix F): The preferred plan consists of 76 lots and entails
permanently filling 0.713-acre of wetlands. This plan involves tactical road design and shared driveways
between lots 15 and 16, 17 and 18, and 55 and 56, which minimizes impacts to wetlands by 0.021-acre. At
Impact B, there is a proposed bottomless culvert with retaining walls (on each side of Impact B) at the stream
crossing, which reduced overall permanent wetland impacts by 0.029-acre and avoided 60 linear feet of
stream impact. Additionally, the Applicant removed three lots (i.e. 77, 78 and 79), where wetlands
significantly encroached into the property boundaries. While this effort may not avoid or minimize direct
wetland impacts, it shows the Applicant's desire to ensure secondary and/or unauthorized wetland impacts do
not take place, after the lots have been conveyed. This plan achieves the Applicant's objective and is the least
environmentally damaging, practicable alternative.
Option A — Preliminary Concept plan 5118117 (see Appendix I): This site plan proposes 66 single-family lots,
0.52-acre of wetland impact and 120 linear feet of stream impact. While wetland impacts are less than the
proposed plan, it was prepared prior to obtaining a formal wetland delineation and Pender County Technical
Review Committee(TRC) review. SEGi's wetland delineation revealed buildable uplands that were not taken
into consideration, when preparing the plan. Additionally, Pender County TRC required access into the project
to be through Trellis Drive, rather than via Rosedale Drive, as was proposed with this plan. For these reasons,
this option was rejected.
Option B — Post JD and TRC approved plan 2/13/19(see Appendix I): By utilizing the new-found uplands,
this plan proposes 79 single family homes. Tactical road design, such as reconfiguring the hammer -head, at
the terminus of Rosedale Drive and Balustrade Way, not utilizing all the available uplands, aligning roads to
cross wetlands perpendicularly, where possible, and reconfiguring Lot 71, to make room for the lift station
and access road, were the only minimization and avoidance methods incorporated into the plan. (Note: This
strategy was carried over onto all subsequent plans). This site plan entails permanently filling 0.704-acre of
wetlands and 60 linear feet of stream. This plan would require 0.009-acre less wetland impacts, than the
preferred plan, but would impact the more functionally valuable stream system, by 60 linear feet. Therefore,
this option was rejected.
Option C — TRC approved plan with multiple bottomless -culverts and retaining walls 06120119 (see Appendix
I): This plan also proposes 79 lots and incorporates 12 bottomless -culverts, across the site, and entailed
permanently impacting 0.49-acre of wetlands and no stream impact. While this plan requires the least amount
of impact to wetlands, the cost of doing so is not practicable. Additionally, the USACE reviewed and objected
to the plan, as they felt the structures would, in effect, act as fill. Therefore, this option was rejected
Option D — TRC approved plan with 1 bottomless -culvert, retaining walls, at all crossings, and shared
driveways 9116119 (see Appendix I): This plan proposes 76 lots and would require permanently impacting
0.494-acre of wetlands and no stream impact. While this plan is less impactf it to wetlands, it is infeasible.
According to the engineer, approximately 1,695 linear feet (4,575 SF) of retaining walls would be needed, to
facilitate this option, and minimizes wetland impacts by 0.219-acre.

The cost of installing retaining walls is approximately $22.00 per square foot. This cost does not include labor.
To utilize retaining walls, at every crossing, would cost approximately $300,000.00. Considering the cost to
mitigate the additional 0.219-acre of impact, at a 2:1 mitigation to impact ratio and through a private bank, who
only sells credits in 0.10-acre increments, the Applicant would be required to purchase 0.50-acre of wetland
restoration credit, at a cost of $23,1367.00. Under this option, the Applicant would be mitigating the additional
0.219-acre of wetland impact, at almost a 5.7:1 mitigation to impact ratio. Therefore, this option was rejected.
Alternative 4 —Avoiding all impacts to wetlands and streams: The Applicant investigated other potential means
for developing the property without impacting wetlands and has been unable to find a practicable alternative that
would achieve his stated goal. Therefore, this alternative was rejected.
Alternative 5 — Impact all wetland and streams: While this alternative would allow the Applicant to achieve his
stated goal, it would be extremely damaging to the environment. Therefore, this alternative was rejected.
Alternative 6 — No Build: Under the no build alternative, residential dwellings would not be built and the current
need for additional housing would not be met. Therefore, this alternative was rejected.
VIII. Avoidance and Minimization:
The avoidance and minimization strategies discussed in Section VI(B) were applied to the proposed, preferred plan.

In conjunction with the avoidance and minimization efforts outlined in Table 4., large trees and other wetland
vegetation will only be removed where needed, in the Headwater Forest and Swamp Forest, and during the construction
process, best management practices will be utilized. Any temporary impact to wetlands, associated with the installation
of roads or other development activities, will be restored to their pre -construction conditions and allowed to revegetate
naturally or seeded with a wetland seed mix. Furthermore, the Applicant, during the design phase, tried to avoid having
wetlands encroach into the individual lots. For those lots, where this occurs, deed notifications will be recorded at the
New Hanover County Register of Deeds, to ensure unauthorized wetland impacts do not take place, after the lots been
conveyed. A draft of the notification has been attached as Appendix J.
IX. Mitigation:
The Applicant intends to offset the loss of chemical, biological and physical processes, which are anticipated to be

removed, as a result of the unavoidable, permanent filling of 0.22-acre of riparian wetlands and 0.493-acre of non -
riparian wetland, by making payment to the Hofrnann Forest Wetland Mitigation Bank, for 0.50-acre of riparian
wetland restoration credit and 1.0-acre of non -riparian wetland restoration credit. A credit reservation letter, from the
mitigation bank, will be furnished to the agencies, upon the agencies' approval of the proposed mitigation plan.
X. Summary
In summary, Terraces Development, LLC has conducted off -site alternative analysis and investigated alternative site
designs, and the selected site and proposed plan achieves their stated purpose and need. Minimization was achieved
by incorporating tactical road design into site plan, utilizing only those uplands that were easily accessible, proposing
shared driveways, selective vegetation cutting, and using deed notifications to prevent unauthorized impacts to
wetlands, after the lots have sold. Unavoidable impacts to 0.22-acre of riparian and 0.493-acre of non -riparian wetlands
will be mitigated through the Hofinann Forest Wetland Mitigation bank, at a 2:1 mitigation -to -impact ratio. After a
thorough evaluation of on -site and off -site alternatives, to construct the planned subdivision, as well as examination of
the potential impacts to biological and cultural resources, the Applicant and SEGi have found the proposed plan to be
the least environmentally damaging, practicable alternative.
