Permit Number Applicant SER Number Project Type SAW-2018-00568 Duke Energy Progress, LLC SERO-2018-00255; SER-2018-19586 Construction of a cofferdam to install a fish passage device Consultation History NMFS’s Revised Biological Opinion (Opinion) for the Yadkin-Pee Dee Hydroelectric Project (YPDHP) issued on April 17, 2015,1 required the installation of a fish passage device for the upstream passage of American Shad. The Opinion for YPDHP covered the construction of the fish passage but did not consider installation of a cofferdam and related effects to species and related critical habitat. We received your letter requesting consultation for the installation of the cofferdam on September 19, 2018. Due to recent findings to ESA-listed sturgeon species and required work windows, we requested additional information regarding the proposed action’s construction conditions on November 8 and December 17, 2018. We received a final response on December 19, 2018, and initiated consultation that day. Consultation was held in abeyance for 38 days due to a lapse in appropriations and resulting partial government shutdown. Consultation resumed on January 28, 2019. This project was originally assigned a tracking number (SER-2018-19586) in our now obsolete tracking system. The project has been assigned a tracking number in our new NMFS Environmental Consultation Organizer (ECO), SERO-2018-00255. National Oceanic and Atmospheric Administration, National Marine Fisheries Service, Southeast Regional Office, Protected Resources Division, Saint Petersburg, Florida. 2 Project Location Address Latitude/Longitude Water body 2593 Power Plant Road, Lilesville, Anson County, North Carolina 34.98280278ºN, -79.8769444 ºW (North American Datum 1983) Pee Dee River Image of the project location and surrounding area (©2018 Google) Existing Site Conditions The project is located on the Pee Dee River at the Blewett Falls Dam and Hydroelectric Station in Lilesville, Anson County, North Carolina, at approximately river mile 188.2 from the nearest opening to the Atlantic Ocean at Winyah Bay. The site includes the Blewett Falls Lake Dam, retaining wall, and concrete tailrace. According to United States Army Corps of Engineers (USACE), dominant substrate within the project include scoured bedrock, intermittent boulders and large cobble. Water quality is typically good and consistently meets North Carolina water quality standards for dissolved oxygen. Water depth in the project area ranges from approximately 4 to 18 feet (ft), with an average depth estimated at 10 ft. Blewett Falls Hydroelectric Powerhouse Proposed Fish Passageway Site Anson/Richmond County Line 3 Blewett Falls Dam represents the Pee Dee River system’s upstream extent of sturgeon spawning and summer/winter seasonal habitat. The fall line (the boundary between an upland region of continental bedrock and an alluvial coastal plain, sometimes characterized by waterfalls or rapids) is located approximately 22 river miles below Blewett Falls Dam. Project Description The applicant proposes to install a cofferdam around the upstream fish passage facilities required by the YPDHP for American shad. All construction activities of the fish passage facility will be conducted once the installation of the cofferdam is complete and the area dewatered. The dewatered area of the cofferdam will be approximately 2,900 square feet (ft2) (0.07 acres [ac]). Data obtained from 3 geotechnical borings will be used to determine the final design of the cofferdam that will be used to dewater the work area for installation of the fish passage facility. The borings will be performed using an ATV/track-mounted drill rig atop a spud barge deployed in the tailrace. The 4-in-diameter borings will be extended to depths ranging from 25 to 45 ft below the river bottom. Upon completion of the project, the borings will be backfilled “from the bottom up” with cement grout placed via a tremie pipe. The cofferdam is expected to be constructed of braced sheet pile. The approximate total length of sheet pile cofferdam is 245 ft. It is anticipated that approximately 105 PZ 35 (or similar) type sheet piles (approximately 28-in-wide) will be used for the cofferdam. The sheet piles will be installed using a vibratory hammer deployed via a land-based crane with a clamshell bucket. A bubble curtain system will be deployed around active pile driving to attenuate noise from pile driving. Equipment mounted on the spud barge in the tailrace will guide the placement of the sheet piles. The interior side of the sheet pile wall will be braced with steel framework as needed depending on the embedment depth achieved by the piles. Depending on the embedment depth of the piles, a tremie concrete seal 2 may need to be placed along the exterior perimeter of the sheet pile wall. Once the sheet pile cofferdam is installed and dewatered, the concrete retaining wall that forms the shoreline of the tailrace and is inside the cofferdam will be demolished and removed from the site. When the construction of the new fish passage facility is complete, the cofferdam will be removed the same way it was installed. This does not apply to emergency work (i.e., work that cannot wait until after the time restriction). The cofferdam will be installed and boring activities conducted during the period when in-water work is allowable per the terms of the YPDHP Opinion and periods allowable under the terms of the 404 Permit. This would include periods of the in-water work prohibition periods specified in the Opinion and described above. This produces a more reliable strength of the product. 4 construction, which is expected to take up to one year. Tailrace borings will occur once the 404 Permit is received. NMFS’s Revised Opinion covers the fish passage construction and operation, and Reasonable and Prudent Measure (RPMs) are contained in the BiOp with implementing Terms and Conditions (T&Cs). Therefore, the applicant will implement these protective measures as required by RPM#1 and T&C#1 to protect sturgeon during fish passage construction activities. RPM #1 and T&C#1 specify that all potential adverse impacts to sturgeon during the construction and operations of the TST fish passage facility (a trap, sort and truck facility in the Blewett Falls tailrace, which would be used to collect anadromous species [primarily American shad] so that they could be sorted and then transported, via truck, to areas upstream of Blewett Falls) or during other construction activities or maintenance of the Blewett Falls Dam are to be minimized to the greatest extent practicable. The applicant has agreed to adhere to NMFS's Sea Turtle and Smalltooth Sawfish Construction Conditions.3 If a sturgeon is seen within 100 yd of the active daily construction/maintenance operation, all appropriate precautions shall be implemented to ensure its protection. Operation of any moving mechanical construction equipment shall cease immediately if a sturgeon is seen within a 50- ft radius of the equipment. Activities may not resume until the protected species has departed the project area of its own volition. Additionally, turbidity curtains will be used for all in-water work. Appropriate erosion and turbidity controls (e.g. cofferdam) shall be utilized during any in-water work carried out by the applicant to limit contaminant-laden sediments from entering the water. No construction debris shall be allowed to enter the water. The Physical and Biological Features (PBFs) of the critical habitat are described in the table below. We believe the proposed action may affect PBF 1, hard substrate; PBF 3, unobstructed water of appropriate depth; and PBF 4, water quality. Water depths in main river channels must also be deep enough (at least 1.2 meters [m]) to ensure continuous flow in the main channel at all times when any sturgeon life stage would be in the river Water Quality (PBF 4) Water quality conditions, especially in the bottom meter of the water column, with appropriate temperature and oxygen values Necessary to support: • Spawning; • Annual and inter-annual adult, subadult, larval, and juvenile survival; and • Larval, juvenile, and subadult growth, development, and recruitment. Appropriate temperature and oxygen values will vary interdependently, and depending on salinity in a particular habitat. Analysis of Potential Routes of Effects to Species Effects to Atlantic and shortnose sturgeon may include the risk of injury or death from interactions with construction activities and/or equipment; however, we believe this scenario is discountable due to the species’ mobility. The applicant’s implementation of NMFS’s Sea Turtle and Smalltooth Sawfish Construction Conditions will further reduce the risk of interactions by requiring all construction workers to watch for sturgeon. Operation of all mechanical construction equipment will 6 cease immediately if a sturgeon is seen within a 50-ft radius of the equipment. Activities will not resume until the protected species has departed the project area of its own volition. Use of turbidity curtains, the construction activities, and related construction noise may prevent or deter sturgeon from entering the project area. We believe that the effect to sturgeon from temporary exclusion from the project area due to construction activities, including related noise and presence of turbidity curtains, will be insignificant. The size of the area from which sturgon will be excluded is relatively small in comparison to the available river habitat, which sturgeon will be able to use during construction. After project completion, turbidity curtains will be removed and sturgeon will be able to return to the project area. Sturgeon could be affected by the placement of temporary in-water structures (e.g., cofferdams) in areas that may serve as spawning habitat. We believe the effect to sturgeon from the placement of temporary in-water structures will be insignificant. The area of temporary impact is relatively small (2,900 ft2 [0.07 ac]) compared to the surrounding area available that will serve as spawning habitat for the sturgeon. Further, once the temporary structure is removed, sturgeon can use the area for spawning again. Sturgeon may be affected by the permanent loss of habitat due to the placement of pile-supported structures. However, the effect to sturgeon from the potential loss of spawning habitat due to the placement of pile-supported structures is insignificant. Sturgeon are a mobile species that spawn over large areas and the area of impact is relatively small (420 ft2 [0.001 ac]) compared to the surrounding river habitat available. Effects to listed species as a result of noise created by construction activities can physically injure animals or change animal behavior in the affected areas. Injurious effects can occur in two ways. First, immediate adverse effects can occur to listed species if a single noise event exceeds the threshold for direct physical injury. Second, effects can result from prolonged exposure to noise levels that exceed the daily cumulative exposure threshold for the animals, and these can constitute adverse effects if animals are exposed to the noise levels for sufficient periods. Behavioral effects can be adverse if such effects interfere with animals migrating, feeding, resting, or reproducing, for example. Our evaluation of effects to listed species as a result of noise created by construction activities is based on the analysis prepared in support of the Opinion for SAJ-82.3 The noise analysis in this consultation evaluates effects to ESA-listed fish species identified by NMFS as potentially affected in the table above. The current NMFS-accepted noise thresholds to ESA-listed fish species due to vibratory hammer driving are 206 decibels (dB) for peak-pressure injury, 234 dB for cumulative sound exposure level (cSEL) injury, 150 dB root mean square (RMS) for behavioral disturbance of fishes over 102 grams (g) in weight. We do not expect fish under 102 g in weight to be present because the location is approximately 188 river miles from the mouth of the river and sufficiently far from the upstream spawning locations (pers. comm., A. Herndon and F. Innocenti on 12/20/2018). The applicant will install all piles using a vibratory hammer to drive 28-in-wide steel sheet piles to depth. Additionally, our calculation is based on 1 sheet pile installed at the maximum allowance of vibration time in a 12- hour period (i.e., number of seconds [sec] of vibration per pile x number of piles per day = estimated 3 NMFS. Biological Opinion on Regional General Permit SAJ-82 (SAJ-2007-01590), Florida Keys, Monroe County, Florida. June 10, 2014. 7 number of sec per day [43,200 = 60 sec x 60 minutes x 12 hours]) all construction activities will occur during daylight hours only. To minimize potential noise impacts, the applicant will use air bubble curtains to reduce noise levels. According to the best available data,4 air bubble curtains provide a 5 dB reduction in vibratory hammer underwater sound levels to piles up to 24 in wide.4 Based on our noise calculations, installation of 28-in steel sheet piles by vibratory hammer using air bubble curtains for noise abatement will not cause single-strike or peak-pressure injury to ESA-listed fish species. The cSEL of multiple sheet piles over the course of a 24 hour period may cause injury to ESA-listed fishes radius of up to 0.47 ft (0.14 m). Due to the mobility of ESA-listed fish species, we expect them to move away from noise disturbances. Because we anticipate the animal will move away, we believe that an animal’s suffering physical injury from noise is extremely unlikely to occur. Even in the unlikely event an animal does not vacate the daily cumulative injurious impact zone, the radius if that area is smaller than the 50-ft radius that will be visually monitored for sturgeon. Construction personnel will cease construction activities if animal sturgeon is sighted per NMFS’s Sea Turtle and Smalltooth Sawfish Construction Conditions. Thus, we believe the likelihood of any injurious cSEL effects is discountable. An animal’s movement away from the injurious impact zone is a behavioral response, with the same effects discussed below. Based on our noise calculations, installation of 24-in sheet piles by vibratory hammer using air bubble curtains as noise abatement could result in behavioral effects at radii of up to 152 ft (46 m) for ESA-listed fishes. Given the mobility of sturgeon, we expect them to move away from noise disturbances. Because there is similar river habitat nearby, we believe this effect will be insignificant. Since installation will occur only during the day, these species will be able to resume normal activities during quiet periods between pile installations and at night. Additionally, based on the configuration of the project area, sturgeon will be able to depart the affected area through several pathways; no access route will be blocked. Therefore, we anticipate any potential behavioral effects will be insignificant. Analysis of Potential Routes of Effect to Critical Habitat Hard substrate necessary for the settlement of fertilized eggs and refuge, growth, and development of early life stages (PBF 1) may be affected by the installation of piles. However, we believe this effect will be insignificant. The river contains gravel and cobble that may serve as a critical function for egg, larvae, and adult sturgeon growth and spawning; however, the temporary cofferdam piles will only affect a small portion of the tailrace. The available substrate surrounding the permanent and temporary structures will continue to support these early life stages, and once the temporary structure is removed, these areas of hard substrate will become accessible again. According to the USACE, the applicant will not conduct any in-water work from February 1 to April 30 and from September 15 to October 15 of any year, to prevent any interruption of sturgeon spawning and migration. The unobstructed water of appropriate depth (PBF 3) may be affected by the proposed action; however, we believe the effect will be insignificant. For the life stages potentially using the action area, PBF 3 refers to water that is free from obstruction such that: spawning adults can make unencumbered movements to the spawning grounds; adults can access staging, resting, and holding habitats; and juveniles can make seasonal and physiologically-dependent movements to appropriate salinity zones within the river. It also refers to the requirement that the main channel to be deep enough to ensure that there is continuous flow when adults or juveniles are there. The installation of turbidity curtains, air bubble curtains, and a temporary cofferdam will only affect a small portion of the tailrace. These structures will be removed following completion of the fish passage facility. Upon removal, these structures will no longer create an obstruction to sturgeon movement. The installation of the cofferdam may create noise that could deter the movement of sturgeon through the area. However, no in-water pile driving will be allowed from February 1 to April 30 and from September 15 to October 15 of any year, to prevent any disruption of adult sturgeon migration activities. Therefore, we believe any effects to PBF3 will be insignificant. Localized and temporary reductions in water quality (PBF 4) through increased turbidity may result from the temporary placement of the cofferdam. We believe the effect to PBF 4 from localized and temporary increased turbidity will be insignificant because turbidity curtains will be used to contain turbidity and we expect any small amount of turbidity that may escape to have an insignificant effect on the water quality conditions, especially in the bottom meter of the water column, with appropriate temperature and oxygen values. Conclusion Because all potential project effects to listed species and critical habitat were found to be discountable, insignificant, or beneficial, we conclude that the proposed action is not likely to adversely affect listed species and critical habitat under NMFS’s purview. This concludes your consultation responsibilities under the ESA for species under NMFS’s purview. Consultation must be reinitiated if a take occurs or new information reveals effects of the action not previously considered, or if the identified action is subsequently modified in a manner that causes an effect to the listed species or critical habitat in a manner or to an extent not previously considered, or if a new species is listed or critical habitat designated that may be affected by the identified action.
