President JLG Corporation PO Box 3006 Cary, NC 27519-3006 Subject: Air Park DWQ Project No. 95273 Wake County Dear Mr. Futrell: Wetlands Unit staff visited the subject site on November 30, 2000 and discovered that construction had been completed on one or more lots in the subject development. The 401 Water Quality Certification issued March 16, 1995 required among other conditions that, "Additional DEM IDWQI is required for the storm,,vater management plan before construction begins or lots are sold." Our files contain no information to indicate that any approval was ever obtained. As such. you must develop a stormwater management plan designed to remove 85% TSS per the NCDENR Stonntirnter Best Management Practices Manual. April 1999, and submit the plan with a signed and notarized Operation and Maintenance Agreement for the entire site by January 2. 2000. This Office issued a 401 WQC approval based on this application, but a caveat was added that "additional DEM approval is require for the stormwater management plan...". There is no evidence in the file that such an approval was granted. I am not certain what design parameters this Ofi'ice used for stormwater back then. This WQC predates the 10/1/96 version of 15A NCAC 2H .0500 and the November 1995 version of the NCDENR Stormwater BMP Manual. In any event, one portion of the site that appears to include a large manufacturing i'acility drains into the above pond via a forebay of sorts. The pond obviously existed prior to construct ion the project. The pond has a permanent pool. I (lid not inspect the outlet. Additionally, I do not believe that the entire site drains to this pond. I would estimate that approximately 113 to 1/2 of the project site flows to the above pond. It also appears that additional stormwater management devices could be provided to treat the remaining portion of the property. Box 3006 Cary, N.C. 27511 Dear Mr. Futrell: r CU PY ILE You have our approval to place fill material in 1.13 acres of wetlands or waters for the purpose of constructing a commercial subdivision at Airpark Property (SR 1002 and SR 1706), as you described in your application dated 3 March 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 2732 and 2671. These certifications allow you to use Nationwide Permit Numbers 14 and 26 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Additional DEM approval is required for the stormwater management plan before construction begins or lots are sold. Deed restrictions shall be placed on all remaining jurisdictional wetlands to restrict future fill (draft example attached). In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. The project is located near Morrisville, NC (Wake County) and is bordered to the east by Stirrup Iron Creek. The property is just east of the intersection of Airport Blvd. (SR 1002) and Watkins Road (SR 1706). The project was assigned project #931060 by DEM. We requested that the project to be placed on hold on 2/10/94. The Corps approved detailed wetland delineation is shown on the attached map. These delienations have been approved by Mr. Eric Alsmeyer of the U.S. Army Corps of Engineers. During a review of our original application Karl Shaffer of DEM and Mr. Eric Alsmeyer made several suggestions for reducing the requested 3.43 acres of fill requested. These suggestions have been incorporated in this new site plan. Based on the revised plan fill in the wetlands will be required to build a commercial subdivision (see attached map). It will be necessary to impact a total of 1.13 acres (see map) of jurisdictional waters and wetlands above headwaters for placement of the proposed facilities. Approximately .21 acres will be impacted under Nationwide 14, and the remainder (.92 acres) will be impacted under Nationwide 26. A portion of the wetlands on the tract are made up of an old farm pond (see attached map) which will be left in place and storm water diverted into it. As suggested the main wetland body below the pond will not be impacted by the current plan. Based on this review, we have identified significant uses which would be removed by this project. These are water storage, streambank stabilization, pollutant removal and wildlife habitat. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned. Therefore, we are moving toward denial of your 401 Certification. Please provide us with information supporting your position that your project must be constructed in wetlands. Specifically can you construct your commercial fill on nearby upland? Also a stormwater facility will be required for this development. Any documentation such as maps and narrative which you can supply to address upland alternatives may be helpful in our review of your 401 Certification. The project is located ne,.i Morrisville, NC (Wake County) and is bordered to the east by Stirrup Iron Creek. The property is just east of the intersectirn of Airport Blvd. (SR 1002) and Watkins Road (SR 1706). The Corps approved detailed wetland delineation is shown on the attached map. These delineations have been approved by Mr. Eric Alsmeyer of the U.S. Army Crops of Engineers. Fill in the wetlands will be required to build a commercial subdivision (see attached map). It will be necessary to impact a total of 3.43 acres (see map) of jurisdictional waters and wetlands above headwaters for placement of the proposed facilities. Approximately .21 acres will be impacted under Nationwide 14, and the remainder will be impacted under Nationwide 26. A portion of the wetlands on the tract are made up of an o:-C farm pond (see attached map).
