Any violation of these tenns may subject pennittee to a fine, imprisonment or civil action; or may cause the pennit to be null and void. (1) This modification authorizes limited debris removal and bulkhead as described in the attached revised plats. (2) The project should be undertaken with caution. If during construction, materials of cultural significance are encountered, work must immediately cease and notification must be given to the Division of Coastal r~anagement at 338-1558 and the Corps of Engineers at 343-4629. (3) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands ts not authorized. (4) No excavated or fill material will be placed at any time in any marsh or surrounding waters outside of the alignment of the fill area indicated on the work plat(s). (5) If existing pilings cannot be lifted out by a crane and the piling have to be washed out wi th a pump, the work may not take place from March 1 through September 30 of any year: ~ithout pr:i 9r approval of the Di vi si on See att This pennit action may be appealed by the pennittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This pennit must be accessible on.site to Department personnel when the project is inspected for compliance. This includes all areas where pilings are to be removed or installed. The investigation will satisfy the N. C. Department of Cu1 tura 1 Resources, Di vi si on of Archi ves and Hi story, regardi ng the presence, extent and significance of underwater archaeological remains. Contact that agency at 919-733-4763. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. b. It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats from damage by wavewash. The permittee will not hold the United States liable for any such damage. c. A review of your application received June 9, 1987, for a Department of the Army permit to construct docks and install mooring piles in the Pasquotank River to establish a 10 slip commercial marina, Elizabeth City, Pasquotank County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. Comments from Federal review agencies will be furnished to the State. If your application must be withdrawn from this general permit process for any reason, you will be written and informed of its further management. ( 'I, THORNTON DEVELOPMENT CORPORATION BID REPORT PAGE 2 SITE DESCRIPTION The applicantls property is located in Pasquotank County in Elizabeth City at 200 \~ater Street adjacent the Pasquotank River. This lot has an existing 2 story masonry building which is proposed to be converted into offices and a restuarant. The remaining area of this lot vlill be a parking lot. The applicant has already received approval for these plans through the CAMA minor permit program. The existing shoreline is riprapped, with a small section of it having a wooden bulkhead. The lot currently slopes gently towards the river. The applicant prpposes to construct 10 boat slips behind his lot. An existing concrete bulkhead adjoins his property to the southo The proposed slips will not extend out past this existing bulkhead align- ment. Additionally, as shown on plat 2, there exists many pilir.ss in this area which is now unnavigable. The applicant proposes to remove all these pilings and to construct a pier system to accomodate 10 boatse The pier will extend perpendicular 751 out into the river. The "L" will be 151 from the shore and extend parallel to the shore 1051. The proposed pier will be 61 wide, with the maximum width being 81 (this being on the first 151 of the perpendicular section of pier). Five finger piers are proposed, with 23 mooring pilings. Four slips are proposed, to be 351 irl length and 151 wide (these are located along the perpendicular section of pier). Six slips will be 181 in width and 501 in length (these are located along the parallel section of pier). The applicant proposes to remove the existing pilings by pulling them up by crane. However, if the crane is unable to remove the pilings, a pressure pump will be used to remove the pil i ngs. . ANTICIPATED IMPACTS The project as proposed will result'in the usurping of 1080 square feet of river bottom, however, this bottom is already unavailable to navigation due to so many existing pilings at this location.
