PROJECT SUMMARY: The applicant proposes to reconstruct a pier from MHW out to the AIW W, with a 10 slip community docking facility and a covered gazebo. Caison's Creek HOA October 30, 2019 Page 2 9. PROJECT DESCRIPTION The proposed project is located in Supply on the mainland side of the AIW W across from Holden Beach in Brunswick County. The property can be reached by traveling NC HWY 17 south towards Holden Beach. Travel straight through the intersection of HWY 17 and NC HWY 211, and continue past Brunswick Community Hospital. Just past the hospital, look for Mt. Pisgah Road and prepare to make a left turn across the highway. Travel Mt. Pisgah Road/NC HWY 130 south until the road turns sharply toward the left at a Citgo gas station. Turn right onto Caison's Creek Dr SW and continue down until you reach Heron Watch Dr SW and turn left. The proposed docking facility will start at the dead end of Heron Watch Dr SW. The project area is 3.5 acres. The pier originates at the end of the Heron Watch Dr SW cul de sac and continues over a high ground portion of a 59-acre undeveloped parcel. High ground elevations range from 4 to 20 feet above MHW. The majority of the project is located on approximately 3.5 acres, most of which is coastal wetlands, and is situated on the AIW W. The average depth at the waterward end of the existing docking facility is approximately -2.0' at MLW. The topography of the site is generally flat, with moderate slopes leading down to the wetland stream area and the marsh. Vegetation on the upland portions of the tract includes Pine trees (Pinus sp.), Live Oak (Quercus virginiana) and other Oaks, Hickory (Carya sp.), Red Maple (Acer rubrum), Berries (Vaccinium spp.), Red Bay (Persea borbonia), various saplings, grasses, weeds, vines, and ferns (Pteropsidae). High ground soils consist of Wando fine sand; wetland soils consist of Carteret loamy fine sand. Salt Meadow Cordgrass (Spartina alternii fora) and Black Needlerush (Juncus roemarianus) are the predominant Coastal Wetland species in the project area. The CAMA Land Use Plan Classification for the project area is Residential. Currently, there are no permanent man made features on the tract other than the heavily damaged existing previously permitted docking facility (Major Permit #182-04). Major Permit # 182-04 was issued on December 20, 2004 to Caison's Creek S/D, c/o Midway Development Corp and authorized the construction of a subdivision roadway, a covered gazebo, and a 10-slip community docking facility. A "404" wetland area runs along the AIW W side of property. Adjacent to this "404" wetland area is a band of Black Needlerush that marks the beginning of the coastal marsh. From here to the waters of the AIW W, there is a broad (approximately 750 feet wide) expanse of Saltmeadow Cordgrass coastal marsh. Within this area, elevations fluctuate so that there are areas of pending, patches of Black Needlerush, and even a .72-acre upland island. A wetlands survey (Action ID 200401221) was previously conducted for the project site and was approved on 9/27/04 by the Wilmington District Army Corps of Engineers. The wetland survey was only valid for a period of up to 5 years (assuming no change in law or regulations) and has since expired on 9/27/09. The proposed rebuilding of the docking facility will start at MHW and extend out to the AIW W and will only include maintenance and repair to the existing high ground access pier. These waters of the Atlantic Intracoastal Waterway have been classified SA by the NC Division of Water Resources. The project area is closed to the taking of shellfish. The area is not considered Primary Nursery Area by the Division of Marine Fisheries. PROPOSED PROJECT The applicant proposes to reconstruct a pier from MHW out to the AIW W, with a 10 slip community docking facility and a covered gazebo. The docking facility would be built with the same dimensions and in the same footprint as the previously permitted docking facility (Major Permit #182-04). Over the years, several storms Caison's Creek HOA October 30, 2019 Page 3 including Hurricane Irene, Matthew, and Florence have damaged the structure beyond use. Portions of the pier would be reused or repaired where possible and replaced where damage is significant. Total pier length would be 1,118 ft long x 6 ft wide, crossing from high ground over federal wetlands and coastal wetlands out to the AIW W. The pier would terminate with a 18' x 18' covered gazebo and a 154' x 6' floating dock spine. From the spine, (5) 24' x 4' finger piers would extend waterward and perpendicular to the AI W W. A total of (9) 24'x12' boat lifts would be installed in the finger piers and (1) 24'x 12' boatlift would be installed on the outside of the far east finger pier (slip # 10). Water depths at the waterward end of the proposed floating spine are approximately -2' feet MLW. Water depths at the landward edge of the floating spine range from -.06' MLW to -1.4' MLW. The docking facility would extend out into the water to within approximately 2 feet of the Corps of Engineers AIW W 80' setback line. The pier and covered gazebo would not encroach into the adjacent 15-foot riparian corridor setback line on the west side of the docking facility. The eastern portion of the docking facility will be constructed with a small portion of the 5"' finger pier and the entire boatlift in slip #10 extending over the 15-foot riparian corridor setback. The eastern riparian property owner has waived the 15' setback and does not object to the proposed plan. The width of the waterbody is approximately 540'. 10. ANTICIPATED IMPACTS The high ground portion of the pier is 233' and deck boards and handrails would be repaired as needed. Rebuilding the remaining 885' of pier, the gazebo, and the 10 slip docking facility would incorporate approximately 9,180 ft' of Estuarine Waters and Public Trust Area. All of the anticipated impacts for this proposed project would be in the same footprint as the previously authorized docking facility and have already been accounted for in Major Permit #182-04. The pier would not exceed ''/a width of the water body or extend into the Army Corps 80' setback. A short term increase in turbidity can be expected during piling installation during pier/dock construction. (SEGi) has been retained by Caison's Creek HOA (see Attachment 1), herein referred to as the "Applicant", to submit the attached CAMA Major Permit Application packet (Attachment 2), which is necessary to perform maintenance and new work, on their community boating facility, located off Sea Aire Drive, in Brunswick County, North Carolina (see Attachment 3). Site Information and History: The structure is located on approximately 3.5 acres, most of which is coastal wetlands, and is situated on the Atlantic Intracoastal Waterway. The average mean -low water depth, at the waterward end of the structure, is approximately -4.5' (see Attachment 4). The structure was originally permitted, by the DCM, under CAMA Major Permit #182-04 (see Attachment 5) and included 885 LF of pier, an 18' x 18' fixed, covered gazebo, a 154' x 6' floating platform, with 5-24' x 4' floating, finger piers, and 10-24' x 12' boat lifts. Over the years, several storms (specifically Hurricanes Irene, Matthew and Florence) have damaged the structure (see Attachment 6). Proposed Work: The Applicant intends to repair sections of the existing 885 LF pier and the 18' x 18' gazebo and replacing the 154' x 6' floating platform, associated finger piers and boat lifts. Existing pilings will be used, if possible. If not, they will be replaced. Conventional construction methods and materials will be used. To ensure protection of the West Indian manatee (Trichechus manatus), the work will be undertaken between November 1 and May 31. If this is not possible, the Applicant will adhere to the US Fish and Wildlife's guidance entitled "GUIDELINES FOR AVOIDING IMPACTS TO THE WEST INDIAN MANATEE, Precautionary Measures for Construction Activities in North Carolina Waters" (see Attachment 7). Upon receiving a current survey of the structure and water depths, it was determined that the structures were not constructed as per the plan, approved under the original CAMA Major Permit. The structure was constructed approximately 10' east of the western, 15' riparian corridor setback line, when it was proposed to be positioned on the western, riparian corridor, setback line. This being the case, the Applicant intends to replace the structures in the same footprint, in which they were constructed. This entails encroaching into the eastern, 15' riparian corridor. Caison's Creek CAMA Maier Permit Application (7/23/19) c 7F l v A small boat and barge will be used, to complete the work, and will either be moored, at the site, or mobilized to the site each day, until the work is completed. CAMA Major Permit Process: As part of the CAMA Major Permit process, the Applicant has notified the eastern, adjacent riparian property owner, Suzette Stines, by US Postal Service certified mail (see Attachment 8) and via email to the western, adjacent riparian property owner, Tom Young, who signed the waiver (see Attachment 9). Also, a $400.00 filing fee is required, which has been included with this correspondence (see Attachment 10). It is SEGi's hope that the information found within and attached to this letter will be sufficient, for the DCM to consider the application complete, and the permit will be processed without delay. No other structure, whether floating or stationary, may become a permanent part of this community docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in or over public trust waters without permit mollification. 4) Any portion of the permitted access pier and docking facilities built over coastal. wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 5) The pier and associated structures shall have a minimum setback distance of 15 feei between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 6) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire oil the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 7) The roof of the covered platform shall not be designed for second story use. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 9) The authorized structure and associated activity shall not cause an unacceptable interference with navigation. 10) No portion of any structure shall be located within 80 feet of the near bottom edge of the federally maintained AiWW channel. As as -built survey shall be performed on the docking facility within 60 days of completion of construction of the docking facility, and copies of the survey provided to the U.S. Army Corps of Engineers and Division of Coastal Management. 11) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if lie abandons the permitted activity without having it transferred to a third party. 12) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 13) It is possible that the authorized structure may be damaged by wave wash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to enREQtE1WrgDy of the permitted structure and the safety of moored boats. The permittee shall not hold the United States liable for any such damage. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 15) This permit authorizes a maximum of ten boat slips. NOTE: Any proposal to add one or more additional boat slips to the authorized 10 slip facility will require that the docking facility be classified as at marina, and will therefore require a review under the N.C. Environmental Policy Act (NCEPA), High Ground Development 16) No fill material shall be placed in any location or in any manner so as to impair surface water flow into or out of any wetland area. Stormwater Managing 17) The Division of Water Quality approval of this project under stormwater management rules of the Environmental Management Commission is covered by way of Stormwater Permit No. SW8041025, which was issued on 12/15/04. Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit. EROSION & SEDIMENTATION CONTROL NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. 18) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 19) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e,g. silt fence, diversion swales or berms, etc.). 20) The permitted activity shall be conducted in such a manner as to prevent a significant increase in turbidity outside of the area of construction or construction -related discharge. Copies of these recorded deeds shall be provided to the Division of Coastal Management. 22) This permit does not authorize the excavation or filling of any wetlands or open water areas, even temporarily. 23) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structtuo or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said stnrcture or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. Damage claims associated with any future modification, suspension, or revocation of this permit. 26) The construction and/or operation of the authorized facilities shall not directly result in any closure of any waters that are open to the taking of shellfish. Any such closure directly attributable to the mar to facility shall require that the permittee undertake remedial actions to remedy the situation. U W 27) The federally endangered West Indian manatee (Trichechus mnnatus), has been reported in Anti Carolina waters.
