Below is a response to each of your comments. Please justify your need to impact 0.20 acre of bottomland hardwood forest for lot fill (wetland impact #2) and demonstrate how you have avoided and minimized to the maximum extent practicable. This office recommends that all lots be designed so that all jurisdictional wetlands and waters are located within open space. The applicant has revised the site plan to reduce wetland impacts. Impact #2 has been revised and wetland impacts at this location have been reduced to 0.024 acre. Total wetland impacts have been reduced to 0.135 acre. Enclosed are revised maps and pages 3, 5, and 7 of a revised PCN form (pages 3, 5, and 7) that reflect these changes. General Condition #20 of the Nationwide Permits states that a minimum of 1:1 mitigation is required for impacts exceeding 0.10 acre. To mitigate for 0.135 acre of wetland impacts, the applicant proposes to preserve 14.96 acres of wetlands on site (see enclosed map). This would be a 111:1 mitigation to impact ratio. The applicant plans to preserve these wetlands by incorporating the Corps' standard preservation language into the subdivision's restrictive covenants. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The site is currently forested with a large man-made pond in the center of the tract, which has been classified by ACOE as isolated waters. The applicant has a stormwater permit for this pond. Adjacent properties are mostly undeveloped/forested or residential, with some commercial use on the opposite side of Highway 133. 3b. Explain the purpose of the proposed project: The purpose of the proposed project is for the development of a residential subdivision. Proposed wetland impacts are necessary for roads and for lots. 3e. Typical construction equipment will be used to pave a road system and clear lots for building footprints. A total of 0.135 acre of wetland impacts are needed for roads and/or lots.
