I am writing on behalf of our client, Mr. Nasir Ahmad, in response to your le la y 17, 1999.
Mr. Ahmad's property comprises 5.71 acres, and was originally part of 10-acre tract that he owned, prior
to the sale of 4.3 acres in March of 1997. The property that was sold was used for construction of the
relocation of Concord Mills Boulevard (formerly Speedway Boulevard). The remaining tract of land has
very limited developable area.
Mr. Ahmad engaged the services of both our firm and an environmental consultant, to review and assess
the development feasibility for this site. A number of options were considered, although, due to the
number of physical constraints, development of the site is extremely difficult.
As is indicated in the attached documentation, runoff from the Concord Mills site is piped across the
boulevard onto the Ahmad property. We have been concerned with the extent of accumulated sediment
observed and the potential impact to the property, entirely from off-site sources. As you are aware,
development in the Kings Grant area has been enormous. Mr. Ahmad's acreage represents only a tiny
portion and is dwarfed by the surrounding players.
Further restrictions placed on this property would seem to unfairly penalize a landowner who, to date, has
initiated no land-disturbing activity, but whose property is nonetheless impacted by development of a much
larger magnitude than that which is proposed on this site. Furthermore, the General Permit Verification
received from the U.S. Army Corps of Engineers specifically calls for the remaining 1.38 acres of
wetlands to "... be preserved through placement into a conservation easement." Mr.Ahmad is not opposed
to those terms and conditions proposed.
For these reasons therefore, I respectfully request your consideration of the particular circumstances of
this site. I have enclosed for your reference, a summary, along with related documentation, to best
characterize the existing conditions and limitations of this property. It is my hope that this information will
help to address your specific areas of concern.

dated January 7, 1999)
1. Site Information
The subject property is located at Kings Grant, along the north side of Concord Mills Boulevard (formerly
Speedway Boulevard), approximately 0.5 miles west of the I-85 interchange. It is an approximately
triangular-shaped parcel, with a total area of 5.71 acres. The property has a total roadway frontage of
approximately 1,000 feet and is situated opposite the easternmost entrance into the Concord Mills site.
The (relocated) Concord Mills Boulevard is a 5-lane section with an opening in the concrete median at the
property.
2. Background
The Owner requested assistance in determining the development potential of the 5.71-acre tract of land,
with the intent to provide three (3) sites approximately one acre each. The anticipated development use
would be for fast-food restaurants or similar establishments.
Other required development criteria considered include:
' Compliance with City/County zoning
' Regulatory compliance with respect to stormwater management and wetland protection
' Desire to minimise wetland impacts
' Access to property at the existing median opening, opposite the existing entrance to Concord
Mills site
' Driveway turnout/entrance geometries and vertical alignment in accordance with NCDOT
standards

' Desire by Owner to raise grade of proposed building sites as close to the elevation of road
(Concord Mills Boulevard) as possible, for best visibility
Based on these general considerations, the Owner engaged the services of Environmental Services, Inc.
(ESI) for review of the wetlands on the site and identification of permitting requirements. The Owner
retained DPR Associates, Inc. to use those initial findings in preparing a schematic development plan for
the site.
3. Scope of Study
The study represents the summary of findings and conclusions based on the following:
? Overall description of physical features of property
? Chronology of the property and surrounding development
? Initial intent of Owner and purpose of study.
? Field review of site conditions.
? Review of Concord Mills Boulevard roadway plans for coordination of site.
? Review of permitting requirements and procedures.
? Wetlands delineation review and recommendations.
? Review of siteaccess options.
? Preparation of schematic design alternatives for development of site.
? Recommendation/selection of preferred schematic alternate.
? Preparation of site development plans for submittal to U.S. Army Corps of Engineers
and the Division of Water Quality as required for Pre-Construction Notification (PCN)
for sites with wetland impacts less than one acre.
? Review/assessment of design concept and determination of available developable land.
? Preparation of estimated construction quantities and costs for development of property.
? Summary/documentation of findings and conclusions.

5. Development Overview
The following is a general outline of site conditions affecting the development potential for the subject
property:
? Of the 10.01-acre tract of land originally owned by Mr. Ahmad, 4.3 acres ofi(evelopable
property were sold inMarch, 1997. This land was subsequently used in the relocation of
Speedway Boulevard.
? The 5.71-acre tract remaining from that sale lies predominantly within a delineated wetland
area. Based on the original wetlands plats prepared by FC&A Consulting Engineers, dated
September 25, 1995, there are approximately 2.4 acres of wetlands on the site. The wetlands
on the site are two effectively non-contiguous areas.
? In addition to the wetlands, there are some 50 linear feet of regulated stream channel and
approximately 400 linear feet of non-regulated stream channel. The proposed development
of the site would be limited to that which can be accomplished, maintaining wetland impacts
to less than one acre.
? The property lies some 30 feet below the elevation of the road (Concord Mills Boulevard),
indicated by the existing slope easement. A median opening is provided within the property
frontage. However, no actual entrance (or embankment) onto the property was constructed
as part of the road relocation. Construction of the entrance alone will require a large quantity
of costly off-site fill material.

? The property is encumbered by a total of three (3) permanent drainage easements, two of
which were established as part of the roadway relocation. These easements total some 0.3
acres for the 72, 48 and 24-inch culverts, respectively, that each cuirentl}discharge onto this
property. These pipes and easements must be dealt with as part of development of the site
(ie- rerouting of pipe, grading limitations on buildable land area, and wetland impacts).
? An existing 60-foot access easement parallels the sewer easement along the eastern portion
of the property.
? An existing 30-foot sanitary sewer easement lies along the east property line.
? Observed accumulation of sediment from constriction across Speedway Boulevard.
? Undercut excavation and replacement with off-site fill material.

This is in response to the most recent letterfrom NCDENR to Mr. Ahmad dated July 25, 1999 (a copy of which is
attached for reference). That letter indicated approval of the 401 Water Quality Certification with additional conditions
attached. Of the conditions prescribed, Item 3, states "The wetland site to the rear of the property (0.71 acres) shall
not be filled but instead shall have stormwater directed into it, for treatment. "
We have been investigating possible modifications to the site plan previously submitted. Mr. Ahmad has recently been
approached by the adjacent property owner, Landex, about construction of a new road connecting to Concord Mills
Boulevard (at the currently shown location). The facility would be NCDOT-maintained--extending through the Ahmad
property, rather than as essentially a driveway entrance serving the single tract as shown on the earlier site plan. This
new roadway would align with the existing Concord Mills entrance and, with the signalized median opening, would
provide full access to properties behind the Ahmad site.
A part of the concept is some exchange of land, so as to provide a developable parcel on the west side of the proposed
entrance road. This is due to the anticipated offset (from Concord Mills Boulevard to intersection) that NCDOT will
likely require.
Therefore, in accordance with your request, this is to notify you of the Owner's intent to change the project. Enclosed
for your reference is a site plan showing the proposed development concept for the site Please review this ' ormation

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Ahmad:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.28 acres
of wetlands acres of wetlands and 295 feet of streams for the purpose of constructing a commercial development at Speedway
Blvd. near I-85, described in your application dated 12 March, 1999 and 18 June 1999. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use
Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater,
Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CA?MA
permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas
within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact.
These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is
later).
2. An additional condition is that a final, written stormwater plan including a wet detention basin or dry basin which discharges via
sheetflow into the remaining wetlands must be approved by DWQ before wetland (or stream) impacts occur. Also, before any
building is occupied at the subject site the approved storm water treatment facilities shall be constructed and operational and the
approved stormwater management plan shall be implemented.
3. The wetland site to the rear of the property (0.71 acres) shall not be filled but instead shall have stormwater directed into it for
treatment.

Dear Mr. Ahmad:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.28 acres
of wetlands acres of wetlands and 295 feet of streams for the purpose of constructing a commercial development at Speedway
Blvd. near I-85, described in your application dated 12 March, 1999 and 18 June 1999. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use
Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater,
Non-Discharge and Water Supply Water shed regulations. This-approval will expire when the accompanying 404 or CAMA
permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas
within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact.
These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is
later).
2. An additional condition is that a final, written stormwater plan including a wet detention basin or dry basin which discharges via
sheetflow into the remaining wetlands must be approved by DWQ before wetland (or stream) impacts occur. Also, before any
building is occupied at the subject site the approved storm water treatment facilities shall be constructed and operational and the
approved stormwater management plan shall be implemented.
3. The wetland site to the rear of the property (0.71 acres) shall not be filled but instead shall have storrwater directed into it for
treatment.

The a lien cant proposes to impact 0.99 acres of wetlands and 450 feet of channel however,
all but 50 feet of the channel is non-jurisdictional. The site will require the installation of a significant
amount of fill inorder to access the adiacent public right-of-way (Sony Boulevard). The site also
receives a significant amount of stormwater from off-site sources (Concord Mills Mall site), which has
contributed a heavy amount of sediment loading to the channels that transect this property. In
reviewing the jurisdictional stream channels, aquatic activity (fish or were not found,
therefore, mitigation should not be required. Wetland mitigation is not required since the impacts are
less than one acre (Wetland Score - 37,). The applicant's engjpeer, Mr. Richard Modelin, has also
identified many other site development constraints that he noted in Section No. 4 of his written
comments dated June 2, 1999. From the numerous constraints identified by Mr. Modelin, this site
does not appear to be well suited for development,

I am writing on behalf of our client, Mr. Nasir Alimad, in response to your letter dated May 17, 1999.
Mr. Alttnad's property comprises 5.71 acres, and was originally part of 10-acre tract that lie owned, prior
to tic sale of 4.3 acres in March of 1997. The property that was sold was used for constnlction of the
relocation of Concord Mills Boulevard (formerly Speedway Boulevard). The remaining tract of land has
very limited developable area.
Mr. Ahmad engaged the services of both our firm and an environmental consultant, to review and assess
lie development feasibility for this site. A number of options were considered, although, due to tic
number of physical constraints, development of the site is extremely difficult.
As is indicated in the attached documentation, nmoff from the Concord Mills site is piped across the
boulevard onto the Ahmad property. We havc bccn concerned with the extent of accumulated sediment
observed and the potential impact to the property, entirely from off=site sources. As you are aware,
development in tic Kings Grant area has been enormous. Mr. Alimad's acreage represents only a tiny
portion and is dwarfed by the surrounding players.
Further reslriclions placetl on this property would seem to unfairly penalize a landowner who, to dale, has
initiated no land-disturbing activity, but whose properly is nonclhcless impacted by development of.) much
larger magnitude than that which is proposed on this site. Furthermore, the General Permit Verification
received from the U.S. Army Corps of Engineers specifically calls for the remaining 1.38 acres of
wetlands to "... be preserved through placement into n conservation casement." Mr.Alimad is not opposed
to those terms and conditions proposed.
For these reasons therefore, I respectfully request your consideration of the particular circumstances of
this site. I have enclosed for your reference, a summary, along with related documentation, to best
characterize the existing conditions and limitations of this property. It is my hope that this information will
help to address your specific areas of concern.

"Ihe subject properly is located al Kings Grant, along the north side of Concord Mills Boulevard (formerly
Speedway Boulevard), approximately 0.5 miles west of (lie I-85 interchange. It is an approximately
triangular-shaped parcel, with a total area of 5.71 acres. 'flit property has a total roadway fronlage of
approximately 1,000 feet and is situated opposite the easternmost entrance into the Concord Mills site.
Tltc (relocated) Concord Mills Boulevard is a 5-lane section with an opening in the concrete median at flit
property.
2. Background
The Owner requested assistance in determining the development potential of the 5.71-acre tract of land,
with the intent to provide three (3) sites approximately one acre each. 'fhe anticipated development use
would be for fast-food restaurants or similar establishments.

The Division of Water Quality has reviewed your plans for the discharge of fill material into 0.99
acres of streams and/or wetlands located at Kings Grant Blvd. near I-85 in Cabarrus County. Insufficient
evidence is present in our files to conclude that your project must be built as planned in waters and/or
wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the proposal are
made as described below, we will have to move toward denial of your 401 Certification as required by 15A
NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional
information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your
project on administrative hold.
Please provide us with information supporting your position that states your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters and/or
wetlands. Specifically can you construct your project by minimizing impacts to wetlands to less than one-
third acre? Otherwise a wet detention pond will be required to handle the stormwater runoff. A site plan
will be needed to justify this fill. Any documentation such as maps and narrative that you can supply to
address alternative designs for your project may be helpful in our review of your 401 Certification. Also
this project may require compensatory mitigation as described in 15A NCAC 2H .0506(h) if perennial
streams are being impacted.
Please respond within three weeks of the date of this letter by sending a copy of this information to
me and one copy to Mr. Mike Parker, Mooresville Regional Office at 919 North Main Street Mooresville
NC 28115. If we do not hear from you in three weeks, we will assume that you no longer want to pursue

Environmental Services, Inc (ESI) is submitting on behalf of Dimpa , Nasir Ahmad, a Pre-Constru ton
Notification Application (PCN) for a Section 401 Certific ' nifcation is being requested because
the client is proposing modification (filling) of approxim tely s of jurisdictional wetlands located
within the property. In conjunction with the proposed we nd pproximately 30 feet o f significant
stream channel will be culverted.
The property is located on the north side of King's Grant Boulevard, approximately 2000 feet west of the I-85
overpass (Figure 1). The property is located in Cabarrus County, North Carolina.
The property encompasses approximately 5.71 acres and contains a total of 2.37 acres of jurisdictional
wetlands. Three stream channels exist within the proposed development area. Stream A and B are 125 and
295 liner feet, respectively (Figures 2). These channels were determined to be non-significant (stormwater)
channels by Mr. Steve Chapin of the U.S. Army Corps of Engineers (COE) on 26 August 1998 and
subsequently by Mr. Mike Parker (DWQ- Morrisville Field Office) on 6 October 1998. Stream C is the only
significant (perennial) channel identified on site and within the development area.

(2) Site layout avoids and minimizes the amount of fill in wetland. The total parcel contains 2.37
wetland acres and only 0.99 wetland acres are proposed for fill. Steep side slopes for fill placements
minimizes wetland acreage fill.
