with the application and ronditions hereinafter set forth.
Condition(s) of Certification:

as to prevent significant increase in turbidity

turbidity in the Stream is 25 NTU's or less
are not considered significant).

The applicant is proposing to repair their existing tank trail
and to install sixteen culverts to facilitate creek crossing.
The project will require a 401 Water Quality Certification for
the filling associated with the placement of the culverts. The
401 Certification should contain the following conditions:
1. That all fill material be free from toxic material.
2. That all erosion control measures be implemented prior to
the placement of the fill material.
3. That the side slopes be stabilized.
4. That the construction activity should not cause significant
increase in the turbidity levels downstream of the project.
This office has no objection to the project as proposed.

c. The activity will not jeopardize a threatened or
endangered species as identified under the Endangered Species Act,
or destroy or adversely modify the cultural habitat of such
species.
d. The activity will not significantly disrupt the movement
of those species of aquatic life indigenous to the waterbody
(unless the primary purpose of the fill is to impound water).
e. Any discharge of dredged or fill material will consist of
suitable material free from toxic pollutants.
f. Any structure or fill will be properly maintained.
g. The activity will not occur in a component of the National
Wild and Scenic River System nor in a river offically designated
by Congress as a "study river" for possible inclusion in the
system.
h. The activity will not cause an unacceptable interference
with navigation.
i. If the activity may adversely affect historic properties
which the National Park Service has listed on, or determined
eligible for listing on, the National Register of Historic Places,
or if significant historic properties are encountered before or
during work, the permittee will notify the District Engineer.
j. The construction or operation of the activity will not
impair reserved tribal rights, including, but not limited to,
reserved water rights and treaty fishing and hunting rights.
k. An individual State water quality certification must be
obtained or waived. Conditions of certification will be
considered to be special conditions of the Federal nationwide
permit .
1. The following management practices will be followed to the
maximum practical extent:
(1) Discharges of dredged or fill material into waters of
the United States will be avoided or minimized through the use of
other practical alternatives.

(2) Discharges in spawning areas during spawning seasons
will be avoided.
(3) Discharges will not restrict or impede the movement
of aquatic species indigenous to the waters or the passage of
normal or expected high flows or cause the relocation of the
waters (unless the primary purpose of the fill is to impound

(4) If the discharge creates an impoundment of water,
adverse impacts on the aquatic system caused by the accelerated
passage of water and/or the restriction of its flow will be
minimized.
(5) Discharge in wetland areas will be avoided.

Dear Mr. Mills:
Enclosed please find an Application for 401 Water Quality
Certification for the above-referenced project. A 404 permit has
already been issued by the Corps of Engineers for this project
under Nationwide provision Number 26 for minor road crossing
fills. A copy of this permit is enclosed for your convenience.
Also enclosed are plan sheets showing the location of proposed
culverts.
Please note that this project is not new construction, but
involves only the overlay of existing trails and installation of
approximately sixteen new culverts perpendicular to the trail to
carry existing watercourses across the trail. Very minimal fill
below MHW will be required to install these culverts since they
are located across existing trails only. In many cases, the
amount of existing fill will be reduced when the aggregate overlay
and culvert installation is completed.
Currently, there are many trails throughout the Marine Corps
Base connecting maintenance areas, tactical landing zones (TLZs)
and firing ranges. The majority of traffic on these trails is
heavy tracked vehicles such as tanks, armored personnel carriers,
armored vehicle launch bridges and amphibious vehicles. Existing
trail widths vary significantly and range from sixty feet to over
two hundred feet. Wide areas in the trails typically result from
heavy vehicles circumnavigating obstructions such as washouts,

mudho1es or fallen trees. Often the mudholes and washouts origi-
nally resulted from poor or inadequate surface drainage on the
trail. These areas have deteriorated over time due to a lack of
regular maintenance and inadequate initial roadway construction.
without proper repair, including provision for local drainage,
trails will continue to deteriorate and vehicles will continue
their infringement on adjacent areas avoiding obstacles.
Camp Lejeune base officials contracted with Talbert, Cox &
Associates to design repairs for three trails on base: Amphibian
Area to TLZ Albatross, Rhodes Point to TLZ Cardinal, and TLZ Crow
to TLZ Lark. Combined, these trails are approximately eighteen
miles long.
The method of repair was dictated by Camp Lejeune personnel
and consists of overlaying a thirty-foot wide portion of the trail
with compacted aggregate and providing required drainage with
aluminized corrugated metal pipes under the improved trail to
allow existing watercourses, currently blocked or ponded by the
trail, to continue in their natural drainage patterns. The new
pipes are forty feet in length. Most of the new pipes are 18" in
diameter and the largest is 36" in diameter.
The trail repairs are designed to carry this heavy vehicular
traffic well into the future with minimal maintenance, and adjust-
ments to the existing trail elevations will be minimal. As a
result of this project, the low-lying areas \'li11 be restored to
their original drainage patterns and traffic will be carried on
the improved trail; thus preventing further infringement on
adjacent areas to the trail.
Early in the conceptualization of this project, we met with
Mr. Hugh Heine of the Corps of Engineers Regulatory Branch on-site
to show him the low-lying areas along the trails and discuss ways
to avoid infringement into wetlands. As a result of this meeting,
a portion of one trail was relocated onto an adjacent gravel road
and another area was not improved over the entire thirty foot
standard width.
As discussed above, provision of adequate load bearing road
base and drainage for these trails will result in a long lasting
facility that will allow tracked vehicles to traverse areas with-
out damage to adjacent woodlands, wetlands or streams and will

restore natural drainage patterns in many areas where the existing
trail blocks normal stormwater runoff. If you need additional

Dear Mr. Readling:
Reference is made to your June 3, 1987 letter regarding the
repair of tank trails Amphibian Area to TLZ Albatross, Rhodes
Point to TLZ Cardinal, and TLZ Crow to TLZ Lark, U.S. Marine Corps
Base, Camp Lejeune, Onslow County, North Carolina.
For the purposes of the Corps of Engineers' Regulatory
Program, Title 33, Code of Federal Regulations (CFR), Part 330,
published in the Federal Register on November 13, 1986, lists
nationwide permits. Authorization was provided for minor road
crossing fills including all attendant features, both temporary
and permanent, that are part of a single and complete project for
crossing of a non-tidal waterbody, provided that the crossing is
culverted, bridged or otherwise designed to prevent the
restriction of, and to withstand expected high flows and provided
further that discharges into any wetlands adjacent to the
waterbody do not extend beyond 100 feet on either side of the
ordinary high water mark of that waterbody.
For this nationwide permit to be valid, you must comply with
the following conditions:
a. Any discharge of dredged or fill material will not occur
in the proximity of a public water supply.
b. Any discharge of dredged or fill material will not occur
in areas of concentrated shellfish production unless the discharge
is directly related to a shellfish harvesting activity authorized
by nationwide permit, 33 CFR 330.5(a)(4).

c. The activity will not jeopardize a threatened or
endangered species as identified under the Endangered Species Actt
or destroy or adversely modify the cultural habitat of such
species.
d. The activity will not significantly disrupt the movement
of those species of aquatic life indigenous to the waterbody
(unless the primary purpose of the fill is to impound water).
e. Any discharge of dredged or fill material will consist of
suitable material free from toxic pollutants.
f. Any structure or fill will be properly maintained.
g. The activity will not occur in a component of the National
Wild and Scenic River System nor in a river offically designated
by Congress as a "study river" for possible inclusion in the
system.
h. The activity will not cause an unacceptable interference
with navigation.
i. If the activity may adversely affect historic properties
which the National Park Service has listed ont or determined
eligible for listing on, the National Register of Historic Placest
or if significant historic properties are encountered before or
during workt the permittee will notify the District Engineer.
j. The construction or operation of the activity will not
impair reserved tribal rights, including, but not limited to,
reserved water rights and treaty fishing and hunting rights.
k. An individual State water quality certification must be
obtained or waived. Conditions of certification will be
considered to be special conditions of the Federal nationwide
permit.
1. The following management practices will be followed to the
maximum practical extent:
(1) Discharges ~f dredged or fill material into waters of
the United States will be avoided or minimized through the use of
other practical alternatives.

(2) Discharges in spawning areas during spawning seasons
will be avoided.
(3) Discharges will not restrict or impede the movement
of aquatic species indigenous to the waters or the passage of
normal or expected high flows or cause the relocation of the
waters (unless the primary purpose of the fill is to impound
water) .
(4) If the discharge creates an impoundment of water,
adverse impacts on the aquatic system caused by the accelerated
passage of water and/or the restriction of its flow will be
minimized.
(5) Discharge in wetland areas will be avoided.
(6) Heavy equipment working in wetlands will be placed on
mats.
(7) Discharges into breeding areas for migratory
waterfowl will be avoided.
(8) All temporary fills will be removed in their
entirety.
The District Engineer has determined that the individual and
cumulative adverse effects of your work on the environment will be
minimal. Your work is authorized by nationwide permit provided it
is accomplished in strict accordance with the preceding
conditions. Please be aware that this authorization does not
relieve you of the responsibility to obtain any required State or
local approval.
