SUBJECT: In -stream Assessment Of Wilmington Northside WWTP Discharge
The City of Wilmington has requested a first-time SOC to increase
the flow of its Northside WWTP by 679,000 GPD. Using this facility's
self -monitoring data, the Region has estimated that the present BOD5
limit of 30 mg/l will need to be increased to a temporary limit of 47
mg/l under the SOC. Because there is considerable flow at the point of
discharge (7Q10=28 cfs, average flow=2130 cfs), the impact of the above
changes on the water quality of the Northeast Cape Fear River will be
minimal. Pre-SOC and SOC analyses using mass balance indicate that the
BOD5 instream waste concentration (IWC) will not increase significantly
(8.27 mg/1 to 13.06 mg/1).
Consideration should also be given to the discharge being only 300
feet above the confluence of the northeast branch with the main part of
the river. The combined 7010 flow below the confluence is 1149 cfs,
yielding an IWC of 2.36 mg/l of BOD5 under the SOC. Since the Cape Fear
River is influenced by tidal currents at the discharge site, pollutants
from the WWTP will be carried up the northeast branch at flood tide (1.7
knots minimum). However, because of the dilution ratio present even at
low -flow conditions, this should not be a problem.
Since the issuance of the latest permit to Wilmington-Northside in
October, 1983, there has been demonstrated tonicity of their effluent.
A toxic study conducted in the spring of this year detected elevated
effluent concentrations of copper, zinc, cyanide, ammonia, and several
organic compounds ("Wilmington Northside WWTP Toxicity Examination",
Department of Environmental Management, Water Quality Section, October
1986).
It is recommended that both the 0.679 MGD increase in wasteflow and
the 47 mg/l BOD5 limit be approved. However, based on the results of
the toxicity examination, it is also recommended that a 20 mg/l ammonia
limit and a toxicity testing requirement (attached) be required as,part
of the SOC.

1.) The permittee shall conduct chronic toxicity tests on a quarterly
basis using protocols defined in E.P.A. Document 600/4-85/014
entitled "Short -Term Methods for Estimating the Chronic Toxicity
of Effluents and Receiving Waters to Freshwater Organisms". The
testing shall be performed as a Ceriodaphnia Survival and Repro-
duction Test. Effluent collection will be performed twice during
each test as 24 hour composite samples. Toxicity test exposure
using the first composite sample will include the first three full
days of testing. Exposure to the second composite sample will in-
clude the last four full days of testing. Effluent samples will
be taken immediately prior to disinfection, but after all other
treatment processes. The Chronic Value (ChV) must be greater than
31 %. There will be minimally five effluent concentrations and a
control exposure treatment. One effluent concentration shall equal
31%, which represents the instream waste concentration (I.W.C.)
during 7Q10 low flow conditions and daily permitted d. char a volume.

There may not be more than 10% mortality in dffMjh� 95% effluent
after 48 hours of exposure.
Note: Failure to achieve test conditions as specified in;:the cited
document, such as minimum control organism survival and appropriate
environmental controls, shall constitute an invalid test and will re-
quire immediate retesting. Failure to submit suitable /test /results[

Please Let this Letter serve as my official written request of
the Environmental Management Commission to grant a Special Order By
Consent for the City's Northside Wastewater Treatment PLant. Enclosed
is a certified copy of the Wilmington City Council Resolution which
requests that Special Order By Consent. Under separate cover, I am
sending another certified copy of this resolution to Mr. Preston
Howard,
To follow—up on actions we intend to take in addition to those
included in my September 29, 1985 Letter to you, I offer:
1. We wiLL attempt to upgrade our chemical feed program in the
coming months by obtaining vertical tanks, another pump, a
concrete pad, and better mixing capabilities.
2. We wiLL develop a scope of services for the consulting
engineer to : a.) confirm their findings in the
investigatory examination to be soon completed by them and
b.) evaluate cost—effective alternatives for the City to
pursue to upgrade the plant to handle 8 MGO (its hydraulic
capacity) and to handle flows for the Long term.

3. Vie are still in need of receiving the anaLyticaL report
conducted by the State concerning our loadings. I
understand we should soon receive the organics tests resuLts
conducted by the State. This additioneL date wiLL help us
in reaching conclusions.
4. Our pLant's performance during the second heLf of September,
1986 was better than the first half of the month. Our
readings in September, 1986 (a limited data base) indicated
that we are averaging close to 40 mg/L for BOD5 effluent.
We wiLL be out of compliance, even with chemicaL feed, with
one train out of service. It is difficult to predict the
fiLter's recovery time after December 15, 1986. Therefore,
we are still requesting interim Limits under the SpeciaL
Order by Consent of 47 mg/L for BOD5 effluent. We will
continue with the chemical feed in order to stay within
compliance and obviously we will attempt to get the plant to
operate as close to 30 as passible.
Other information contained in my September 29, 1986 Letter
remains essentially unchanged. Please advise of any additionaL
information you may need on this subject in order for our request to
be approved.

TO GRANT A SPECIAL ORDER BY CONSENT
FOR THE NORTHSIDE WASTEWATER TREATMENT

WHEREAS, the James A. Loughlin Wastewater Treatment PLant (the
"Northside Plant"1 has been in violation of its NPDES Permit No.
NCO023965 for five (5) months during a twelve (121 reporting period
(July, 1985 to June, 19861 with respect to exceeding the monthly
average permit Limit of 30 mg/L for effluent DOD5; and
WHEREAS, the Division of Environmental Management notified the
City of Wilmington on September 2, 1986 that since the Northside Plant
was in non—compliance as stated above that requests for sewer system
extensions tributary to the facility would be denied; and
WHEREAS, the Northside PLent was in compliance with its permit's
DODS.Limits in June, July, and August, 1986 through the use of
chemical feed to enhance its treatment capabilities; and
WHEREAS, due to maintenance painting of one trickling fiLter and
one primary cLarifier, the Northside Plant wiLL exceed its permit's
DOD5 Limits in September, 1986, even with the use of chemicaL feed to
enhance its treatment- capab-iLities; and
WHEREAS, due to maintenance painting of another trickling fiLter
and primary clarifier, as weLL as repairs to the trickling filter, the
Northside Plant is projected to exceed its permit's DOD5 Limits even
with the use of chemicaL feed; and
WHEREAS, under N.C.G.S. 143-215.67(b) and subject to the
Provisions of N.C.G.S. 143-215.67(a), the Environmental Management
Commission may authorize a unit of government to accept additional
wastes to its waste —disposal system upon a finding that the unit of
government has secured financing for planning, design, and/or
construction of a new or improved waste—disposaL system which will
adequately treat the additionaL waste and the additional waste wiLL
not result in significant degradation in the quality of waters
uLtimateLy receiving such discharge;
NOW THEREFORE BE IT
RESOLVED, that the City of Wilmington hereby requests the
Environmental Management Commission to grant a Specia.L Order by
Consent and the City of Wilmington agrees to enter into and abide by
this Special Order by Consent as stipulated as foLLows:
1. That the SpeciaL Order by Consent shall expire on March 1,
1987;

2. That until the expiration of the SpeciaL Order by Consent,
the permitted BOD5 effluent Limitations of the Northside
Plant shaLL be 47 mg/L as a monthly average;
3. That the City of Wilmington wiLL continue with chemical feed
to enhance the treatment capability of the Northside Plant
and shaLL endeavor to make every effort to have the
effluent's monthLy average for BOD5 be as close as possible
to 30 mg/L;
4. That maintenance painting of the PLant's major facilities
wiLL be completed no Later than January 1, 1987;
S. That the City holds North Carolina NPDES Permit No.
NCO023965 for operation of an existing wastewater treatment
works (the Northside PLent) and making an outlet therefrom
for treated wastewater to the Cape Fear River, but is unabLe
to comply with the effluent Limitations for BOD5, as set
forth in the City's 201 plan to protect water quaLity
standards. Compliance wiLL require preparation of pLans
and specifications for and construction and operation of
additional treatment works;
6. That non—compliance with fineL affluent Limitations
constitutes causing and contributing to poLLution of the
waters of this State named above, and the City is within the
jurisdiction of the Environmental Management Commission as
set forth in Chapter 143, ArticLe 21 of the North Caro Lino
General Statutes,'
7. That the City desires to cause or aLLow the discharge of
678,865 gpd of edditionaL wastewater to the treatment works,
and that the discharge of such edditionaL wastewater from
the treatment works of the waters of this State will not
resuLt in any significant degradation in their quality or in
the quality of any water uLtimateLy receiving such
discharge;
8. That the City has secured financing for pLanning for
treatment works which, when constructed and operated, wiLL
be sufficient to adequateLy treat the wastewater presently
being discharged and the additional wastewater desired to be
discharged, to the extent that the City wiLL be able to
comply with final permit effluent Limitations;
9. In accordance with the provisions of the North Carolina
General Statute 143.215.67(b) the Environmental Management
Commission aLLows the City to accept the additional
residential waste specified below, or an equivalent number
of housing units, to its waste —disposal system:
