Onslow County The Subject application has been reviewed for water quality impacts and the following comments are offered: a) The proposed project does require a 401 Water Quality Certification but meets the requirements of General Certification No. 1272 for bulkhead construction. b) Based upon information from Bob Benton of Shellfish Sanitation, DHS, the proposed marina expansion will result in the automatic closure of currently open shellfish waters for a distance of 250 feet in all directions from all structures and pilings in the proposed new basin. The area affected by this closure does have an existing shellfishing use. The automatic closure of these areas will result in the loss of an existing use. Such a loss of ,use is considered to violation the Antidegradation Policy of the EMC's Water Quality Standards. Po. The loss of this vegetation and the habitat it provides is considered to be detrimental to water quality. d) Because of the problems described above it is recommended that the permit for the expansion be denied. We have no objection to the maintenance dredging of the existing marina. Onslow County PROJECT DESCRIPTION: The applicant is proposing to dredge and expand an existing marina by creating 149 additional wet slips, and construction of a travel lift. It is recommended that the project be denied based on the fact that there will be an automatic closure of productive shellfish areas, extending out 250' in all directions from all structures and pilings within the proposed new basin, according to Bob Benton of shellfish Sanitation. The project, as proposed, will also result in the loss of approximately 166,265 sq. ft. of sea grass/sea grass habitat area due to the proposed dredging of the new basin. The loss of this habitat and the essential functions it provides is viewed by this office as degradation of water quality. PROJECT SUMMARY: The applicant is proposing to dredge and expand an existing marina facility known as Swan Point Marina. PAGE #2 FIELD INVESTIGATION REPORT - TRIANGLE SALES OF RALEIGH, INC./SWAN POINT MARINA, ONSLOW COUNTY 9. NARRATIVE DESCRIPTION: The applicant's property consists of an approximately 5 acre tract of land located off, and near the end of, NCSR 1523 and adjacent to the AIWW, between New River and Chadwick Bay, near the community of Sneads Ferry, in Onslow County. The majority of this property has been developed into a commercial marina, known as 'Swan Point Marina', and has an associated upland repair facility. A good portion of the marina basin was excavated years ago into upland areas. On the north side of the marina basin, a bulkheaded peninsula of land approximately 350' long x 25' wide protects the basin area from adjacent open water areas. Portions of this marina facility were authorized by State Permit #589. The existing marina consists of approximately 40 wet-slips and has fueling facilities to service transient boats traveling the AIWW. Upland development includes a ships store, an approximately 80' x 70' building where mostly marine engine repair work is done, and gravel, concrete and packed sand parking areas. A dragline boom and cradle system allows for the 'dry storage' for smaller vessels on upland parking areas while undergoing repairs. Restroom and shower facilities are also provided to patrons of this marina, but a pumpout facility is not available. The applicant is requesting a permit which would allow a major expansion of this marina facility, as well as the maintenance dredging of the existing basin. Plans included with the application show that the marina facility is proposed to be expanded in an area of shallow, open water immediately north of the bulkheaded peninsula of land. This proposed expansion will be approximately 515' in length x 325' in width x -6' MLW deep and will contain a number of floating dock systems to accommodate docking facilities for 149 additional boats. Also included within the proposed basin area is a travel lift. It will be supported by two (2) tracks, each approximately 5' wide x up to 80' long. An approximately 170' long x 5' wide work pier is also proposed to be located south of the travel lift. The existing bulkhead on the north side of the peninsula is proposed to be replaced. The new bulkhead would be approximately 3' waterward of the existing structure and would be approximately 370' in length. For the most part, the area to be dredged can be characterized as being located at the mouth of a small creek. This shallow water area has an extensive cover of sea grass vegetation with water depths ranging from approximately l' to -3' MLW deep. Division of Marine Fisheries have also shown that there are significant resources of clams and to a lesser degree, oysters in the proposed dredged area. Because of the Division of Health Services policy to recommend closures of shellfishing areas around marinas, there is presently a 100' wide prohibited zone around Swan Point Marina. There is also some existing navigational use within this area. Traversing through this shallow water is a small channel approximately 8' wide x -3' MLW deep which provides boating access to property owners upstream of the marina. The applicant is also proposing to maintenance d~edge the existing marina basin which is approximately 320' long x 170' wide to a depth of -6' MLW. A 'T' section at the end of an existing pier, and adjacent to the AIWW, is also proposed to be enlarged by the construction of an 8' wide x 110' long addition. A pumpout station is also proposed to be placed on the dock system. All excavation is proposed to be accomplished by the use of a hydraulic dredge. The applicant has estimated that approximately 24,000 cu. yds. of primarily sand material will be excavated and pumped to Grant Island. At this time, a site inspection of Grant Island has not been made, but a review of aerial photography (Photo Index 84:26-267, B-23) shows that the island has historically been used for spoil disposal and is now stabilized with vegetation. An onsite inspection will, however, be forthcoming to determine its suitability. The island is approximately 40+ acres in size. 10. ANTICIPATED IMPACTS: The project, as proposed, will result in the excavation of approximately 166,265 sq. ft. of sea grass/sea grass habitat area and a like amount of shallow water habitat bottom. The values of sea grass and shallow water habitat areas have been well documented in the scientific literature. Sea grass beds provide such things as food, habitat and water quality functions that are important in sustaining fishery resources. Shallow water habitat areas provide habitat for a number of invertebrates that are components of the food chain, as well as, the staging area for juvenile finfish to gather and be protected from larger predators. This project will also cause the excavation of a substantial clam resource and clam habitat area. There will also be additional closures of open shellfishing areas from the operation of the approximately 189 wetslip marina facility as required by the Division of FIELD INVESTIGATION REPORT - TRIANGLE SALES OF RALEIGH, INC./SWAN POINT MARINA, ONSLOW COUNTY PAGE #4 Health Services Marina Policy. A traditional boating access channel will also be eliminated by the construction of docks. The maintenance of excavation of the existing basin will result in the deepening of approximately 54,400 sq. ft. of previously excavated bottom areas. This area is presently closed to the harvesting of shellfish and no information is available as to any shellfish resources that may be located within this existing basin area. The proposed replacement bulkhead will result in the filling in of approximately 1,110 sq. ft. of shallow water habitat bottom.
