CERTIFICATION

THIS CERTIFICATION is issued in conformity with the requirerrents of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Envirorurenta1 Managment
Regulations in 15 NCAC 2H, Section .0500 to Harry Stovall pursuant to an
application filed on the 18th day of February, 1987 to fill an isolated
wetland area for roadway construction in Cedar Landing SUbdivision.

The Application provides adequate assurance that the discharge of
fill material into an isolated wetlands area adjacent to the waters of
Hewlett's Creek in conjunction with the prop:::lsed roadway construction in
New Hanover County will not result in a violation of applicable Water
Quality Standards and discharge guidelines. 'Iherefore, the State of
North Carolina certifies that this activity will not violate Sections
301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in
accordance with the awlication and conditions hereinafter set forth.

Cbndition(s} of Certification:

1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 25 mu's or less
are not considered significant).

2. That appropriate sedi.rrentation and erosion control
measures shall be employed to minimize turbidity
and siltation impacts.

Violations of any condition herein set forth shall result in
revocation of this Certification.

'Ibis Certification shall becalE null and void unless the above
conditions are made conditions of the Federal Permit.

Dear Mr. Mills:

Enclosed please find correspondence with Regulatory Branch dated 2/4/87 and
2/9/87, the Preliminary Plat for the 12 lot development and the Water
Quality Certification fom.

As the plan indicates the flagging has been surveyed and the area
calculated to be 0.46 acres.

Any disturbance occurring in that area will be relative to finish floor
elevations and street grades. '!his has not been established but will be
kept to a minimum to establish positive drainage from structure and
maintain adequate cover for the gravity waste line.

I hope I've addressed the items we discussed by phone on 2/13/87. If
additional infonnation is required please contact me.

Reference is made to the Cedar Landing subdivision located
between Hewletts Creek and Greenville Loop Road, New Hanover
County, North Carolina. The project site was inspected by
Ms. Alison Arnold of our staff on December 24, 1986, and
January 14, 1987. The property contains a small area of wetland
subject to our jurisdiction under Section 404 of the Clean Water
Act. Ms. Arnold flagged the boundary of the area subject to our
jurisdiction on January 14, 1987. It is our understanding that
you will survey her flags and provide a copy of the survey to this
office. Once the survey is completed, we can determine what, if
any permits will be required for the proposed project.
