Bolick N.C, Dept. of Transportation P,O, Box 1460 Boone, NC 28607 Dear Mr, Bolick: You have our approval, in accordance with the attached conditions and those listed below, to excavate in 0.10 acres of wetlands or waters for the purpose of paving SR 1403 at Boone, as you described in your application dated 30 May 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires tmless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below, If you change your project, you must notify us and you may be reqwred to send us a new application, If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds (T 15A:04B ,0024). If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing, You must act within 60 days of the date that you receive this letter, To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N,C, 27611-7447, This certification and its conditions are fmal and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Dept. of Transportation P.O, Box 1460 Boone, NC 28607 Dear Mr, Bolick: On 30 May 1997, you applied to the N,C, Division of Water Quality (DWQ) for a 401 Water Quality Certification to impact 0.10 acres of wetlands and/or culvert placement/channel changes in streams in order to pave SR 1403 in Watauga County. Your project has been forwarded to Mr, Ron Linville (910) 771-4600 in the DWQ Winston-Salem Regional Office for review, This review wil1likely require an on-site inspection prior to the approval, modification or denial of the proposed work. If you send additional infonnation to the U.S. Anny Corps of Engineers concerning this project, please be certain that our staff have copies of this material so we can use it in our process in making a decision. According to our preliminary, in-house review since you propose to disturb greater than 150 linear feet of streams, it is likely that compensatory wetland and/or stream mitigation will be required by DWQ for this project as described in 15A NCAC 2H,0506(h). Also, we cannot tell if a wetland detennination was made, We cannot detennine the precise linear distance of perennial stream impacts and/or the wetland fill areas for mitigation purposes. You should prepare a table listing all channel changes and new culvert structures or culvert extensions, with the linear distance of stream channel impacts shown, The wetland mitigation ratio if necessary will be detennined by the distance of impact areas from blue-line streams, as shown on USGS topo maps, We recommend that you forward a copy of the appropriate topo map with wetland fill areas shown, accompanied by a table listing all wetlands, the area of fill required, and distances from blue-line streams. Until this infonnation is provided, this application is considered to be incomplete and our processing time will not start, NCDOT is reminded that in accordance with 15A NCAC 2H.0506(h)(6), a minimum of 1: 1 in-kind restoration or creation of wetlands is required for wetland mitigation, In order to ensure no net loss of wetlands, enhancement and/or preservation can only be accepted as part of a mitigation package, not as a substitute for restoration. We recommend that you not impact any wetlands or waters on your project site until a 401 Water Quality Certification has been issued from Raleigh. The issuance of a Corps of Engineers 404 Pennit does not mean that you can proceed with construction. According to the Clean Water Act, the 404 Pennit is not valid until a 401 Certification is also issued. This prQject has been extended and will now require a 404 Nationwide Permit. This project will require replacing an 18" C.M.P. with a 24" C.M.P. and performing a proposed channel change, in a wetland area, from Sta. 27+00 Rt. to Sta. 29+50 Rt. which carry unnamed tributaries to Meat Camp Creek. Meat Camp Creek has the DEM classification, C Tr. Due to the proposed work, we are requesting a 404 Nationwide Permit. I am sending a joint application form, typical roadway section, straight line sketch with the proposed erosion control, notes on pipe installation, general notes on erosion control, cross sections of proposed encroachments in the trout water buff~r zone, and a marked county map. Where slope protection treatment is required, Section 868 and Section 1042 of the 1995 Standard Specifications for Roads and Structures will be followed. Any material obtained from the project must be clean before being placed. Generally, the order of installation of the erosion control measures will be as follows: Temporary Silt Basins shall be installed before clearing and grubbing begins. Silt Fences and Temporary Silt Ditches shall be installed after clearing and before grading. Temporary Stone Ditch Checks shall be installed as soon as ditchline is established, Pipe Outlet and Inlet Protection will be done as soon as the pipe is installed. Seeding and other permanent erosion control measures are to be implemented as soon as practical. .,. Pipe Installation 1. Install erosion control devices. In streams, where necessary, rock silt screens will be used and installed prior to pipe replacement or any work being done to channel. 2. Remove material and existing pipe while limiting, as much as possible, material and sediment from entering a stream and/or escaping from project. 3. Prepare pipe foundation while again taking care to limit, as much as possible, material and sediment from entering a stream and/or escaping from project. Where possible, new grade will be below existing stream bed. If needed, bedding material will be clean stone. 4. Place the new pipe and compact backfill. 5. Install slope protection on outlet and inlet ends of pipe. Also, complete installation of erosion control measures and perform maintenance as needed on existing measures. 6., Establish permanent vegetation as soon as possible. 7, Remove rock silt screens as soon as possible after vegetation is established.
