We are considering authorization of the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification may be required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is considered a reasonable time for State action. JUSTUS AMr~ONS BIO REPORT VILLAGE AT NAGS HEAD Submitted by: George H. Hood PAGE 2 Date: November 18, 1986 SITE DESCRIPTION: The applicant's property is a 375 acre tract which extends from the Atlantic Ocean to Roanoke Sound in Nags Head, N.C. This tract was previously known as the "Epstein Tract". U.S. 158 Bypass transects the property and for purposes of this report the property which lies to the west of the Bypass will be referred to as "Soundside" and that to the east "Oceanside". The sandy rolling topography on the soundside results in elevations ranging from 0 to 40 feet above mean sea level. This area supports a variety of marsh, shrub, and thicket vegetation. The Corps of Engineers has delineated the "404 no permit to fill" alignment which reflects the normal water line along the sandy Roanoke Sound shorefront, a connected Juncus roemerianus marsh, an isolated Juncus marsh in the center of the soundside property and an old D.O.T. drainage ditch on the southern boundary. These areas are depicted on the illustrative master plan. A commercial shopping center (Outer Banks Shopping Mall) exists on 16.8 acres of the soundside property and is serviced by a 120,000 gpd sewage treatment facility. The adjacent waters of Roanoke Sound are classified as "S.A.". The Division of Archives & History has documented sites DR22, DR46 and a National Register Historic District in or near the proposed development. The oceanside is characterized by predominantly flat sandy soils which rises to a continuous primary dune along the ocean front. An out parcel separates the tract with the area to the south of the out parcel exhibiting an erosion rate of two feet per year and the northern area's rate at three feet per year. The first line of stable natural vegetation was established for planning purposes on 10 June 1986 and is depicted on the master plan. Structures existing on the ocean side are a municipal complex and water tower, a 36 unit townhouse development on the north oceanfront known as liThe Quay" and developed under CAMA Minor Permit #82-048, and four single family structures on the south end of the oceanfront known as "Sea Point" and being constructed under CAMA Minor Permit #85-035. Proposed for development on the soundside are: 700 dwelling units comprised of single family detached and multi family units. upgrading the existing waste treatment facility to 1.0 MGD capacity. a new municipal facility of 5.38 acres. an eighteen hole golf course and club house. 16.26 acres of street right of way with the roads to be paved with asphalt. a 4.25 acre shopping center expansion. .34 acre public sound access on the northern boundary. two one hundred foot long piers with "T" heads. The rest will be excavated in the sandy soils throughout the development. These ponds will be part of the storm water management program which is being assessed by the Division of Environmental Management. Proposed developments for the oceanfront are: two hotels with a total of 800 rooms. 16.75 acres of commercial/office complexes. 500 dwelling units comprised of single family detached and multi-family. beach/tennis club. dune crossovers, gazebos and decks. 3.20 acres of road right of way. removal of the existing municipal building with retention and improvements of public beach access. and relocation of Virginia Dare Trail. Wood Date: Novembrr 18, 1986 JUSTUS AMMONS VILLAGE AT NAGS HEAD BIO REPORT PAGE 4 ANTICIPATED IMPACTS: The construction proposed on the 375 acre tract will result in the destabilization of hundreds of acres of hi~hground. With careful phasing and an appropriate sedimenta- tion erosion control plan (administered by the Town of Nags Head) offsite sedimentation can be 1 arge1y avoided. Impacts to the liS .f\. II waters of the adjacent Roanoke Sound could be mitigated by the development and implementation of a prudent storm water management plan. A plan has been submitted to the Division of Environmental Management. The ponds playa major role in this plan and care must be taken to adequately set back the ponds from the NWL to avoid connection of these waters to Roanoke Sound by erosion. Certainly the pond which will be connected to Roanoke Sound such that a 10 year storm would flow through the drainage ditch should be reviewed carefully to determine the impact of accumulated fertilizers and other pollutants on adjacent waters. The excavation of one of the ponds will result in the loss of approximately 100,000 square feet of isolated mixed Juncus marsh. The filling of 500 square feet of relatively unproductive shallow water habitat to place a culvert for access across the D.O.T. drainage ditch will not contribute directly to any Significant environmental degradation. However, the development of such a large complex does raise some important local issues. The Town of Nags Head should consider its ability to provide fire protection for the 60 foot high hotels. Additionally, police protection, garbage services as well as the control of increased traffic should be addressed by the Town. Potable water always represents a problem in this area and the Town should be a\'/are of the commitment for this project. CAMA REVIEW: The project site is classified as transition in the Nags Head LUP. The proposal is consistent with that plan. Submitted by: George H. Item 111.0.1 During the course of road construction a minimal amount of cut and fill will be necessary to establish safe and durable roads which physically blend with surrounding elevations. Major excavation will be in areas of proposed ponds with expected depths of 8 to 12 feet. . The sand dune elevation near green # 16 will be reduced from 40 ft. to about 28 ft. mean sea level (msl). Existing ground elevations are around 5 ft. msl. 2. Item III.E.l Approximately 2,000 cubic yards of fill material is proposed to be placed within about 800 ft. of the existing ditch located between tee #3 and fairway #4. 3. Item V.B.4 Buildings will generally be constructed of wood frame or concrete and steel on foundations of wood pilings, concrete block or slab. Number of dwellings are shown on the Master Land Use Plan. 4. Existing ocean accesses in the area include: a) a 70 ft. wide parking area on the north side of the Quay, b) a 6 ft. pedestrian access on the south side of Sea pointe, c) a 70 ft. access on the south edge of the outparcel, d) a 30 ft. parking area on the property's south edge. Any other access to the beach is prohibited by the Town of Nags Head. These accesses are heavily used during the peak portions of the summer tourist season. No public access to the Roanoke Sound currently exists along the the approximately 6,600 linear feet of soundfront property. 3 5. Proposed ocean accesses include: a) a 75 ft. property owner's beach access to the south of the hotel/restaurant amenities b) a 50 ft. wide addition to the existing access in c) above for a total of 120 ft. c) a 50 ft. wide addition to the existing access in d) above. for a total of 80 ft. Two sound accesses are proposed for the use owners. One 60 ft. x 250 ft. public sound access is the northwest corner of the property. Access will by way of existing street in Old Nags Head Cove.
