Project No. 44360.1.1 Project Location: Realignment of Wall Street (Non-System) at US 17 Business (Main Street) and Shallotte Avenue (Non-System) in Shallotte, Brunswick County (see attached Vicinity Map). Project Description: The purpose of this project is to realign Wall Street at US 17 Business (Main Street) and Shallotte Avenue. The proposed roadway will have three 11’ lanes in each direction with a variable width raised median. The proposed typical section also includes curb & gutter on both sides with sidewalk. The roadway will be designed with a 40 mph design speed. Purpose and Need: The existing signalized intersection of Wall Street (non-system), Main Street (US 17 Business), and Shallotte Avenue (non-system) is currently offset and runs split side streets for signal operations. This causes delay due to an additional signal phase. Aligning the intersection will improve sight distance and delay by reducing the signal phases and improve timing for the overall intersection. This will improve mobility through the intersection. Anticipated Permit or Consultation Requirements: A Nationwide Permit (NWP) No. 14 or Regional General Permit (RGP) No. 198200031 will likely be required for impacts to “Waters of the United States” resulting from this project. A NCDWR Section 401 Water Quality General Certification No. 4135 may also be required prior to the issuance of a Section 404 Permit. The USACE holds the final discretion as to what permit will be required to authorize project construction. Special Project Information: Environmental Commitments: Greensheet Commitments are located at the end of the checklist. Estimated Costs: The estimated costs, based on 2018-2027 STIP, are as follows: R/W & Utilities $ 785,000 Const: $ 700,000 Total: $1,485,000 Estimated Traffic: Year 2019 1,500 vpd Year 2040 2,300 vpd TTST 1% Dual 2% DocuSign Envelope ID: CEFD0214-8576-4CB8-A5F5-DF1F9C623E77 2 Design Exceptions: There are no anticipated design exceptions for this project. Pedestrian and Bicycle Accommodations: This portion of Wall Street is not a part of a designated bicycle route nor is it listed in the Transportation Improvement Program (TIP) as a bicycle project. Sidewalk will be added along both sides of Wall Street. Temporary pedestrian accommodations are needed during construction in the work zone at the intersection of Wall Street and Main Street. Alternatives Discussion: No Build – The no build alternative would not improve traffic flow at the intersection of Wall Street/Main Street/ Shallotte Avenue. Other Agency Comments: The Army Corps of Engineers responded that “any discharge of excavated or fill material into waters of the United States and/or any adjacent wetlands would require Department of the Army (DA) permit authorization”. Response: NCDOT will submit for permit authorization. The Division of Coastal Management responded that “Any work which has the potential to temporarily or permanently impact coastal wetlands should be avoided as well”. Response: There are no proposed impacts to coastal wetlands. The U. S. Fish and Wildlife Service and the N.C. Wildlife Resource Commission had no special concerns for this project. Waters of the US: The NRTR (Natural Resources Technical Report) for this project identified 1 wetland within the study area. Threatened and Endangered Species: The NRTR (Natural Resources Technical Report) lists seventeen protected species, including fifteen listed by the United States Fish and Wildlife Service (USFWS) and two listed by the National Marine Fisheries Service (NMFS). None of the species listed will be affected by this project. Relocations of Residences and Businesses: There are no relocations of residences for this project however there will be one business relocated. The ABC store located adjacent to US 17 Business will be relocated and the relocation is being coordinated by the Town of Shallotte. Due to the minimal impacts to the roadway network, and to adjacent properties, no further public involvement was necessary. The North Carolina Department of Transportation and the Town of Shallotte have coordinated extensively throughout the design process as the realignment impacts Town of Shallotte property. PART A: MINIMUM CRITERIA YES NO 1. Is the proposed project listed as a type and class of activity allowed under the Minimum Criteria Rule in which environmental documentation is not required? If the answer to number 1 is “no”, then the project does not qualify as a minimum criteria project. A state environmental assessment is required. Could the proposed activity cause significant changes in land use concentrations that would be expected to create adverse air quality impacts? 3. Will the proposed activity have secondary impacts or cumulative impacts that may result in a significant adverse impact to human health or the environment? 4. Is the proposed activity of such an unusual nature or does the proposed activity have such widespread implications, that an uncommon concern for its environmental effects has been expressed to the Department? 5. Does the proposed activity have a significant adverse effect on wetlands; surface waters such as rivers, streams, and estuaries; parklands; prime or unique agricultural lands; or areas of recognized scenic, recreational, archaeological, or historical value? 6. Could the proposed activity cause significant changes in land use concentrations that would be expected to create adverse water quality or ground water impacts? YES NO 8. Is the proposed activity expected to have a significant adverse effect on long-term recreational benefits or shellfish, finfish, wildlife, or their natural habitats *If any questions 2 through 8 are answered “yes”, the proposed project may not qualify as a Minimum Criteria project. A state environmental assessment (EA) may be required. PART C: COMPLIANCE WITH STATE AND FEDERAL REGULATIONS YES NO 9. Is a federally protected threatened or endangered species, or its habitat, likely to be impacted by the proposed action? 10. Does the action require the placement of temporary or permanent fill in waters of the United States? 11. Does the project require the placement of a significant amount of fill in high quality or relatively rare wetland ecosystems, such as mountain bogs or pine savannahs? 12. Is the proposed action located in an Area of Environmental Concern, as defined in the coastal Area Management Act? 13. Does the project require stream relocation or channel changes? Cultural Resources 14. Will the project have an “effect” on a property or site listed on the National Register of Historic Places? 15. Will the proposed action require acquisition of additional right of way from publicly owned parkland or recreational areas? DocuSign Envelope ID: CEFD0214-8576-4CB8-A5F5-DF1F9C623E77 5 PART D Additional Documentation as Required from Sections B & C Question 9: The US Fish and Wildlife Service has developed a programmatic biological opinion (PBO) in conjunction with the Federal Highway Administration (FHWA), the US Army Corps of Engineers (USACE), and NCDOT for the northern long-eared bat (NLEB) (Myotis septentrionalis) in eastern North Carolina. The PBO covers the entire NCDOT program in Divisions 1-8, including all NCDOT projects and activities. The programmatic determination for NLEB for the NCDOT program is May Affect, Likely to Adversely Affect. The PBO provides incidental take coverage for NLEB and will ensure compliance with Section 7 of the Endangered Species Act for five years for all NCDOT projects with a federal nexus in Divisions 1-8, which includes Brunswick County, where U-5788 is located. This level of incidental take is authorized from the effective date of a final listing determination through April 30, 2020.
