Dear Sirs:
We have been requested by you to review a map prepared by Evans Engineering, Inc., entitled
"Possible Pond Location Map," showing the property consisting of approximately 414 acres
lying south of Bryan Boulevard and between New Garden Road and Jefferson Road in the city of
Greensboro, formerly owned in its entirety by Jefferson Pilot Life Insurance Company CUP"),
some of which now has been conveyed by it to other entities. We have reviewed the map which
shows possible locations of permanent runoff control structures for each of the parcels into
which the JP property has been or is being subdivided and have determined that such structures
constructed for each of the parcels as shown on the map would meet the watershed requirements
of the City of Greensboro without utilization of the approximately 22-acre lake that is located
essentially in the center of the property. We should note the probability that development
activities on the respective parcels might collect and direct the flow of runoff such that fewer
permanent runoff control structures than those shown on the map would be required to meet our
watershed requirements.
It is the strong preference of the City of Greensboro, however, that the large lake be used as a
permanent runoff control structure, rather than a proliferation of smaller structures.

Dear Mr. Thomas:
We have reviewed the additional information submitted by your office and the
National Park Service concerning the above project and offer the following
comments.
As a result of the December 14, 1998, meeting between you, my staff, and
representatives of Jefferson Pilot where'we received additional information about
project changes in the permit area, we have revised our recommendations for
archaeological investigations.
Archaeological site 31 GF224* * has been destroyed by ground disturbing activities
by the Guilford County Board of Education. Archaeological investigations of this
area would be pointless and we withdraw our recommendation for evaluation of the
site for National Register eligibility.
It is our understanding that archaeological site 31 GF223 * * is now outside the
permit area and, therefore, not subject to Section 106 review. Thus, evaluation of
its National Register eligibility will not be undertaken.
Based on the information submitted by the National Park Service concerning the
skirmish known as the Battle of New Garden, it is our opinion that there is a high
probability for portions of the Jefferson Pilot tract to contain archaeological
evidence of this eighteenth century conflict. We recommend that the area from
New Garden Road east to the lake and from the northern boundary of the school
property to the northern side of Hobbs Road be surveyed by an experienced
archaeologist. This area corresponds to parcel 5B (Park Option) on the project
plans. A map indicating the boundaries is enclosed.
The archaeological investigation should include intensive historic research of the
skirmish, beginning with the references cited in Mr. Vogel's letter (copy attached)-

Garden Road. The use of a metal detector during this investigation would be
appropriate. The topographic map indicates there may be a springhead located
within the middle third of the tract. Based on current knowledge, it is likely that
the bench area adjacent to the springhead may contain a small Woodland period
campsite. The easternmost third of the tract, due to the sloping topography should
be subjected to a reconnaissance level investigation.
The above comments are made pursuant to Section 106 of the National Historic
Preservation Act and the Advisory Council on Historic Preservation's Regulations
for Compliance with Section 106 codified at 36 CFR Part 800.

day of February, 1998, by and between JEFFERSON PILOT LIM INS C ANY, a
North Carolina corporation ("Jefferson-Pilot"), and the GUILFORD C BOARD OF
EDUCATION (the "School Boar(r"),
RECITALS:
A. Contemporaneously herewith, Jefferson-pilot is conveying to the School Board the
real property referred to as 'Lot 1, School Site on the Master Development plan for Jeff?rson-
Pilot dated October 10, 1997, last revised November 4, 1997, and more particularly described on
Exhibit "A", attached hereto and incorporated herran (thc "Property,). The Property is one of
seven parcels owned by Jefferson-Pilot included on the Master Development Plan (the seven
parcels shall be referred to as the "New Garden Development").
B. As required by the City of Greensboro, Jefferson-Pilot has agreed to construct
Certain improvements on and adjacent to the New Garden Development, such as road widening
and road and sewer construction, all as described in the Master Development Plan.
C. The School Board has agreed to pay a portion of the costs for the construction of
certain of these improvements relating to the New Garden Development, which improvements
will benefit the Property.
D. Jefferson-Pilot and the School Board desire to set forth the School Board's share
of these improvements costs and the manner in which Jefferson-Pilot will be reimbursed for the
costs.
AGR'EEM 14T:
NOW, TfMREFORE, for and In consideration of the above recitals, and the premises and
mutual promises hereinafter set forth, the sufficiency of which is hereby aalmowledged, the parties
hereto hereby agree as Wows:
1. Jefferson-Pilot will construct or will cause the construction of the improvements
required in connection with the development of the New Garden Development as set forth on the
Master Development Plan (the "improvements"), The projected costs for the Improvements ore
set forth on Exhibit "B" attached hereto and incorporated herein, entitled 'Allocation of Projected
Site Development Costs for the JP New Garden Road Property",
2. The School Board shall reimburse Jefferson-Pilot in the manner described below
for its prorata share of the costs actually incurred by Jefferson-Pilot in the construction of the
Improvements according to the schedule set forth on Exhibit -B', with such reimbursement

amount not to exceed the School Board's allocable share of the Improvements costs estimated on
Exhibit B". During the construction of the Improvements. Je$'esson_Pilot ahall deli v to the
School Board a monthly statement certified by an Officer of Jefferson-Pilot setting forth the
School Board's prorata share of the Improvements Costs for construction actually completed
during such time period (the 'Statement") along with supporting documentation showing
Jefferson-Pilot's payment of such costs. No Statements will be sent during
Jefferson-Not did not PaY anY construction invoices. The School Board shall pay month dW

3. The School Board represents and warrants that an actions necessary to authorize
the School Board's execution of this Agreement and the payment of the School Board's prorate

4. In the event that any of the amounts set forth in the Statement(s) is not paid when
due, interest shall accrue on such unpaid amount at the rate of seven percent (7%) per annum

forth below, and the School Board shall send all payments to Jefferson-Pilot at the address set
forth below.

6. This Agreement constitutes the entire understanding between the parties with

upon and inure to the benefit of the parties hereto and their respective successors and assigns.
7. The School Board agrees to join in the execution of a Declaration of Covenants,
Conditions and Restrictions in a form to be agreed upon by Jefferson-Pilot and the School Board,
which Declaration will provide for a continuing financial obligation by the School Board limited to
its proportionate share of the cost of maintaining retention or detention
other drainage or erosion control devices serving the New Garden Developmentasrequired byd

On December 8, 1998 a site visit of the Jefferson Pilot property was conducted
by Mr. John Dorney and Mr. Ron Linville. The visit determined that the school
system had impacted jurisdictional waters (classification WS-III, NSW).
Specifically, a jurisdictional tributary to Horsepen Creek had been piped
without the issuance of a US Army Corps of Engineers Section 404 Permit and a
Section 401 Certification which is issued by the State of North Carolina. Without
these, the project is in violation of requirements of the United States Clean Water Act
Section 301. Additionally, this activity is not in compliance with NCAC 15A 2H
.0500 which requires application for these impacts.
It is our understanding that the US Army Corps of Engineers has indicated that
they will permit this activity as long as the 401 Certification is acquired.
It is necessary that you respond to this Notice of Violation within 30 days of
your receipt of this letter. A 404/401 Joint Application form is enclosed for your

Dear Mr. Priddy:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 363 feet
of waters for the purpose of constructing the Jefferson Elementary School, as you described in your application dated 25 February
1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number
3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you
should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment
and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire
when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters to notify the
state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of
the date of this letter or the issuance of the 404 Permit (whichever is later).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

Recommendations were to present some options discussed with
their engineer. I am flexible on this one. Will leave it up to you
since you have seen site. Engineer indicated that they will be
leaving tree buffer along lower portion of property. We could say
that they should leave remaining and exisiting buffers in place for
both streams with natural vegetation for stormwater and nutrient
management in lieu of a stormwater pond. This should be acceptable
to them and should not jeopardize their agreement with JP (who
knows?). They may add more units later to this site and if we don't
protect now, they may do more damage. Should indicate that any
future impacts will require another DWQ notification and review.

never required stormwater for an elementary school since the imprevious
surfaces are rather low. also with downstream lake and stream
mitigation on-site, i would say this suffices? do you still want

Dear Mr. Dorney:
On behalf of the Guilford County Schools we have enclosed a comple a of pptfcation Form for
Jefferson Elementary School. The Guilford County Schools is requesting Corps of Engineers and
State Water Quality approval in accordance with the "Notice of Violation" received on February 8,
1999 from Larry Coble. Along with the application form we have enclosed the following supporting
information to assist you and your staff in the review of our application:
1. Partial copy of the Jefferson Pilot wetland maps prepared by Evans Engineering.
2. Copy of a letter from the Elizabeth Treadway, Director of Environmental Services
supporting JP's concept of utilization of the large lake for a permanent runoff control
structure.
3. Copy of the Overall Development plan for the Jefferson-Pilot property showing the school
site and the location of the lakes.
4. Copy of a letter from the North Carolina Department of Cultural Resources
5. Copy of a contract between Guilford County Schools and Jefferson-Pilot for transfer of the
school property and agreement on cost participation for certain infrastructure
improvements.
6. Copy of Sketch plans showing various development schemes considered for this site.
7. Copy of the overall site development plan.
Our firm evaluated a geotechnical report and inspected the subject channel and made the
determination that this was a wet weather drainage channel. The existence of the wetland maps
prepared by Evans Engineering were made for Jefferson-Pilot and were not provided to Guilford
County Schools. However we feel that JP would have provided these to us if they were asked to do
so. The USGS topographic map for the project area did not show a blue line for a stream
designation. Since we did not suspect a wetland issue, based upon our review of the available
information, we did not inquire about potential wetland mapping.
During the Schematic Design Phase, several different layouts were examined. After much discussion
with the City of Greensboro Planning and Transportation Staff a layout was selected to insure safe

ingress and egress from the school site. Design constraints such as the size and shape of the
property, the limitation on the number of driveway access points on New Garden Road, and the need
to provide sufficient vehicle "stacking" for student unloading helped to shape the layout that is
currently constructed on the site. Because of these design issues, impacts to the subject channel
could not have been avoided.
The Guilford County Schools request approval of the Water Quality Certification based on the
approved development plan from the City of Greensboro. This plan utilizes the existing Jefferson-
Pilot lakes for watershed protection. The Guilford County Schools will be part of a property owners
association. The property association will be required to maintain the lakes for water quality
protection.
