HomeMy WebLinkAbout20191550 Ver 1_Client Letter Report 09.23.19_20191108 September 23, 2019 ELECTRONIC SUBMITTAL Jennifer.Bennett@duke-energy.com Ms. Jennifer Bennett Project Manager I Duke Energy 526 South Church Street Charlotte, NC 28202 Dear Ms. Bennet: Subject: Preliminary Jurisdictional Waters Determination Duke Energy, Blewett Falls Fishing Platform Replacement Project Lilesville, Anson County, North Carolina CEC Project 151-852 This report summarizes the results of CEC’s desktop and on-site Preliminary Jurisdictional Waters Determination (PJWD) conducted for Duke Energy (Duke) at the proposed Blewett Falls Replacement Fishing Platform Area totaling approximately 1.7 acres, near the town of Lilesville, Anson County, North Carolina ( Project or Project Area) (Figure 1). The purpose of this desktop assessment and on-site wetlands and waters investigation was to provide a preliminary jurisdictional opinion on the presence or absence of potential jurisdictional Waters of the United States (WoUS) within the designated Project Area, and determination of the Ordinary High Water (OHWM) mark below the existing power plant, or backwater area leading to the main channel of the Pee Dee River. 1.0 BACKGROUND WoUS are defined by the United States Army Corps of Engineers (USACE) and the U.S. Environmental Protection Agency (EPA) as “those areas that are inundated or saturated by surface or groundwater at a frequency and duration sufficient to support, and under normal circumstances, do support a prevalence of vegetation adapted for life in saturated soil conditions.” In order for an area to be classified as a jurisdictional wetland, hydrophytic vegetation, hydric soils, and wetland hydrologic indictors must be present. In North Carolina, the USACE and the EPA jointly regulate the discharge of dredged and fill material within jurisdictional WoUS under Sections 401 and 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act of 1899. WoUS includes territorial seas, navigable coastal and inland lakes, rivers and streams (perennial and intermittent), and wetlands. Jurisdictional features include wetlands, open waters, ponds, lakes and perennial/intermittent streams. Jurisdictional features are regulated by the USACE and North Carolina Department of Environmental Quality, Division of Water Quality (NC DEQ). Permits requirement are specific to Ms. Jennifer Bennett – Duke Energy CEC Project 151-852 Page 2 September 23, 2019 the type, location and amount of impacts, if proposed. Stormwater management plans and/or mitigation for proposed impacts could be a requirement of the permit approval process. This assessment can be used to assist Duke with a preliminary review of the Project Area only and is not considered final until verified by the USACE and NCDWQ. The following supporting documents are provided: Figure 1: Vicinity Map; Figure 2: USGS Topographic Map; Figure 3A: Aerial Map; Figure 4A: NRCS Current Soil Survey Map; Figure 4B: NRCS Published Soil Survey Map; Figure 5: National Wetlands Inventory (NWI) Map; and Figure 6: Potential Jurisdictional Boundaries Map. Attachment A: Wetland Determination Data Forms; Attachment B: NC DEQ Stream Classification Forms; and Attachment C: Representative Photographs. 2.0 SITE CONDITIONS AND DESKTOP REVIEW The Project is approximately 1.7 acres and currently consists of a recreational area below the existing Duke Energy Blewett Falls Dam Hydroelectric Power Plant, along the backwater area of the Pee Dee River in the north, with associated parking areas to the south and central portions with the remainder wooded (Figures 1 and 3). Surrounding land use consists mainly of industrial facilities in association with the Hydroelectric Plant. A review of available topography information shows the surrounding area to be gently to moderately sloping (Figure 2). The Project contains elevations ranging from approximately 160 above mean sea level (amsl) to the OHWM of 127 feet amsl. A review of the published and on-line National Resource Conservations Service (NRCS) Soil Surveys for Anson County indicates there are no hydric soils within the Project Area (Figures 4A and 4B). A review of the National Wetlands Inventory (NWI) map indicates only the open water area of the of the backwater area of the Pee Dee below the Powerhouse (Figure 5). 3.0 WATERSHED CLASSIFICATION AND BUFFER REQUIREMENTS According to the NC DEQ, the Project is in the eight digit (Hydrologic Unit Code [HUC]-8: (03040201) Yadkin-Pee Dee River Basin, the ten digit [HUC]-10: (0304020103) Marks Creek- Pee Dee River, and the twelve digit [HUC]-12: (030402010304) Island Creek-Pee Dee River. The Pee Dee River, from Blewett Falls Dam to N.C.-S.C. State Line, is classified as “Class C Waters” Ms. Jennifer Bennett – Duke Energy CEC Project 151-852 Page 3 September 23, 2019 by the NCDEQ. Class C waters are defined as: Waters protected for uses such as secondary recreation, fishing, wildlife, fish consumption, aquatic life including propagation, survival and maintenance of biological integrity, and agriculture. Mandatory vegetative riparian buffers are not required by the NC DEQ based on the site locality in a specific river basin or watershed. However, based on observations, potential jurisdictional surface waters that may be subject to vegetative buffers are located on the site. Development or stormwater setbacks that are specific to the proposed development of the site could be required by the NC DEQ. Consultation with the local zoning authority is recommended to determine site specific vegetation buffers adjacent to the features located on the site prior to submittal for zoning approval. 4.0 PRELIMINARY JURISDICTIONAL REVIEW This assessment utilized the 1987 USACE Wetland Delineation Manual, the 2018 Field Indicators of Hydric Soils of the United States along with the USACE 2010 Regional Supplement: Supplemental Guide ERDC/EL TR-12-9 (Eastern Mountains and Piedmont Region (Version 2.0), Wilmington, NC District office. Regulator Guidance letter No. 05-05, Dated December 7th 2005, was utilized to establish an OHWM of the backwater area, below the power plant, for the Pee Dee river. Potential jurisdictional areas were delineated (flagged in the field), classified, and mapped with a sub-foot Trimble Geo7X GPS unit using the USACE Routine On-Site Determination Method. Data representative of on-site jurisdictional wetland areas and non-jurisdictional upland areas was collected and reported using Wetland Determination Data Forms (Attachment A). Potential jurisdictional stream channels were classified according to NC DWQ Stream Identification Form Version 4.11. CEC utilizes the NC DWQ stream classification forms in order to document on-site stream conditions as requested by the USACE field and satellite offices of the Wilmington, NC district office. These classifications include sampling with an auger, D-shaped dip net, collecting photographic documentation, and defining approximate breakpoints (location at which stream changes classification) within each on-site stream channel. NC DWQ Stream Classification Forms representative of on-site stream channels were used to document stream conditions (Attachment B). Representative photographs were taken of on-site aquatic features and existing site conditions (Attachment C). The locations of mapped wetlands and other WoUS, Stream Classification Points (SCP), and Wetland Determination Data Points (DP), are depicted on (Figure 6). 5.0 RESULTS On March, 15th 2019, CEC scientist Kevin Thomas, Professional Wetland Scientist (PWS) and North Carolina Licensed Soil Scientist (NCLSS), delineated potential jurisdictional WoUS and established the OHWM, within the Project Area. Based on the results of the field investigation, Ms. Jennifer Bennett – Duke Energy CEC Project 151-852 Page 4 September 23, 2019 there is one feature, an Unnamed Tributary (UT) to the backwater area of the Pee Dee River that would likely be considered potential jurisdictional within the Project Area. This feature totals approximately 303.54 linear feet of stream (Figure 6). These features consist of one potential jurisdictional stream channel and one potential jurisdictional wetland. Streams With the exception of the backwater area of the Pee Dee River below Blewett Falls Powerhouse, one potential jurisdictional stream channels exists within the Project Area (Figure 6; Table 1). Stream SA 1 orginates in the eastern portion of the Project Area and generally flows due west, then in a north direction until it confluences with backwaters of the Pee Dee River and is a Relativly Permanent Water (RPW) (Perennial stream). Photo representation of the OHWM, which was established at elevation 127’ National Geodectec Vertical Datum 1929, of the backwater area of the Pee Dee were collected (Attachment C; Photographs 11 & 12) Perennial streams exhibit year-round flow with strong geomorphological, hydrological, and biological characteristics. The on-site perennial stream generally include soil based evidence of high water table, iron oxidizing bacteria, strong continuity of channel bed and bank, with some aquatic biological activity. Table 1. Summary of on-site Non-Wetland Waters of the United States within the Project Area Jurisdictional Stream NCDEQ Classification NCDEQ Score(s) Photograph(s) Linear Footage SA 1 Perennial 38.5 3 through 9 303.54 Stream Total 303.54 Non-Jurisdictional Upland Areas No additional WoUS were delineated within the Project Area (Figure 6). Wetland Determination Data Forms and photos representative of upland areas and Stream Collection Points were collected outside the delineated wetland boundaries or in non-juridistional channels, (Attachment A, B and C; Photographs 1, 2 & 10). 6.0 RECOMMENDATIONS The Report and on-site Delineation provided by CEC represents our best professional judgment regarding the potential of on-site wetlands, streams, and other water features at the time of the investigation that can be used for preliminary project planning only. Wetlands and other potential jurisdictional waters are present on the site, which are regulated by the USACE and/or NC DEQ. However, until a Jurisdictional Determination (JD) is issued by the regulatory agency, these findings can only be considered preliminary and is not an official governmental approval. CEC recommends that before any construction or other earth disturbance activities occur on site, a formal JD should be obtained from the USACE.
