Dear Hr. Parker:
Reference the revised plan of Hr. John EdwardiWaters, Jr., to excavate a
canal thro.tgh wetlands, construct jetties and deeped a pond on the Atlantic
Intracoastal \vaterway (AIWW), Topsail Sound, near Sloop Point, Pender County,
North Caroliua. Also, reference our letter to you of November 13, 1987.
The Federal agencies have completed review of the revised proposal dated
January 16, 1988. By letters of Harch 11 and 14, 1983 (copies enclosed), the
National Harine Fisheries Service and the U.S. Fish and Wildlife Service
mai ntained thei r recommendations for denial of authorizations primarily
because the proposed canal continues to be unnecessarily aligned in wetlands.
The agencies would agree to issuance of State and Federal authorizations
provided:
a. the proposed canal is realigned to avoid emergent wetland excavation
to the maximum extent. '
b. the canal and pond depths do not exceed 3 feet, mean low water (MLW),
and
c. to avoid periods of high biological activity, no work would be
permitted between the dates of April 1 and September 30 of any year.
We support the comments from the Federal review agencies.

Reference the application of Mr. John Ed.ard ~a~ers, Jr., for

The ?ederal agencies have co~pleted revie~ 0: the proposal as
presente~ by the application and your field investigation report.
By letters of October 28 and October 30, 1987 (c~pies enclosed),
the U.S. ?ish and Wildlife Ser...ice (USF\.S) and the ~iational ~{arine
?isherie5 Service (~~S) objected to the proposal priuarily
because :: the projected loss of approxi~ately 0.7 acre of
Spar:ina alterniflora and Juncus roeoerianus.
The ~3FWS reco=uended realigning the canal to uinirnize
excavati:n of vegetated ~e~lands and li~iting excavation in the
canal a:::~ pond to a ~xi~uD depth of 3 feet, cean low ~ater (HLW).
The ~0{FS suggested i~proving/enlarging the existing pier
structure. we support the opinion of the agencies that
authorization for the work, as presently designed, be denied. We
have pr~.,:ded the co~ents of :hese agencies to ~r. Waters and
anticip~:= his co:::zen::s/intentions on or before ~iove:1ber 21, 1987.

The Subject application has been reviewed for water
quality impacts and the following comments are offered:
a. The proposed project does require a 401 Water
Quality Certification but does meet the
requirements for certification under General
Certification No. 1272 for bulkhead construction.
b. Because the project would result in an "L" shaped
channel approximately 340 feet along at a depth of
10 feet below HLW and connecting waters are only 3
feet below MLW, a "sink" would be expected to
result and poor flushing of the basin will be
expected. As a result of the inhibited flushing
characteristics, contraventions of water quality
standards, especially dissolved oxygen, would be
expected to occur. Unless the project is modified
to provide a depth which would allow flushing to
occur, the permit should be denied.

Project Description: The applicant proposes to dredge a marsh
area to reconnect a one time boat basin to the AIWW. Wooden
jetties are also proposed to reduce shoaling.

8. Project Summary The applicant proposes to reconnect an existing man-made pond
to the AIWW and to place jetties at the connection to protect it from shoaling.

9. PROJECT DESCRIPTION
The project site is located on the west side of the AIWW in the Sloop Point
community. There is an existing pond which measures approximately 36' wide x
180' long. Depths are shown on the plans ranging from -41 mlw to -10' mlw.
Based on conversations with the applicant and also adjacent property owners,
the pond was originally connected to the AIWW by an access channel some
distance north of the existing northern end of the present feature. A border
of mixed marsh now exists between the existing pond and the fringe of smooth
cordgrass along the AIWW. The pond fringe is approximately 1401 wide and
contains black needle rush ~ roemerianus) and smooth cordgrass (S.
alterniflora) as the predominant species. The adjacent waters are classified
as SA open and are a secondary nursery.
The applicant is desirous of reopening the connection of the pond to the AIWW
to create a basin with access channel. The dimensions of the proposed channel
are approximately 144' long x 161 wide x -10' mlw. All spoil will be excavated
by a mechanical excavator and placed on the adjacent high ground.
Approximately 844 cubic yards of material would be involved. Two jetties each
approximately 50' long would protect the mouth of the access channel.
10. ANTICIPATED IMPACTS
The projects as proposed would cause to be consumed approximately 2652 sf of
coastal wetlands. Of this total approximately 1,126 sf would be Juncus
roemerianus. The other 1,526 sf would be Spartina alterniflora. Additionally
the 10' proposed depth wo~ld create a very serious potential water quality
problem due to the d~fference in depth between the feature and the connecting
waters. This difference does not appear to be consistent with 7H
.0208(b)(1)(F). These impacts would be significantly reduced by shifting the
entrance into the adjacent high ground. Approximately 25' of the Spartina
alterniflora fringe along the AIWW would still be crossed with a resulting loss
of approximately 400 sf of wetland. The depth should also be reduced to no
more than the -31 mlw depth indicated in the area adjacent to the AIWW.
