near Harlowe as requested in the permittee's application dated 611/09 including the
attached drawings (6) all dated 5/19/09
('his permit, issued on September 29, 2009 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Marina
1) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina. Any sewage discharge at the marina shall be considered a violation of this permit for which
the permittee is responsible. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
2) Unless specifically altered herein, this permit authorizes only the docks, piers, and other structures and
uses located in or over the water that are expressly and specifically set forth in the permit application.
No other structure, whether floating or stationary, may become a permanent part of this docking
facility without permit modification. No non-water dependent uses of structures may be conducted on,
in or over public trust waters without permit modification.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit shall be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work shall cease when the permit expires on
April 3, 2014
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

4) The authorized marina is located in an area classified as "Approved" for shellfish harvest. Future
individual docks and dips, cr the decking of any boats greater than 24 feet in length, or any boats with

narrative, dated received in Morehead City on 6/3/09 and in order to satisfy concerns of the Division of
Environmental Health to ensure that there is no change in classification from "Approved"; quarterly
reports indicating the number of slips. the number and length of all boats, the number and length of
boats with cabins, then number of boats with heads, and the number of boats with "porta-potties" must
be made to the Shellfish Sanitation Recreational Water Quality Section on the fifth day of the first
month of each quarter of the calendar year, and shall be postmarked on or before the fifteenth day of the
reporting month. The report shall be submitted to the N.C. Division of Environemtnal Health at PO Box
769 Morehead City, NC 28557. Additionally, restrictive covenants shall be placed on all lots within the
subdivision. The restrictive covenants shall state that:
a) No docking of boats larger than 24 feet in length.
b) No heads allowed on any boat docked in this marina.
c) No docking of boats with cabins in this marina.
These Restrictive covenants shall be recorded with the Craven County Register of Deeds and copies
provided to the Division of Coastal Management, prior to occupancy of any slips authorized by this
permit.
4) The construction and/or operation of the authorized marina facilities shall not directly result in any
closure of any waters that are open to the taking of shellfish. Any such closure directly attributable to
the marina facility shall require that the permittee undertake remedial actions to remedy the situation.
Such actions may include, but are not limited to, a removal of any unauthorized slips or mitigative
measures to reduce or eliminate the cause(s) of the closure.
5) All portions of the access pier/walkway located over Coastal Wetlands shall not exceed a width of 6 ft.
and shall be elevated a minimum of 3 feet above the marsh substrate as measured from the bottom of the
decking.
6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
7) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
8) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
that may be caused from existing or future operations undertaken by the United States in the public
interest.
9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.

11) The permittee may be required to apply for a submerged land lease from the Department of
Administration's State Property Office. Contact the Department of Administration's State Property
Office directly at (919) 807-4650 for this determination. Should it be determined that an Easement is
required, the permittee shall supply a copy of the easement to the Division within 30 days of issuance of
the Easement.
Upland Development
12) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including but not limited to the
driveway, parking lot, community clubhouse, sidewalks, infrastructure associated with the development
of the marina, all as expressly and specifically set forth in the attached permit application and workplan
drawings. Any additional land disturbing activities and/or construction may require a modification of
this permit. Contact a Division of Coastal Management representative at (252) 808-2808 for this
determination.
Stormwater Management
13) The Division of Water Quality approval of this project under stormwater management rules of the
Environmental Management Commission is covered by way of an existing Stormwater Permit No.
SW7050605. If a modified Stormwater permit is required, it shall be obtained prior to initiation of any
development authorized by this permit. Any violation of the permit approved by the DWQ shall be
considered a violation of this CAMA permit.
Sedimentation and Erosion Control
'VOTE: An Erosion and Sedimentation Control Plan may be required for this project. If a plan is needed,

activity. Submit this plan to the Department of Environment and Natural Resources, Land

14) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
15) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).

removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his autrorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
17) Any mitigative measures or environmental commitments specifically made by the applicant in the
Environmental Assessment for this project should be implemented, regardless of whether or not such
commitments are addressed by individual conditions of this permit.
18) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
i9) The permittee and/or his contractor shall meet with a representative of the Division prior to project
initiation in order to discuss the conditions set forth in this permit.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that, in accordance with the
rules of the Environmental Management Commission, many non-water dependent activities are
not authorized within 50 feet of the normal water level or landward edge of any coastal wetlands,
which ever is more restrictive. Contact the Division of Water Quality at (252) 946-6481 for
project specific clarification.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under DWQ Project No.
09-0730..
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. No.
SAW-2009-01473.
