This pennit, issued on 1/ is subject to compliance with the application (where consistent
with the pennit), all appli bl egulations, special conditions and notes set forth below. Any violation of these teOlls may be
subject to a fine, imprisonment or civil action; or may cause the peOllit to be null and void.
1) The project will be conducted in accordance with the following plats: Plats
identified under "Title" of the Table of Contents of the application book ~
prepared by McKim and Creed dated March, 1989; Peregory letter dated 4/21/89 ~!
to Gossett and associ ated boardwalk plat, revi sed p'l at for wastewater treat-
ment facilities with cover letter from Peregory to Mills dated 8/30/89;
revised sheet #13, and sheet #17, modified by DCM, 9/7/89.
Genera 1
2) The bulkhead will not extend waterward more than 2' from the normal water
level at any point along its alignment at the time of construction. NOTE:
Prior to any bulkhead construction, the proposed alignment wi~l be staked
by a representative of the N. C. Division of Coastal Management.
(See attached sheet for Additional Conditions)
This pennit action may be appealed by the pennittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
ini liation or continuance, as the case may be.
This peOllit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on

ADDITIONAL CONDITIONS
3) All backfill material will be obtained from a highground source and confined
behind the permitted bulkhead.
4) No marsh grass will be excavated and/or filled.
5) No excavated or fill material will be placed at any time in any marsh or
surrounding waters outside of the alignment of the fill area indicated on the
work plats.
6) No meandering piers or walkways through any wetlands are authorized by this
permit, except for the observation piers as discussed and depicted on the
attached Peregory letter and plat of 4/21/89.
7) No pedestrian footpaths or trails, constructed of asphalt, concrete, gravel,
etc. can be placed below the 10 year flood elevation which is 7.0' at the
project site. Earthen paths which will consist of only vegetation removal (no
land disturbing) activities can be placed below the 7.0' contour. NOTE: The
only piers over wetlands authorized by this permit are those for direct access
to T's or observation platforms and shall not extend more than 100' beyond the
NWL or exceed 6' in width. These piers and docks may have "T" heads or
platforms not exceeding 500 sq. feet built at their waterward end and not
covering any vegetated wetland areas.
8) Wetlands crossing of the proposed road as noted by sheet 13 will be
accomplished by bridging. No fill will be placed in these wetlands.
9) Tn order to protect water quality, runoff from the construction area must not
visibly increase the amount of suspended sediments in adjacent waters.
Marina Construction and Operation
10) Prior to the construction of the marina pier system, the following distances
must be surveyed and buoyed exactly as shown on sheet No. 17 which is labeled
PIER SYSTEM DETAIL in the application package: A - 395'; B - 485'; C - 535';
D - ')40'; E - 485'. These surveyed points must be reviewed by a
representative of the N. C. Division of Coastal Management, prior to any pier
construction.
11) The pier containing the pumpout and fuel facilities is hereby deleted, as
depicted by the attached sheet 17, modified by DCM.
12) The walkways which will connect the five marina piers will be located at or
landward of the NWL. At no point shall the walkways extend more than 2'
beyond the NWL.
13) Piers and docks shall be elevated over coastal wetlands and shall not exceed
6' in width.
14) Prior to occupancy of any new slips authorized under this permit, the
permittee will permanently equip and maintain for the life of the marina a
, pump-out facility to service boats with holding tanks.

15) The marina will display a sign showing the location of the pumpout facility,
including other appropriate waste disposal information, at the entrance and
exit from the main piers.
16) No sewage, whether treated or untreated, shall be discharged at any time from
boats using the marina. Any sewage discharge at the dock facility, or within
Chocowinity Bay by a vessel using the marina, shall be considered a violation
of this permit for which the permittee is responsible. This prohibition shall
be applied and enforced throughout the entire existence of the permitted
structure.
17) If it is determined that discharges from boats using the marina are making a
significant contribution to pollution that results in a violation of water
quality standards, or if it is determined that there is a pattern of
discharges within Chocowinity Bay from boats using the marina, then the
permittee may be required to cease all use of the permitted structure and
remove it from the waters of Chocowinity Bay.
18) This permit authorizes only the docks, piers and other structures and uses
located in or over the water that are expressly and specifically set forth in
the permit application. No other structures, whether floating or stationary,
may become a permanent part of this marina without permit modification. No
non-water dependent uses of structures may be conducted on, in, or over public
trust waters without permit modification.
19) In order to reduce the possibility of collision by boats in periods of
darkness or inclement weather, the waterward-most extremities of the piers
will be permanently m~rked by reflective material.
20) No attempt will be made by the permittee to prevent the full and free use by
the public of all navigable waters at or adjacent to the authorized work.
21) All boating access for the development will be provided at the permitted
marina. No individual piers will be allowed.

22) Prior to construction of the marina, the permittee will prepare, in
coordination with the Division of Coastal Management, restrictive covenants
prohibiting the construction of individual piers. These restrictive covenants
shall also set aside an easement, or buffer zone, from the normal water
elevation of Chocowinity Bay to be held in perpetuity by the Cypress Landing
homeowners association. Construction of any individual piers will require the
permittee to cease all use of the permitted structure and remove it from the
waters of Chocowinity Bay.
23) An operational manual will be developed and enforced for the life of the
marina. The manual must be completed and approved by DCM prior to boat
occupation of any slips.

ADDITIONAL CONDITIONS
24) The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the project without having the
permit transferred to a third party.
Archaeological
25) An archaeological site shown as "Ruins" on the Hackney USGS quadrangle map is
located within the area identified for the wastewater treatment fields. This
site must be investigated and results of any findings submitted to the N. C.
Department of Cultural Resources, Division of Archives and History, through
the Division of Coastal Management, prior to commencement of construction at
that site.
General Notes
NOTE
A written vector control plan should be considered for this development.
Similar size developments in Florida include mosquito and biting fly
control in the preliminary proposal. These should include:
(1) pond and marsh surveillance,
(2) larval control methods;
(3) pond and spray irrigation field plans to minimize creation of
mosquito habitat;
(4) pond and irrigation field maintenance plans to minimize and control
floodwater species of mosquitoes, and,
(5) on-site capability to control larvae and to spray for adults if
necessary.
NOTE:
A Dam Safety permit may be required for the main pond.
NOTE:
An Erosion and Sedimentation Control Plan will be required for this
project. This plan must be filed at least thirty (30) days prior to the
beginning of any land disturbing activity. Submit this plan to the
Department of Environment, Health and Natural Resources, Land Quality
Section, 1424 Carolina Avenue, Washington, NC 27R89.
NOTE:
Future changes in project density, or marina size will require a
modification of this permit.
NOTE:
Authorization to carry out the project must also be provided by the Corps
of Engineers - Telephone 919/251-4631.

The subject revised application has been reviewed for water
quality impacts and the following comments are offered:
a)
The revised wastewater treatment site as submitted on August
31, 1989 has been reviewed by our regional staff. We find
that the site is satisfactory to allow disposal of the amount
of wastewater expected to be generated by the Cypress Landing
Development (300,000 gpd). This site is likely to receive a
non-discharge permit once final engineering and design have
been completed and reviewed.
b)
The applicant has revised the road way crossing involving
wetland fill to provide for bridging of this area. The
proposed bridge resolves our problems with wetland impacts
from the proposed roadway.
Based upon the revised information our objections as
described in our August 23, 1989 comments have been adequately
addressed. We no longer object to permit issuance for this
project.

Dear Mr. Mills:
Attached please find documents responding to your
letter of August 23, 1989, concerning Weyerhaeuser Real
Estate Company's permit application for its Cypress Landing
project on Chocowinity Bay in Beaufort County. The attached
documents deal specifically with item C of your letter.
Item C states the Division's concern over the proposed
1/2 acre wetland fill section for a road crossing. Exhibit
C attached details a bridge crossing of the wetland area.
This alternative proposal for the road crossing is submitted
along with a request for Division consideration of allowing
the fill section crossing based on an agreement between
Weyerhaeuser Real Estate and the Division on a suitable
mitigation plan. It is our feeling that the CAMA permit
could handle this issue through condition stating that if an
agreement on a mitigation plan is not reached prior to the
road crossing being constructed, the crossing must be
bridged according to the bridge plan shown on sheet 13 of
the Permit Application.

wastewater treatment site. The attached exhibit A shows a
re-alignment of the storage lagoons, oxidation ponds, and
spray fields that avoids wetlands areas and provides
appropriate buffers. Additional spray field areas have been
added to provide the 323 acres of wetable area specified by
Alton Hodge on August 28, 1989. The new spray field areas
have been screened for wetlands by Timber & Land Management
Consultants, Inc. (Mr. Rob Moul) .

'The Subject application has been reviewed for water quality
impacts and the following conunents are offered:
a) The proposed project has an acceptable stormwater
management plan.
b) The proposed sewage disposal facilities for the project
are unacceptable as submitted. The proposed oxidation
ponds and the sewage storage lagoon are hardwood swamp
areas. The Corps has investigated this site on November
7, 1988 and determined that the area was no longer a
404 jurisdictional wetland due to the drainage
alterations which had been constructed to these areas.
However, our field staff found these areas to be an
inundated hardwood swamp and dredging ponds or lagoons
in these areas would not be acceptable. Additionally,
the wetland areas in sites 3,4,5,18,19 and 20 are also
hardwood swamp areas recently inundated. These areas
are considered to be wetlands. These areas should be
avoided as a part of the land application - spray
irrigation wastewater treatment system. The Company
should submit a revised site plan for the wastewater
treatment and disposal facilities.

c) The wetlands fill proposed for the roadway construction

available and should be considered. The 401
Certification for this fill has been denied. A copy of
the denial is attached.
The Division objects to the permit issuance as submitted.
The specific water quality problems that must be resolved are the
wastewater treatment and disposal system locations and the
wetland fill for the roadway as explained in (b) and (c) above.

This Division received your application for Water Quality
certification under Section 401 of the Federal Clean Water Act on
April 12, 1989. The application requests certification for
proposed placement of fill materials into a hardwood swamp
wetlands adjacent to the waters of the Chocowinity Bay. The
proposed fill is to facilitate roadway construction and will
result in the filling of approximately one-half acre of wetlands.
This roadway is a portion of the Cypress Landing Development, a
874 acre project consisting of 400 single family lots, 172 patio
homes, 152 day cottages, 24 townhomes, convenience shopping
center, 18 hole golf course, and a 302 slip marina. Issuance of
a Water Quality Certification by this Division must be based upon
a reasonable assurance that the activity is not expected to
result in violations of Water Quality Standards applicable to the
surface waters which may be affected.
A specific concern for impacts upon water quality on this
project relates to the loss of important uses of this wetland
area. Wetlands serve essential functions, such as purification
of surface waters and groundwater recharge. Filling of this area
will eliminate these uses. Such a loss of use is inconsistent
with the Antidegradation Statement of the Environmental

Management Commission's Water Quality Standards. This proposed
wetland fill is considered to be avoidable in that alternatives
are available for constructing the roadway to either avoid the
wetlands or bridge them. Because of the potential water quality
standards violation and the existence of alternatives for the
wetland fill, I have determined that your application for Water
Quality Certification should be denied.
If this denial is unacceptable to you, you have the right to
an adjudicatory hearing upon written request in thirty (30) days
following receipt of this denial. This request must be in the
form of a written petition, conforming the Chapter 150B of the
N.C. General Statutes, and filed with the Office of
Administrative Hearings, Post Office Drawer 11666, Raleigh, North
Carolina 27604. Unless such demands are made, this denial shall
be final and binding.

Thank you for your letter of June 22, 1989, regarding the application of
Weyerhaeuser Real Estate Company for Department of the Army authorization
to construct marina facilities and place fill material in wetlands on
Chocowinity Bay for development of a residential community with golf course,
Cypress Landing, near. Chocowinity, Beaufort County, North Carolina. Your
notice that a petition has been filed to classify Chocowinity Bay as an
Outstanding Resource Water (ORW) is appreciated.
Presently, in coordination with the N.C. Division of Coastal Management
(NCDCM), Weyerhaeuser's application is being considered pursuant to our
State/Federal general permit (administrative process) No. CESAW-C080-N-OOO-
0291. This general authorization makes Federal authorization available for
construction activities that receive, after thorough State and Federal review,
the necessary permits from the State of North Carolina. Routinely, the N.C.
Division of Environmental Management (NCDEM) is involved in the State/Federal
review process as they participate in the review process. Additionally,
besides the Coastal Area Management Act (CAMA) permit being required by NCDCM,
prior to the issuance of any Department of the Army permit, NCDEM, Water
Quality Section, would have to waive or issue a Section 401, Clean Water Act,
Water Quality Certification. The requested Department of the Army permit will
be denied if either the CAMA permit of the Section 401 Water Quality
Certification is denied.

The above subject document has been and evaluated for water quality
concerns by the Washington Regional Office. The proposed project is
for the development of approximately 874 acres of land on Chocowinity
Bay. Proposal is for 400 single family lots (0.41 acre/tot.), 172
patio homes (0.27 acre/unit), 152 day cottages (0.10 acre/cottage), 24
townhomes, convenience shopping center, 18 hole golf course, and a 302
slip marina. Proposed activity includes 600' of bulkhead on average
of 2' waterward of NWL, 8, 200' of wooden boardwalk over wetlands of
which 1,100' will be constructed over coastal wetlands, and the
construction of a spray irrigation system for wastewater treatment.
This proj ect proposes to fill 0.50 acre of hardwood swamp for the
purpose of roadway fill. This is a water dependent avoidable
proposal. Alternatives are available and should be considered.
The stormwater plans have been submitted and are acceptable and
complete per Bill Moore of this office.
On August 21, 1989, Alton Hodge, John Dorney, Raleigh Bland, and I
investigated the site for the proposed spray irrigation system. A
wetland map was submitted to this office by the Weyerhaeuser Company
for review. We, the above aforementioned persons, inspected the site
and concluded the following:
1. The areas proposed for the two (2) oxidation ponds and the
storage lagoon are hardwood swamp areas and are determined
by this office as not acceptable for the proposed activity.
On November 7, 1988, the Army Corps of Engineers
investigated the site and determined the area of the
treatment lagoons to no longer be considered a wetland
regulated by the provisions of Section 404 of the Clean Water
Act (see attached correspondence). It is the opinion of Mr.
Dorney and myself that the area is an inundated hardwood
swamp and dredging the area for the purpose of constructing
the ponds and lagoons would not be consistent with our
present guidance for the protection of wetlands.

2. The wetland areas in site 3, 4, 5, 18, 19 and 20 are also
hardwood swamp areas recently inundated. Hydrophytic
vegetation, soil characteristics (hydric soils) and
hydrologic indicators support the delineation of these areas
as wetlands. It is the opinion of this office that these
wetland areas should be avoided as part of the land
application-spray irrigation wastewater treatment system.
It is the recommendation of this office that the 401 Certification be
denied due to the proposed fill activity in the wetlands on the
residential site for the purpose of the roadway crossing. It is
further recommended that the 401 Certification be denied due to the
proposed plans for the spray irrigation wastewater treatment facility
being incomplete. There are many areas proposed by the Weyerhaeuser
Company as part of the treatment facility which are unacceptable by
this office and should be avoided. It is further recommended that
this office will reconsider this decision if the applicant proposes an
acceptable alternative to fill of the wetlands for a roadway crossing
and also if the applicant submits to this office a revised and
acceptable site plan for the spray irrigation wastewater treatment
facility.

On November 7, 1989, you met with Mr. David Gossett, North
Carolina Division of Coastal Management, and Mr. Ernest Jahnke of
my staff to determine Corps of Engineers' regulatory jurisdiction
at your proposed Chocowinity Bay real estate development adjacent
Chocowinity Bay east of Chocowinity, Beaufort County, North
Carolina.
The proposed sewage treatment lagoon is located in a drained
pond vegetated with old growth cypress, red maple, sweet gum and
bay type shrubs. The survey revealed that the soils, although
highly organic, are no longer saturated by virtue of the drainage
ditch constructed for that purpose. On this basis, it is our
determination that the site is no longer a wetland regulated by
the provisions of Section 404 of the Clean Water Act. A
Department of the Army permit is not needed to discharge fill
material in this area to prepare it for receipt of sewage
effluent.

Weyerhaeuser Real Estate Company has submitted an application for
a CAMA major permit to develop an 874-acre tract located adjacent to
Chocowinity Bay. The proposal involves the development of 572 single
family lots, 152 patio home lots, 117 Bay cottage lots, 9 townhouses,
3-acre commercial shopping area, 12-acre country club and a lagoon
spray irrigation system. The following comments will specifically
address stormwater controls for the site.
The total project will result in approximately 128-acres of
built-upon area or about 15% (128 + 874 = 15%). There are some high
density pockets and collection systems proposed within the development
that will trigger a stormwater plan in lieu of the low density option.
Engineers for Weyerhaeuser have proposed a combination of wet ponds
and natural vegetated swales (or filters) as a means of storm water
control. A large portion of the development is included in a 483-acre
watershed where stormwater will be routed to a lake. The lake would
be designed to function as a wet detention pond. There are 4 other
areas that may require stormwater control measures. These areas are:
(1) Patio homes (Section 4): This section includes 7200 SF lots with
3100 SF of built-upon area, or approximately 43% built-upon.
Additional green areas were included by the engineer to show 30%
built-upon for this section. The only proposed stormwater
measures are natural vegetated swales. When the erosion control
plan is reviewed for this section, it may be determined that
additional controls will be necessary.
(2) Townhouses: Some portion of the drainage will be routed to wet
ponds, while other portions will be discharged over land through
vegetated filters. This area represents a high density pocket
adjacent to Chocowinity Bay and may require additional stormwater
controls.
(3) Marina: A wet pond is proposed to serve this area; however, the
actual design parameters have not been formulated.

(4) Bay Cottages: This section includes 4500 SF lots with 2600 SF of
built-upon area, or approximately 58% built-upon. Additional
green areas were included by the engineer to show 30% built-upon
for this section. Stormwater control measures other than natural
vegetated filters may be required for this section.
Based on the master plan and stormwater control measures that
have been submitted, I feel that the site can be developed in a manner
consistent with the stormwater regulations with the exception of a few
areas. The stormwater control measures should be adequate to protect
water quality. Additional stormwater measures can be addressed as
each phase is submitted for erosion control approval.

Your July 21, 1989 comments on the Cypress Landing project
recommend denial of the Water Quality Certification for the
wetland fill associated with the roadway construction. A draft
denial has been forwarded to the Director's office for a final
decision on that matter. Your comments further advise that your
evaluation of the project (if the wetland fill is disallowed)
should be deferred until after ORW status has been determined by
the EMC. We have discussed this possibility of waiting under
ORW determination with Alan Klimek and Steve Tedder as well as
with DeM. DCM will not be able to stop processing of the CAMA
major application pending decisions on ORW. As matters presently
stand, the staff recommendations on ORW will go to the EMC on
September 14, 1989 for a EMC decision on whether to proceed to
hearing. The last day for DeM action on the permit currently
will be September 11, 1989. DCM needs the results of our review
for potential water quality impacts as soon as possible.
It is requested that you provide your evaluation and
recommendations for the CAMA major by August 14 if at all
possible. Your comments should address as a minimum the
anticipated water quality impacts from the marina, stormwater,
and sewage disposal. We need to know whether you anticipate
water quality violations from the marina and conditions which you
consider appropriate for the marina design or operation. We need
to know whether ~he project conforms to stormwater runoff rules
and the status o~: approval. We need to know whether an

acceptable site has been proposed for the sewage disposal system
and what the probability of permit issuance is for the sewage
disposal. These, of course, are only the main issues. Please
address other water quality issues or approval status that you
are aware of as a result of your review.

reconunendations.

Chocowinity Bay. Chocowinity Bay is an undisturbed area in the
Tar-Pamlico Basin. PERT member and DEM staff member Barry Adams has
recommended that any development in this undisturbed area should only
be considered after the State has determined if this area should be
designated as Outstanding Resource Waters (ORW). During this time the
applicant should consider recommendations from the commenting agencies
to lessen adverse environmental impacts.
It is the recommendation of this office that the 401 Certification be
denied due to the fill activity in the wetlands. It is further
recommended that this office will reconsider this decision if
acceptable alternatives are proposed by the applicant. It is
recommended that this reconsideration be held in abeyance until after
the ORW status of these waters has been established.

Environmental setting
Weyerhaeuser Real Estate Company is developing in Beaufort County a private
pennanent residential and second home ccmnunity on i. 874 acres of land on SR
1123 adjacent to the south side of Chocowinity Bay. The development will be
located along approximately 8,800' of shoreline, and will be on both sides of
SR 1123. The name of the nel.y Clevelopment will be Cypress landing.
The topography at the site consists of 20' to 30' bluffs vegetated with various
hardwCX}ds and pines which change to hardwood drains. As one moves dowllstream
on these drains the upland hardwoods first change to wooded swamp vegetated with
cypress and various species of gums which then change to navigable waters
adjacent to which are coastal wetlands (marsh). The main watersheds on the
property are Silas Creek, Rice Patch Creek, and Landing Creek. All of these
watersheds drain to Chocowinity Bay. Chocowinity Bay is a relatively shallow
bay (+ -4' to + -7' NWL) which connects to the pamlico River. The project
portion of the bay has a SC water quality classification, and is considered a
public trust waters AEC. In the headwaters of the bay several creeks are
present, the largest of which is Crawford Creek. The south side of the bay
(project side), except for one or two single family dwellings, is completely
undeveloped. On this side of the bay, the shoreline varies from hardwood bluffs
to large areas of coastal wetlands which are dominated by Spartina cynosuroides.
The northern side of the bay is also fairly undeveloped immediately adjacent
to the shoreline except near the mouth of the bay where single family cottages
occur. Most of these cottages have bulkheads and piers. The average pier
length is probably less than 100' long. Along most of the shoreline large
expanses of coastal wetlands, and wooded swamp are present. On the northern frin-
ge of these wetlands large acreages were filled prior to permit requirements to
develop home sites.
Of the i. 874 acres of land within the development, i. 789 acres are highground
and i. 85 acres are wetlands. These wetlands have been delineated by represen-
tatives of the Corps of Engineers and the Division of Coastal Management. Soils
on the property vary from sandy loam on the highground portions to mucky peat
in the wetland areas. An archaeological survey has been conducted on the
property and the only artifacts that were found were those associated with a
19th century brick production.
Wildlife on the property is diverse which is what would be expected with such
an area of various types of vegetation and topography. Chocowini ty Bay has been
historically noted as a wintering waterfowl area. Waterfowl hunting has always
been a traditional sport within the area.
Project proposal
The applicant is proposing the following:
(1) The development of 865 dwelling units on 874 acres. These will be as follows:
A. Single Family Detached
1. Single Family Lots - 400 units with an average lot size of 0.41 acres
2. Patio Homes - 172 units with an average lot size of 0.27 acres
3. Bay Cottages - 152 units with an average lot size of 0.10 acre.

B. Town Homes - 24 units on 3.7 acres. All homes will be connected to a
central sewage system which will be discussed later. Also all units
will be served by a central water system also to be discussed later.
(2) The development of a convenience shopping center on SR 1123 near the
entrance of the development. No specifics are known about the center at
this time.
(3) The development of an 18 hole golf course on + 128.4 acres of land. + 35.0
acres of lakes within the Silas Creek watershed will be excavated outside
of any wetland area to provide earthen materials for the coursp and for
stonn water retention. Various amenities will accompany the golf course
such as clubhouse, swbnming pool, tennis courts and 200 parking spaces.
The total golf course and club facilities will occupy ~ 157.4 acres of land.
(4) The development of a 302 slip marina in Chocowinity Bay. The marina will
consist of five pier systems which will be connected by either a 6' wide or
a 10' wide walkway which will be located at or near the normal water line.
Also connected to the pier system is a ~ 220' long pier with a 10' width
which will be utilized as a fuel and pumpout location. This pier will
extend approximately parallel to the NWL. At the end of this pier will be a
500 sq. ft. open sided gazebo. The marina which will be designed to accommodate
boats from a length of 25 I to a length of 40' will not be open to the public.
No slips will be leased. Slips will be sold only to individuals who own
property wi thin Cypress Landing. Water depths around the piers vary from 4.3'
at normal water to 6.2"at normal water. The applicant states that these
water depths are adequate for his needs therefore no excavation is proposed.
Amenities to the marina on adjacent land will be a 5,000 sq.ft. pavilion, and
10,000 sq. ft. of shoreside facilities which will include a dock master
building, ships store, yacht club, restaurant, offices, showers and restrooms.
Also 165 parking spaces will be available. The entire marina complex will
be located on 12.5 acres.
(5) 600 feet of bulkhead which will average no more than 2' beyond the NWL. The
bulkhead will be constructed in the vicinity of the marina complex.
(6) The construction of 8,200' of wooden boardwalks. 1,100' of these boardwalks
will be constructed through coastal wetlands which is primarily vegetated
with Spartina cynosuroides. This section of boardwalk is proposed to cross
one unnamed navigable stream. The remaining 7,100' of boardwalk will be
constructed through wooded swamp wetlands. These boardwalks will have a
6 1 width and wi 11 be constructed 4' above the vegetation contour. At ten
locations these boardwalks will extend into Chocowinity Bay. At no location
will the pier extend beyond the -4' water contour nor have aT-shaped
wate:rward end greater than 500 sq.ft. All boardwalks will be connected
on upland areas by either earthen trails or asphalt paths.
(7) The construction of a spray irrigation wastewater treatment facility. The
system will consist of two oxidation ponds, storage lagoon, chlorine contact
chamber, effluent pump, and twenty spray irrigation fields. The system will
be constructed on a 676 acre tract of land which is vegetated with pines
and which is being leased from Weyerhaeuser Company. The site will be ~ 1
mile southeast of the proposed development adjacent to SR 1125. The system
will be designed to treat 500,000 gallons of wastewater per day. Cypress
Landing is expected to generate approximately 360,000 gallons per day.

(8) The construction of a 400,000 gallon per day central water system. The
system will have two wells and an elevated tank which will have a one day
storage supply.
Environmental llnpact
As previously stated the project will result in the conversion of a i. 874 acre
tract of land adjacent to Chocowinity Bay into residential development and a
676 acre tract of land into a spray irrigation site for wastewater. The 874 acre
site has varied vegetation from upland pines, and hardwoods, to wetlands
vegetated with cypress, gums, and marsh. The 676 acre site is vegetated with pine
plantation. Due to the conversions of these properties, the existing wildlife
habitat will be dramatically changed. Several species may essentially be
removed or displaced from the systems. Also the marina and increased boat usage
within the bay will probably have an impact on wintering waterfowl.
Other environmental concerns are:
(1) OVerall potential for the degradation of water quality from the marina and
from the increase of numbers of people and residences within the watershed.
(2) The disruption of nonnal drainage patterns into the creeks from upland
dam and lake construction, and from nonnal landscaping practices.
(3) The construction of boardwalks atop i. 6,600 sq. ft. of coastal wetlands, and
i. 42,000 sq. ft. of wooded swamp.
(4) The filling of i. 18,000 sq. ft. of wooded swamp wetland for a development
road crossing.
(5) The increase in turbidity in Chocowinity Bay from the marina, bulkhead,
and observation pier construction.

The Department of Natural Resources and Conmuni ty Development hereby gives
public notice as required by N.C.G.S. 113A-119 (b) and 143-215 3(a) (1) (c) that
Weyerhaeuser Real Estate Company of New Bern, N.C.
filed an application on 28 March 1989 for a permit 'from the
Division of Coastal Management to develop in an Area of Environmental Concern
and for certification from the Division of Environmental Management that a
discharge of fill material in project wetlands will not violate applicable
water quality standards.
According to said application Weyerhaeuser proposes to develop an
874 acre tract of land on Chocowinity Bay into a residential community
(Cypress Landing) consisting of dwellings, marina, golf course, and
commercial area. The site is located in Beaufort County on the south side 0::
Chocowinity Bay.
A copy of the entire application and additional information may be ex~nined

system will have two wells and an elevated tank which will have a one day
storage supply.
Environmental impact
As previously stated the project will result in the conversion of a ~ 874 acre
tract of land adjacent to Chocowinity Bay into residential development and a
676 acre tract of land into a spray irrigation site for wastewater. 'The 874 acre
site has varied vegetation frc:m upland pines, and hardwoods, to wetlands
vegetated with cypress, gums, and marsh. 'The 676 acre site is vegetated with pine
plantation. Due to the conversions of these properties, the existing wildlife
habitat will be dramatically changed. Several species may essentially be
removed or displaced frc:m the systems. Also the marina and increased boat usage
within the bay will probably have an impact on wintering waterfowl.
Other environmental concerns are:
(1) Overall potential for the degradation of water quality from the marina and
from the increase of numbers of people and residences within the watershed.
(2) 'The disruption of normal drainage patterns into the creeks from upland
dam and lake construction, and frc:m normal landscaping practices.
(3) The construction of boardwalks atop ~ 6,600 sq.ft. of coastal wetlands, and
~ 42,000 sq. ft. of wooded swamp.
(4) 'The filling of ~ 18,000 sq. ft. of wooded swamp wetland for a development
road crossing.
(5) 'The increase in turbidity in Chocowinity Bay frc:m the marina, bulkhead,
and observation pier construction.

areas. The Corps has investiga.ted this site on November
7, 1988 and determined that the area was no longer a
404 jurisdictional wetland due to the drainage
alterations which had been constructed to these areas.
However, our field staff found these areas to be an
inundated hardwood swamp and dredging ponds or lagoons
in these areas would not be acceptable. Additionally,
the wetland areas in sites 3,4,5,18,19 and 20 are also
hardwood swamp areas recently inundated. These areas
are considered to be wetlands. These areas should be
avoided as a part of the land application - spray
irrigation wastewater treatment system. The Company
should submit a revised site plan for the wastewater
treatment and disposal facilities.
