Dear Mr. Jones:
I am writing to inform Lake Creek Corporation that the Division of Water Resources is imposing a
moratorium on the Lake Creek Corp. — Baytree Lakes WWTF and its collection 'system as a result of
Lake Creek Corporations inability to operate the wastewater treatment and disposal system in accordance
with the referenced permit. This decision is based upon the recurrent violations for flow — in conduit or
thru the treatment plant and our review of information associated with the NDMR's, as well as the
inability to certify the disposal system is capable of accepting treated wastewater in accordance with the
permit.
North Carolina General Statute §145-215.67(a) states, in part, that no person subject to the provision of
NCGS 143-215.1,143-215.108 or 143-214.109 shall cause or allow the discharge of any wastes to a waste -
disposal systemin excess of the capacity of the disposal system or of any wastes which the waste -disposal
system cannot adequately treat. Should these terms be violated, 143-215.67 states a moratorium can be
imposed "on the addition of waste to a treatment works" if the treatment works is riot capable of adequately
treating additional waste. Lake Creek Corporation — Baytree Lake WWTP converted from a discharge
permit to a non -discharge permitted facility on August 22, 2001. The application was written to expand the
WWTP capacity up to 40,000 gallons per day from 20,000 gallons per day. The upgrades were never
installed as per the application. In November 2008, Lake Creek Corporation — Baytree Lake petitioned
DWQ/Non-Discharge Unit with a new/modified WWTP design to increase treatment design up to 30,000
gallons per day. The permit to upgrade was issued in February 2009, and to date hasn't been constructed.
Based on NDMR records provided by Lake Creek Corporation — Baytree Lake, the facility began having
constant flow violations beginning in 2008 thru present. Consequently, Lake Creek Corporation — Baytree
Lake should have worked on getting the. I&I (inflow and infiltration) under control within their collection
system. Based on current flows reported bythe facility, increasing the treatment capacity to 40,000 gallons
per day would still yield permitted flow violations. Based on the number of services (166 homes, 3 club
houses, office, and pool house) and using minimum design flow rates, Baytree WWTP could/would have
average flows in the range of 60,000 gallons per day.

Based upon the information noted above, the Lake Creek Corp. — Baytree Lakes WWTF and its collection
system are hereby placed on a moratorium prohibiting the introduction of any additional waste to the
collection system tributary to the WWTF beyond the 20,000 gpd authorized in the Non -Discharge permit
WQ0018708. This is to be interpreted as to prohibit the issuance of permits for new sewer line extensions
to be connected to the WWTF, any new taps or activated connections to the existing collection system,
and/or the introduction of additional volumes of new wastewater flow via existing taps, or structure
expansions (subject to the provisions of the statute). This moratorium shall become effective 45 days from
your receipt of this letter.
This moratorium will remain in effect until Lake Creek Corporation — Baytree Lake has requested and
received operational approval of the treatment and disposal systems in accordance with the limits and
requirements within the subject permit and has obtained written notification from the Division of Water
Resources lifting of this moratorium.
As required by NCGS 143-215.67(d), Lake Creek Corporation shall give public notice that a moratorium
will be placed on the addition of wastewater to the Baytree Lakes collection system and treatment facility
within 15 days of the receipt of this letter. Lake Creek Corporation shall give public notice of the
moratorium by publication of the notice one time in a newspaper having general circulation in Bladen
County. The notice shall be as provided in the enclosed sample public notice.
Lake Creek Corporation shall provide an affidavit of publication and a copy of the public notice to the
Division of Water Resources Fayetteville Regional Office within 15 days of publication.
Placement of the public notice in no way absolves Lake Creek Corporation from past or present violations
of North Carolina General Statutes. Failure to place the public notice may subject Lake Creek Corporation
to additional enforcement action by this office.

SEWER MORATORIUM

On the basis of thorough staff review and application of Article 21 of Chapter 143, General
Statutes of North Carolina, Public Law 92-500 and other lawful standards and regulations, the
North Carolina Environmental Management Commission has determined that {Treatment ,
System Name} is unable to adequately collect and treat waste tributaryto its wastewater
treatment facility.
North Carolina General Statute 143-215.67(a) directs that no person subjeot to the provision of

Lake Creek Corporation — Baytree Lakes (aka Bay Tree Utility Company — Company # W-1080)

Lake Creek Corporation —Baytree Lakes (LCCBL) was permitted in May 1982 under NPDES permit
NC0036404. LCCBL operated under the NPDES permit until 15 August 2005 when the site transitioned to
a Non -Discharge Spray Irrigation permit (W00018708, initially issued 22 August 2001).
The spray irrigation infrastructure construction was completed and put into operation in August 2005.
As part of the initial Non -Discharge permit application, Robert Lyons P.E. designed an upgrade to the
existing extended aeration plant (original to the 1982 NPDES permit) to increase capacity to 40,000
gallons per day (20,000 gallon upgrade). The upgrade was not constructed.
A newdesign was submitted by Brian Cox, P.E., in October 2008 to upgrade the existing extended
aeration plant to 30,000 gallons per day (10,000 gallon upgrade). This upgrade has not been
.constructed. This proposal was submitted after discussions and meetings between DWQ/DWR staff and
LCCBL staff. LCCBL was concerned with additional operating and sampling costs associated with the new
2T rules for systems greater than 30,000 gallons per day. LCCBL intended to fix/repair the collection
system to reduce I & I. To date, no repairs to the collection system have been documented or submitted
to DWR.
During the operation of the wastewater collection/treatment system under the NDPES, BIMS lists 47
violations from June 1996 to July 2005. Under the Non -Discharge permit, BIMS lists 190 violations from
August 2005 to May 2019 (there are total of 236 violations, but 46 are due to no NDMR/NDAR during
the four years that the spray irrigation system wasn't construct or under construction). Listed below are
the dates of the Notice of Violations/Notice of Deficiencies issued to LCCBL under the Non -Discharge
permit:

The overwhelming percentage of the violations in the above NOV's are related to flow. As illustrated on
the attached charts from BIMS covering part of the NPDES permit and the current Non -Discharge
permit; the facility has exceeded the permitted flow of 20,000 gallons per day since Jan. 2004. There
have only been two months out of the last 186 months (Jan. 2004) that LCCBL has been below 20,000
gallons per day. There have been spikes exceeding 100,000 gallons per day 12 times during the time
period between Jan. 2004 and May 2019.
One of the NOV's listed address the lack of certified operators (ORC & BU ORC) for approximately six
months (Sept. 2011 to Feb. 2012) and failure to notify that LCCBL didn't have 'the required ORC or BU
ORC. To correct this NOV, LCCBL contracted with EnviroLink to provide the necessary ORC and BU ORC
to operate the spray irrigation system and to visit the facility and record freeboard. Since EnviroLink's
involvement with the facility, an NOV has been issued for exceeding the annual floating total of the
spray irrigation fields and exceeding freeboard in the storage lagoon. Recording keeping and routine
maintenance (i.e. rainfall, freeboard levels, flow meter calibration and operation) have greatly improved
compared with the operating history of LCCBL staff.
The current NOV and NOD are related to permit renewal. At this time the Non -Discharge permit for
LCCBL is expired. Neither Steve Jones or Red Bird Land LLC have responded to the Add Info request
dated 21 March 2017 from central office NDPU to address change of ownership, No Tap moratorium,
Map of Sewer system and Engineers Certification of infrastructure of sewer extensions installed. The
only item addressed in the Add Info letter to date is the paying of delinquents permit fees 2016. At this
time LCCBL is up-to-date on permit fees thru 2018. The next billing cycle will be 1 August 2019 for the
2019 year.
