SPECIAL ORDER BY CONSENT

Pursuant to provisions of North Carolina General Statutes 143-215.2
and 143-215.67, this Special Order by Consent is made and entered
into by the County of Currituck, hereafter referred to as the County,
and the North Carolina Environmental Management commission, an agency
of the State of North Carolina created by NCGS 143B-282, and
hereafter referred to as the commission:
1, The County and the commission hereby stipulate the following:
(a) That the County holds North Carolina Non Discharge Permit
No. 3357R3 for operation of an existing 0.15 MGD tertiary
wastewater treatment plant with onsite disposal of the treated
wastewater to serve Ocean Sands Subdivision, but sewer lines
have been constructed which will result in flows above the
permitted design capacity of the treatment plant when the
project is built out. Compliance will require preparation of
plans and specifications for and construction and operation of
additional treatment works.
(b) That the County is within the jurisdiction of the
Commission as set forth in NCGS Chapter 143, Article 21.
(c) That the County desires to construct addition sewer lines
which when constructed will result in the discharge of up to
111,200 gpd of additional domestic strength wastewater to the
treatment works, and that the discharge of such additional
wastewater to the treatment will not result in any significant
degradation in the quality of the waters of the State.
(d) That the County has secured financing for planning and
construction for treatment works which, when constructed and
operated, will be sufficient to adequately treat the present
wastewater flow as well as the proposed additional waste flow,
to the extent that the County will be able to comply with all
permit conditions.

(e) That the County hereby waives its right to an
administrative hearing authorized by G.S, 143-215.2 on the terms
of this Special Order by Consent, and also hereby waives its
rights to seek judicial review of this Special Order by Consent
as provided in NCGS 143-215.5.
2. The County, desiring to comply with conditions of the permit,
does hereby agree to do and perform all of the following:
(a) Provide the Washington Regional Office located at 1424
Carolina Ave. Washington N.C, 27889 with a list of flow added
under all Special/Judicial Orders and update this list each time
flow is added to the system.
(b) Meet and comply with all conditions of the permit that
are not specifically modified by this Order.
(c) Upon execution of this Order, undertake the following
activities in accordance with the indicated time schedule:
1) On or before January 15, 1989 submit plans and
specifications, permit applications, and supporting
information necessary to obtain a permit for a wastewater
treatment and disposal system capable of treating 300,000
gpd and disposing of up to 600,000 gpd. The construction of
this wastewater treatment system may be done in phases.
2) On or before March 15, 1989 begin construction of the
next phase of the wastewater treatment facility,
3) On or before June 1, 1989 complete construction of the
next phase of the wastewater treatment facility.
4) On or before July 1, 1989 place into operation sludge
handling and disposal facilities adequate to handle sludge
from this facility,
5) Within 30 days following any month where the monthly
average flow reaches 80% of the existing treatment and
disposal system's capacity, plans and specifications for the
next expansion shall be submitted.

6) Total organic halogen (TOX) monitoring is to be performed
every November in each of the monitoring wells, The
analytical methods used for TOX must be capable of detecting
the total of all halogenated organic compounds present at a
concentration of 5.0 parts per billion (ppb) or greater, In
the event that a TOX concentration of 5.0 ppb or greater is
detected, individual halogenated organic compounds present at
a concentration at or above its method detection limit (MOL)
must be identified and quantified utilizing EPA methods 601,
602, 604, and 611.
(d) No later than 14 calendar days after any date ~ time
identIfied for-iCcomplishment of any activity listed in ~
above, submit to the ~!vision Director and the Regional Office
written notice of compliance or noncompliance therewith. In the
~ of noncompliance, the notice shall include ~ statement of
the reason(s) for noncompliance, remedial action(s) taken, and a
statement identifying the extent to which subsequent dates or
times for accomplishment of listed activities ~ be affected,
(e) Operate and maintain the wastewater treatment plant such
that the most effective level of waste treatment is provided at
all times.
3. In accordance with the provisions of NCGS 143-215.67(b) the
Commission allows the County to accept the additional waste specified
below to its waste-disposal system,

4. This Special order by Consent and any terms, conditions and
interim effluent limitations contained herein, hereby supersede any
and all previous Special Order and Enforcement Compliance Schedule
Letters, and terms, conditions, and limitations contained therein
issued in connection with Permit No, 3357R3,
5. Any violation of terms of this Special Order EY Consent,
including paragraph ~ above shall terminate Section 1 of this
Order and any portion of the authorized additional waste not
previously connected to the system shall not thereafter be connected
until the necessary sewerage system improvements ~ been completed
and placed in operation. Noncompliartce with the terms of this
special Order ~ Consent is subject to G,S, 1~215,6. ~he---

SITE REPORT
Bissell and Associates is acting on behalf of the landowner,
Coastland Corporation to obtain permits to develop Crown Point at
Ocean Sands - Section W.
The property to be developed totals 23.2 acres and is
located on the east side of Ocean Trail (Hwy. 12) on the
Currituck Outer Banks adjacent the Atlantic Ocean. The property
is typical of barrier islands being dominated with dune
vegetation including box berry, sea oats, live oaks, persimmon,
black willow, cherry, ~. patens, and ~accarus. A frontal dune
exists along the beach edge of the property. The first line of
stable, natural vegetation was staked by DCM staff in June of
1988. The current applicable annual erosion rate is 6'; the
required small structure oceanfront setback is thus 180'.
The applicant proposes to develop a 90 lot subdivision
disturbing a total of 15 acres on the property. All lots are
proposed to be landward of the 180' setback line. Three beach
walkovers are proposed 6' wide to be elevated at least 18" over
the existing dune. Five hundred square-foot platforms and/or 200
sq. ft. gazebos are planned on top of the dune for each walkover,
Tennis courts and a swimming pool are planned on the western edge
of the subdivision.
ANTICIPATED IMPACTS
Fifteen acres of barrier island shrub-thicket habitat will
be graded and disturbed for this project.

classification in the 1985 Currituck County LUP.
