The Application provides adequate assurance that the discharge of fill material into a wetlands area adjacent to the waters of Yadkin and South Yadkin in conjunction with the settling pond in Davie County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 50 NTU's or less are not considered significant). 2. That discharges from the settling pond are consistent with the NPDES permit (NC00750l9) issued for this facility. Violations of any condition herein set forth shall result in revocation of this Certification. NRCD MAR 1 5 1989 Winston-Salem Regional Office Re: Mining Activity Permit No. 30-08 (Davie County) Dear Mr. Conrad: I am writing you about the .meeting in Salisbury between representatives of the City of SalisbUry, Mr. Thomas E. Carroll, Mr. Wallace E. Venrick, and several professional staff members of the Winston-Salem Regional Office of the North Carolina Department of Natural Resources and Community Development. It is the position of the City of Salisbury that the mining activities contained in Mining Activity Permit No. 30-08 (Davie County) could well endanger the public drinking water supply of the City. It is also the position of the city that, if the City of Salisbury had been rightfully included in the notification process, that a public hearing, in accordance with North Carolina General Statute No. 74-51, would have concluded that a "significant public interest" existed and that their permit would either have been delayed, pending further study, or denied. The fact that the permit has been issued is of small consequence considering the significant health and environmental question now raised by the city. When Mr. springer purchased his "Point Farm" in Davie county, it was conveyed to him subject to an easement for the City of Salisbury to cross his farm with pipes and draw drinking water from the Yadkin River. Also, the City of Salisbury'S pumping station is located opposite Mr. Springer's border on the South Yadkin River. Mr. Springer apparently did not inform the Commission that his proposed dredging operations were immediately upstream from a drinking water supply intake structure. Furthermore, we feel Salisbury qualifies as an adjoining land owner within the meaning of Rule .0004 relating to information required in permit applications. These omissions went undetected probably because the winston-Salem Regional Office of the NRCD does not supervise the Salisbury drinking water operations (Salisbury is under the - Mooresville Regional Office). The county and municipal officials notified were probably Mocksville and Davie County. If they were notified, they did not inform the city of Salisbury.. A permit was eventually issued without any public hearing or any findings. of fact as to whether or not the dredging activities could pose any danger to a public drinking water supply. At our meeting in Salisbury, Mr. venrick stated he would have had serious reservations about issuing a dredging permit for an area close to a public drinking water intake structure. Mr. Carroll stated that Mr. Venrick's department would have been consulted prior to issuing a permit if it was knowledgeable about the fact that the area was near a public drinking water supply intake. We feel Mr. Venrick's concerns about issuing the permit would have clearly led to a determination that "significant public interest" existed. Therefore, a public hearing would have been conducted pursuant to section 74-51. We again request that the Mining Permit be either revoked or suspended until appropriate findings of fact can be made. We appreciate Mr. Springer's "rights" to pursue legal business activities, but he should not be allowed by the State of North Carolina to embark on a venture that might endanger a public drinking water supply. When he bought his farm, he knew one of the bordering rivers was used for a drinking water supply. He should have the absolute duty to prove beyond a reasonable doubt that his proposed mining activities will not in any way pose any threat to the drinking water supply of citizens of North Carolina. As he has stated, our position is that the permit should be revoked or suspended. However, the state representative present requested more information. I am outlining our technical concerns and enclosing a copy of all correspondence. The City staff and our consultants expressed serious concerns about the impact of the dredging operation on our water supply. In addition to those concerns outlined in our previous letter, we are especially concerned about the possible impact of manganese and iron found in the sand deposits on the river bed. Taste and odor problems may be caused by the dredging operation. The presence of organic matter in the sand deposits create the potential to produce chlorinated organic compounds or trihalomethanes which are suspected carcinogens. All of these concerns translate into increased treatment costs and difficulty in maintaining water quality and meeting federal and state standards. Who will monitor the operation and guarantee compliance if our water quality concerns are proven to be unfounded? Additional concerns must be addressed concerning the operation of the site itself. The holding pond could rupture and create a discharge that would seriously impact our treatment plant. Spills of fuel or improper disposal of sewage for the operators have not been adequately addressed. The close proximity of our intake allows us no room for error and no time to compensate for a spill. .' .' D.1kes was excellent. '!he point that he nade concerning the potential for water quality problems occurring during the low flow in the Yadkin River am at the time of peak water demarrl, Le., the hot surraner months, was excellent. I concur that potential problems caused by odor, taste, Manganese, Iron, organics and turbidity are.exce€d.ingly serious, and should not be pennitted. I also believe the potential for an increase in Trihalamethanes will naturally follow an increase in organics. It appears to me the meeting concluded, the best way to keep from having these potential problems is to prevent the cause of their creation. I discussed the classification of the segment of the Yadkin River that serves as a source of raw water for the City of Salisbury with a representative of the Division of Envirornnental Managemant today. I am infonned that the Yadkin River is classified WS III from the confluence of the Ararat River and Yadkin River to an imaginary line crossing the Yadkin River connecting the mouths of SWearing creek and Crane Creek. You nay already have this infonnation. I enjoyed participating in the meeting on March 28, 1989 and will be pleased to assist the city of Salisbury in any way reasonable to get this problem solved in the best inte...-rest of the city; therefore, let me know if and when I nay be of help. Our sand pump sucks in water, sand and all other turbid material at the rate of 2,000 gallons per minute through an eight inch pipe. The base of our operations is approximately 1600 feet above the intake with a maximum operating radius of approximately 750 feet. The river is approximately 400 feet wide in this area. Salisbury's intake located very close to the bank. Their intake it is premised is say not more than ten feet by six feet - although this is only an estimate Salisbury can furnish the exact measurements. 4. '~ -", February 23, 1989 City of Salisbury, N. C. PROBLEM: Proposed sand mining operation directly above the raw water intake for the City of Salisbury's public drinking water supply. The operation of such a facility, whether intermittently or continuously, could have detrimental effects on river water quality. SOME POSSIBILITIES 1. Water quality in the river will change. 2. Changes in water quality affect its treatability. 3. Changes in water quality affect the chemical requirement for treatment. 4. Intermittent changes in water quality require more frequent laboratory monitoring to. prescribe proper chemical feed dosages. 5. Stirring water,will do little to change its quality, but stirring the river bottom benthic deposits continuously or intermittently will affect water characteristics chemically, physically, and biologically. 6. Some of the most aggravating drinking water problems have been caused by turnover in lake bottoms caused by temperature changes. (Manganese, iron, taste, odor, dissolved oxygen, etc.) 7. The normal seasonal changes in river flow will cause mining operations to produce differing effects. stirring a drought flow will result in a greater change in quality rather than stirring a flood flow. This will be occurring at the same time of maximum water use demand. 8. Should mining operations become successful as would be expected, increased activity would follow. Truck traffic, road building, lubricant and fuel oil handling, sanitary facilities, accidents spills and similar activities would increase. All of these could cause problems. .' / --- ./~~ / 9. Once this operation is started, who will monitor its growth change requirements to insure continuing protection to the Salisbury public water supply? 10. Increased laboratory monitoring, increased wear on pumping equipment caused by stirred up grit, increased chemical treatment costs caused by quality changes, increased complaint handling caused by manganese, iron, taste, and odor will be paid for by which responsible party? 11. will the Environmental Protection Agency, the N.C. State Board of Health watershed regulations, and other controlling authorities, who have an interest and responsibility in this activity, approve such operations - unless much, much, more detail about the scope of proposed operations is given. For example: What will the on site equipment do? What are pumping rates, hours of operation per day, fuel requirement? How will it be stored and dispensed? How will sand be transported? How will the sand be stored? What are the protections for the future? What system of handling fuel or other spills is proposed? 12. If a problem should develop that cannot be handled by Salisbury water treatment personnel, who can order the mining operation to cease operations? Who can issue the order to resume operations? 13. Who is the immediate controlling authority? 14. What shall be sufficient treatment interference to stop operations? suspect? Fact? will it be justifiable to stop operations of the mining operation and observe if the problem stops? If it does, is this reason enough to keep the operation shut down? 15. Removing sand, sludge, and other debris from a lake or stream is desirable because it renders structures and channels free of obstructions. This kind of mining, if controlled completely by the public water supplier so as to not interfere with optimum operation of the public water supply to obtain optimum water quality at the least cost to the water customer, is highly desirable. The proposal has not stated this as its objective. 16. Careful and seemingly endless recitation of possibilities, that may create problems in the future, is not done to negate but to properly consider all factors so that we do not blindly go into something filled with bad surprises. As responsible people, public workers dislike all bad .' -- / /' ../ / , " surprises because there is a possibility that the public may be hurt. In addition, action may be taken initially to minimize, avoid, or prevent some of the possibilities from happening. Finally, there may be instances that the cost and benefit does not justify carrying out a proposal or. plan. Careful evaluation of all possibilities can lead to the best action to take. Lee S. Unfortunately the sand pmmp is custom built so that there is no published data. However, am advised the pump will pump 2,000 gallons per minute. Your staff and the State people will be here monday and will be able to examine the plate on the pump and the engine driving it and arrive at the facts. I suggest that perhaps our difficulties are sematic Dredging is a horrid word as far as turbidity is concerned. There are drag line, endless chain bucket and clam shell dredges, amongst others. These, of course, create massive turbidity. Ours is not a dredge. It is a sand pump and sucks water and tubidity in at the rate of 2,000. gallons a minute leaving little, if any, turbidity to get past the pump. I believe that we were in agreement that the if the dredging operation was detrimental to your water supply we would take .whatever action necessary to remedy the problem. We did not resolve the question of whether or not the operation increases the turbidity of the water that would enter your intake. I think we agree that this is the factual question that must be decided. I do not believe we arrived at a method of resolving this question. There are various options one of which is to actually operate the dredge for your observers for them to decide for themselves if as your Staff suggests turbidity is increased or as we contend turbidity is in fact decreased. However, we are open to whatever suggestions you may have. Some facts we did not present fully yesterday you might consider: 1. The dredge sucks up water and sand through an eight inch pipe at the rate of 2,000 gallons per minute. We believe the suction is so great that all water within a considerable radius is sucked in and none which might contain turbidity escapes downstream. 2. Our operation is some 1600 feet upstream from your intake. The river is some 400 feet wide at the intake and, of course, all water flowing in the river does not go through or around the intake which is I estimate only twelve feet wide. The sand dredging operation approved by said permit is scheduled to be operated immediately upstream from the City of Salisbury drinking water intake structure on the Yadkin River. The only way the City of Salisbury became aware of this situation was that its employees noticed an apparent dredging operation was being established immediately upstream from the water intake structure on the Yadkin River. We started investigating this matter and have now been furnished a copy of Permit No. 30-08. The City received no notification that an application for such a permit was under consideration. Our attorneys have informed us that North Carolina General Statute Section 74-51 allows an appli- cation for a permit to be denied if the proposed mining activity would have certain enumerated adverse effects. The statute section also provides that if significant public interest exists, the Department shall conduct a public hearing on the application for a new mining permit. While the determination of whether or not a significant public interest exists is up to the Department, I cannot imagine many things more significant to the public interest than the protection of a water supply to more than 30,000 residents in an adjoining county. We feel your office must not have been furnished with all the necessary facts in this matter. We believe Permit No. 30-08 was granted prematurely in that it was granted without the benefit of a public hearing. We have been informed that a dredging operation at the proposed location would have adverse effects on a public drinking water supply as follows: jJ. The more stringent finished water turbidity requirements recently proposed by the Federal Government may not be able to be met. (2) Introduction of bottom sediments and silt not pre- viously a problem would cause increased levels of iron and manganese in both the river water and the finished treated water from the water treatment plant. (3) The increased turbidity and silt would require increased levels of pre-disinfectant (chlorine) due to the lowered effectiveness of chlorization for disinfection of turbid water. (4) Increased levels of sand and silt in the raw water supply would increase abrasion wear of raw \vater pumps and piping. (5) Increased raw water turbidity \vou1d significantly increase water treatment costs due to the costs of additional coagulant, disinfectant; and the activated carbon dosages necessary to produce a potable product. Additionally, increased silt and turbidity would adversely affect routine physical operations of reservoirs, water treatment plant, and residuals management units due to the increased amounts of sludge resulting from increased chemical dosages. At the public hearing, all interested parties will be able to furnish your Department with the information necessary to make an informed decision on whether or not the suspension should be lifted or the Permit revoked. The other matter involves NPDES Permit No. NC0075019 issued to the Point Sand Company on January 3, 1989, which requires the permittee to obtain an Authorization to Construct from the Division prior to construction of the treatment facilities, i.e. the settling pond. The Company failed to follow the correct procedure which was to apply for the 401 and the Authorization to Construct prior to constructing the settling pond. Our Water Quality staff members reviewed the application and inspected the site on May 26 to determine whether the fill in wetlands should be issued a Water Quality Certification. Our conclusion was that the wetlands lost by creation of the darn and wetlands affected by inundation by the settling pond do not represent a water quality problem. Therefore, we issued a Water Quality Certification on ~lay 30, 1989, for the wetland fill. The Corps of Engineers vlill hopefully make a decision on the after-the-fact permit at an early date. We do not agree with this opinion and have required permits on all similar operations in the state. Once the plans and specifications have been submitted with the required signature and seal of a Registered Engineer, we will expeditiously review the plans to determine their adequacy. The other matter involves NPDES Permit No. NC0075019 issued to the Point Sand Company on January 3, 1989, which requires the permittee to obtain an Authorization to Construct from the Division prior to construction of the treatment facilities, i.e. the settling pond. At the present time, the Point Sand Company has not yet received a Section 404 permit from the Army Corps or Engineers. " Mr. David Springer June 5, 1989 Page Two The DEM Certification and the Corps' permit are processed jointly through public notice issued by the Corps on March 30, 1989 (a copy attached). The Corps' permit is required for this project only bec~use the dam for the settling pon~ was built in a wetland area. The discharge from the settling pond to the river is regulated under the NPDES program. This discharge is regulated differently from discharges of effluent from diked settling basins from hydraulic dredging projects such as those common in coastal areas. It is the nature of the act, sand mining versus hydraulic dredging, that ,determines which permit jurisdictions apply to the discharge to the river. The effluent from the disposal of dredged material is specifically regulated under Section 404 of the Clean Water. Act (Corps of Engineer's permits for dredge and fill materials) whereas the discharge from a sand mining activity is regulated under Section 402 (33 USCA 1342) of the Clean Water Act (NPDES permits for discharge). The 404 implementing regulations in 33 CFR 323.2(d) states that "Discharges of pollutants into waters of the United States resulting from the onshore subsequent processing of dredged material that is extracted for any commercial use (other than fill) are not included within this term (discharge of dredged material) and are subject to Section 402 of the Clean Water Act even though the extraction or deposit of such material may rcquil-e a permit from the Corps of Engineers." Our Water Quality staff members inspected the site on May 26 to determine whether the fill. in wetlands should be issued a Water Quality Certification. Our conclusion was that the wetlands lost by creation of the dam and wetlands affected by inundation by the settling pond do not represent a problem either for specific water quality standards nor result in the loss of existing uses as protected by the Antidegradation Policy. Therefore, we issued a Water Quality Certification on May 30, 1989, for the wetland fill. The Corps of Engineers will hopefully make a decision on the after-the-fact permit at an early date. Wastewater discharges from sand mining activities are regulated under the NPDES permit process (Section 402 of the Clean Water Act). The U.S. EPA has established effluent guidelines for discharges from sand mining which specifically apply to the type of activity which the Point Sand Company is conducting. (See Title 40, code of Federal Regulations [CFR] 436.30.). The Company was issued NPDES Permit No. NC0075019 in accordance with the federal regulations and state law at G.S. 143-215.1. The EPA effluent guidelines at 40 CFR 436.32 along with the N.C. Water Quality Standards are used in establishing effluent limitations and requirements for the NPDES permit to discharge. The term "Pollutant" as defined in 40 CFR 122.2 does include dredged spoil, rock, sand, as well as municipal, '" - Mr. David Springer June 5, 1989. Page Three industrial and agricultural waste and other types of pollutants. While North Carolina's NPDES program must satisfy Federal Law and Regulations, the program must be implemented on the basis of State Law and state Administrative Code. These State requirements may be more stringent than or require additional measures to be taken beyond the Federal Law. Specifically, G.S. 143-215.1(a)(2) requires a permit to "construct. or operate any sewer system, treatment works, or disposal system within the State." The term "treatment works" is defined in G.S. 143-213 (17) as any plant, septic tank disposal field, lagoon, .... or other works not specifically mentioned herein, installed for the purpose of treating, equalizing, neutralizing, stabilizing, or disposing of waste. The term "waste", G.S. 143-213 (18) means 'industrial waste' among others which means "any liquid, solid, gaseous, or other waste substance, or combination thereof resulting from any process of industry, ... or from the development of any natural resource." Therefore, the wastewater from the mining of the sand (a natural resource) is an industrial waste and. the settling pond, to remove clays, silts, sand too fine to be removed in the sand removal stage, organics and other substances present in the material pumped from the river bottom, is clearly a treatment works. Under Title 15, North Carolina Administrative Code (NCAC) 2H .0318 and NPDES Permit No. NC0075019, submission of final plans and specifications signed and sealed by a Registered Engineer and approval of these plans (Authorization to Construct) are required prior to constructing the facilities. Although these initial steps were followed for the permit issued to The Point Sand Company (January 3, 1989), as stated above, the required prior approvals were not obtained. At a recent site visit to this facility, this was documented and a letter was sent from our Regional Supervisor, Mr. Larry Coble, advising that the construction was in violation of the terms of the permit and outlining the actions' required to resolve the violation. A copy of Mr. Coble's April 7, 1989 letter is attached. The plans for the settling pond which were received May 1, 1989, have not been signed and sealed by a Registered Engineer and thus are not approvable as submitted. You contend that the water from the sand mining activity is not a wastewater and that the settling pond is not a wastewater treatment facility. We do not agree with this opinion and have required permits on all similar operations in the State. The mining activity proposed will hydraulically remove deposits (sand, silts, clays, organic material and other deposits) from the river bottom. The sand will be mostly removed from the water and other materials. The remaining materials which have now been resuspended in water will ... The settling pond must be properly designed to remove most of the clay and silt so that the discharge will not violate the NPDES permit requirements for turbidity and suspended solids. "rhe Company should submit a properly signed and sealed set of plans and specification for these treatment facilities for our review and approval. In summary, the Water Quality Certification which must be obtained before the Corps of Engineers may issue the permit for the wetland fill has new been issued. The Authorization to Construct required by the NPDES permit cannot be issued until satisfactory plans and specifications for the settling pond have been submitted, reviewed, and approved. Without such an Authorization to Construct, the Company remains in violation of the conditions of the NPDES permit. Once the plans and specifications have been submitted with the required signature and seal of a Registered Engineer, we will expeditiously review the plans to determine their adequacy. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. ~ -3- Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (OEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The purpose of the site visit was to determine if a COE 404 permit should be issued after-the-fact since the applicant had placed fill materials in wetlands on the point adjacent to the confluence of the Yadkin and South Yadkin Rivers. Impounded waters will impact approximately 1.66 acres of previously intermittent wetlands (contains standing water only after rains and river floods) primarily vegetated with button bush, rushes, sedges and a few black willow trees. These wetlands were cleared for pasture a number of years ago. Impacts to fish and wildlife resources from this proj ect can be minimized by implementing mitigation measures. The creation of a permanent 1.66 acre wetland? with a maximum depth of 3 1/2 feet could actually improve waterfowl habitat in this area. The applicant plans to maintain the 1.66 acre impoundment as a refuge for geese and ducks. Mi tigation measures should include planting waterfowl food plots in and around the impoundment and erec~ing several wood duck nest boxes on the pond. We have no objection to the approval of an after-the- paqe 2 , fact 404 permit to the applicant as long as the a . The proposed area to be mined for sand is owned by Yadkin, Inc. in fee simple ownership and is part of FERC Project #2197. Yadkin, Inc. has not negotiated nor does it plan any lease arrangement with The Point Sand Company and will not seek FERC approval for this project. Yadkin, Inc. received FERC authorization to execute a lease with statesville Concrete Company to mine sand from High Rock Reservoir's North Yadkin River section in July of 1988. This site is down stream and adjacent to the area being reviewed by your office. Yadkin, Inc. is concerned about the total combined impact caused by two mining operations within such close proximity of one another on water quality, fish, wildlife habitat, and recreation. Yadkin, Inc. is concerned that the additional turbidity in the reservoir's water caused by another operation may result in an unacceptable condition for fisheries and downstream drinking water intakes -- specifically the city of Salisbury and N.C. Finishing Company. Yadkin, Inc. owns a 25-foot flood easement which becomes inundated during flooding over the area planned for a settling pond and sand storage by The Point Sand Company. Obviously, any material in that area at the time of flooding will immediately wash into Yadkin's reservoir. Since the City of Salisbury's water intake and pump station are immediately downstream of this area, Yadkin, Inc. is concerned about the washing of materials into and covering their facilities. Additionally, any onsite spills of fuels, oils and other chemicals used by the operator during mining operations would assuredly adversely affect the city's water supply. Some destruction of a wetlands area has already taken place and that destruction will undoubtedly be expanded if mining operations are permitted. A memorandum of the conveyances in the Springer chain of title is attached. The following observations about the conveyances are noted as follows: 1. The Springer tract is a part of a greater tract formerly owned by Carolina Aluminum Company (now Yadkin, Inc.). The greater tract included the entire bed of the Yadkin and the South Yadkin rivers. 2. In 1947, Carolina Aluminum Company conveyed all of the greater tract to Springer's predecessors in title excepting that portion thereof lying at and below the contour at elevation 655 feet Carolina Aluminum Company datum. The retained portion of the land included the beds of the two rivers and is a part of High Rock Reservoir. 3. Springer acquired an interest in the land in 1966. (Memorandum, paragraph 14). Thereafter, several maps of the tract were placed on the public records by Springer which apparently encroached upon the boundary of the portion of the greater tract retained by Carolina Aluminum Company, (Memorandum, paragraph 15). 4. In 1973, Springer placed a deed on record in which he purportedly conveyed an interest in the bed of the river. (Memorandum, paragraphs 16 and 17). Apparently he bases his claim to mine the river upon this deed. The activity of Mr. Springer .adversely affects the title of Yadkin, Inc. to a portion of High Rock Reservoir lying adjacent to Mr. SpLinger's tracL. This public notice does not imply, on the parts of the Corps of Engineers or other agencies, either favorable or unfavorable opinion of the work performed; but it is issued to solicit comments on the factors listed above on which a final decision will be based. The following description of the work is taken from data provided by the applicant and from observations made during onsite visits by representatives of the Corps of Engineers. Plans submitted with the application show construction of an earthen dam within wetlands to create a settling pond in conjunction with sand mining activity on Mr. Springer's property. Overflow from the settling pond flows via pipe into the South Fork Yadkin River. Approximately 6,600 square feet of wetlands have been filled to construct the dam. Impounded waters will impact approximately 1.66 acres of wetlands primarily vegetated with black willow, button bush, rushes and sedges. These wetlands were cleared for pasture a number of years ago. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant ,to obtain any required State authorization. No Department of the Army permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a Department of the Army permit be issued until the North Carolina Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for ~nclusion therein. Past archaeological studies of the property indicate that this work site may be eligible for inclusion, in the Register, and further investigations may be necessary. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Rising from a spring at Blowing Rock in the Blue Ridge Mountains of North Carolina, the Yadkin River flows for 100 miles in a northeasterly direction to a point near Winston-Salem. From this point it turns to the southeast and emp- ties into the Atlantic Ocean through Winyah Bay near Georgetown, South Carolina. The Yadkin's basin extends In a northwest-southwest direction across the central and Piedmont re- gions of North Carolina. The portion of the river below the Uwharrie River is known as the Pee Dee. The four impoundments shown here produce electricity for the Badin Works of Aluminum Company of America. The power is used to produce aluminum from refined bauxite [alumina] through an electrolytic process. The dams and reservoirs are owned by Yadkin, Inc., a wholly-owned subsidiary of Alcoa. Rising from a spring at Blowing Rock in the Blue Ridge Mountains of North Carolina, the Yadkin River flows for 100 miles in a northeasterly direction to a point near Winston-Salem. From this point it turns to the southeast and emp- ties into the Atlantic Ocean through Winyah Bay near Georgetown, South Carolina. The Yadkin's basin extends In a northwest-southwest direction across the central and Piedmont re- gions of North Carolina. The portion of the river below the Uwharrie River is known as the Pee Dee. The four impoundments shown here produce electricity for the Badin Works of Aluminum Company of America. The power is used to produce aluminum from refined bauxite [alumina] through an electrolytic process. The dams and reservoirs are owned by Yadkin, Inc., a wholly-owned subsidiary of Alcoa.
