Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The ri prap wi 11 not extend waterward more than 51 from the exi sti ng bul khead at any point along its alignment at the time of construction. (2) The ri prap materi a 1 wi 11 be obtained from an up 1 and source and wi 11 be clean and free of any pollutants, except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. (3) No marsh grass will be excavated or filled. (4) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. This pennit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. - All work must cease when the permit expires on December 31 ~ 1991 - In issumg this pennit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Willis: On February 6, 1986, we renewed general permit No. SAWC080-N- 000-0291 (enclosed), which provides Federal authorization for construction activities that receive authorization from the State of North Carolina. A review of your application received November 17, 1987, for a Department of the Army permit to place riprap material waterward of a bulkhead on Back Sound, Harkers Island, Carteret County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. We are considering authorization of the proposed activity pursuant to Section 404 of the Clean 'vater Act, and we have determined that a water quality certification may be required under the provisions of Section 401 of the same law. In accordance with our administrative regulations, 60 days after receipt of a request for certification is considered a reasonable time for State action. The applicant's property has a house, small storage building, and an existing wooden bulkhead. The proposed project is to place riprap 5' waterward along an existing 20' wooden bulkhead. The area has an erosion rate of approximately 6' per year along natural shoreline. 10.
