This pennit, issued on I /~/ 758 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these tenns may subject ( pennittee to a fine, imprisonment or civil action; or may cause the pennit to be null and void. (1) In order to protect juvenile fin fish populations, no excavation or filling wi 11 be permi tted between March 1 and September 30 of any year wi thout the prior approval of the Division of Coastal Management. (2) All excavated materials will be confined landward of the normal water elevation contour and any irregularly flooded vegetated wetlands. (3) Excavation will not exceed 9 feet below the elevation of normal water. (4) . The temporary placement or double 'handling of excavated or fill materials within waters or vegetated wetlands is not authorized. (5) . Silt fences will be erected between the spoil site and the barge basin to prevent reentry of sediments into Moccasin Creek. (6) The spoi 1 area wi 11 be proper ly graded and provi ded a ground cover suffi ci ent to restrain erosion within thirty (30) days of project completion. (See attached sheet for Additional Condit~ons) ( This pennit action may be appealed by the pennittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This pennit must be accessible on.site to Department personnel when the project is inspected for compiJ..nce. Any maintenance work or project modification not covered hereunder requires further Departmental approval. , All work must cease when the pennit expires on December 31, 1991 .. The shoreline is bulkheaded at the loading area. The site is currently used to load trees onto barges. The area directly in front of the loading dock has filled in due to accumulated materials (bark, etc.) fallin~ , into the water. The applicant proposes to perform maintenance excavation of the 300' X 50' X _91.. area to allow for the barges to come in and out vlitholJt hitting bottom. The area was originally dredged to a depth of 9 ft., and the applicant wishes to regain this depth. A spoil site is on adjacent high ground. ANTI CI P.l\TED H1PACTS The proposed project will result in the excavation of 15000 square feet of creek botto~, resulting in 1200 cubic yards of spoil material.
