Here are the exhibits for the stream buffers. I don't think there are specific exhibits between SB-3 and SB-4 because
there weren't buffer impacts in the areas. I can reach out to the Civil to confirm.
Also, these impact exhibits should include the buffer impacts between Manholes J and M.

I also can't find a buffer impact sheet in any of the submittals for buffer impacts between Manhole J and M which I
assume is buffer impact 4C based on the fact that I have 4B before J and I have 4D around Manhole M

I was trying to develop an impact table for my approval letter and I can't seem to find plans that show buffer impacts

I believe that they are only filling a small amount (0.02 acres) of Wetland E that is located within the construction
corridor. I have attached the impact exhibits for comparison.

Hi Paul. A few comments:
1) Native tree plantings are mentioned in the mitigation plan. Will these be planted only outside of the maintenance
corridor? As you know, sewer lines are typically maintained as herbaceous -only.
2) The following statement is not accurate "Native grasses, such as centipede and zoysia will be utilized as native grass
species", given that neither centipede nor zoysia are native species.
3) Please provide more specificity regarding the seeding plan. One way to provide this level of detail is to figure out
which seed mix will be purchased (often a piedmont riparian, or piedmont wetland mix from a native plant nursery) and
copy/paste the species list .

1) Copy the Corps on your responses to the request for additional information from NCDWR dated 9/27/2019,
specifically items 1, 3, and 4;
2) Exhibit A shows two spec buildings, whereas Sheets C1.3A, C1.4, and C1.5A only show the southernmost proposed
building. However, Exhibit A indicates that the northernmost building could encroach into a currently unverified
intermittent stream. Have potential waters of the US been delineated on this parcel? If so, please submit this
information for our review. If not, what is the proposed timing of construction of the northernmost building, and will a
delineation of potential waters of the US be submitted for Corps/NCDWR verification prior to design?
3) Thank you for clarification of authorization requested for manholes in wetlands. Although we understand that a
certain level of design has been completed for the sewer line, that fact alone and potential costs associated with
redesign cannot be considered in our evaluation of whether the proposal shows avoidance and minimization of impacts
to the maximum extent practicable. As such, please submit valid reasons why each manhole cannot be located outside
of wetlands per NWP General Condition 23 (a) and (b).
4). As previously requested, please provide specific seeding/planting species for restoration of temporary stream bank
and wetland impacts.

Hi Paul. If the adjacent commercial development is necessary to justify the sewer line then certainly place it all under
NWP 39. If the sewer line stands on its own as a regional sewer project (typically the municipality would be the
applicant), then NWP 12 and 18 would make more sense. Hopefully this helps.

We are approaching getting these items answered and hope to have them to back to you and Sue in the coming days.
Concerning the item about the manholes in wetlands and authorization under NWP 12 (item #3 below), we have the
proposed impact areas as requested.
Each manhole will propose fill impacts of 19.6 SF of jurisdictional wetlands, for a total of 78.4 SF or approximately
0.0018 acres. For manholes D, N, and O, the total proposed fill in wetlands for each manhole is 1.3 cubic yards. For
manhole U, the total fill is 1.1 cubic yards. The total fill for the 4 manholes proposed in wetlands is 5.0 cubic yards.
For the impacts concerning the manholes, can we request that these impacts be authorized with a NWP 18 to cover the
manhole impacts in conjunction with the originally requested NWP 12 for the remaining sewer? Or can we utilize a
NWP 39 to fulfill all of the impacts?

Hey guys. You nailed it. For the section on what NWP 12 authorizes specific to utility lines, it says "There must be no
change in pre -construction contours of waters of the United States." Since the manholes are part of the utility line and
wouldn't be returned to pre -construction contours, NWP 12 can't authorize them. The other allowable above grade fills
authorized by NWP 12 are all specific to substations, overhead utilities, and access roads.
Avoidance and minimization (NWP General Conditions 23 a and b) should direct the design to keep manholes outside of
waters of the US to the maximum extent practicable anyway, so perhaps that's the reason?

lines. Can you help point us in the right direction? We did see one comment in the Nationwide Guidelines, that states:
"There must be no change in pre -construction contours of waters of the United States." Is this the item you were
referring to? It seems like there are allowances for impacts with access roads, substations, and other structures, etc., so
it raised our curiosity.

Please submit the requested information below (via e-mail is fine) within 30 days of receipt of this Notification,
otherwise we may deny verification of the use of the Nationwide Permit or consider your application withdrawn and

1) Future developable area and two speculative buildings were referenced on the PCN. Please submit the location and
building envelopes of the speculative buildings that Samet or related entities plan to develop that would tie into the
proposed sewer line. This information is necessary to ensure that the project presented is single and complete/has
independent utility, and should clearly show where this development would take place for remote evaluation of
potential impacts to waters of the US;
2) Please submit profile views of the proposed stream crossings. If rip rap is proposed to be placed below the ordinary
high water mark of these streams, ensure that the profile drawings clearly show that any rip rap placed in the stream
bed would not be placed above the existing stream bed grade (i.e. key into stream bed);
3) It appears that new manholes (D, N, O, P, and U) are proposed to be placed within wetlands. These impacts are
considered permanent discharges of fill material and permanent losses of waters of the US. Given that NWP 12 cannot
be used to authorize permanent above -grade fill for utility lines, NWP 18 would be required to authorize them. These
impacts must also be itemized separately on the PCN form, along with valid reasons why they cannot be located outside
of wetlands (avoidance and minimization);
4) Please specify the plan to restore temporary wetland and stream impacts, including stockpiling and re -use of
wetland top soil, and specific seeding/planting species.
