Inspection Summary:
Inspectors Mikal Willmer and Brett Laverty, with the Asheville Regional Office, conducted a facility site inspection on
October 30, 2019. This visit was conducted in conjunction with permittee's request to have non-discharge permit No.
WQ0036327 rescinded. Hugh Shannon and Richard Ledford with Mountain Soils and Robert Burgin, consulting engineer
were present and assisted in the site visit on behalf of the owner Mr. Harwood.
All homes on the previous high-rate infiltration system are now connected to the newly permitted subsurface system. As a
precautionary measure to final closure, the ARO is requesting the effluent pipe to the infiltration basin be capped to prevent
any potential flows to the basin in the future.
Additionally, the ARO is requiring the closure of the high-rate infiltration basin (basin) before the permit can be rescinded.
The basin is located approximately 50 feet and downgradient from Highway 74, which is a major transportation route for
Swain and Cherokee Counties. The basin could serve as a conduit to both groundwater and the Nantahala River in the event
there are releases of chemicals and/or petroleum near the Mystic Meadows development. The ARO is requiring the basin to
be covered with a clay cap to impeded infiltration and shaped to promote positive drainage. The earthen berms surrounding
the basin are made up of coarse material (i.e., boulders and cobbles) and cannot be incorporated into the cap. No
construction work is to begin until a cap design proposal is submitted to the ARO for approval.
