These Guidelines stipulate that no Department of the Army permit can be issued for non-water dependant activities for which a less damaging alternative exists. Specifically, we have concluded that development of the residential subdivision can be accomplished without incurring impacts to the high quality wetlands adjacent to the tributary. As our regulations preclude us from authorizing projects where less damaging, practicable alternatives exist, we have no choice but to deny your request for Department of the Army authorization. In the letter and the attached "Wetlands Mitigation Plan", you requested a description of the type of mitigation required by DWQ for this flooding of 6.0 acres of wetlands. As discussed in our letter of January 8, 1999, DWQ's rules [(15A NCAC 2H .0506(h)(b)] require a 1:1 replacement by restoration or creation of wetlands for those acres impacted by the project. In this case, you will be required to restore or create 6.0 acres of riparian wetlands by these rules. If you choose to utilize the N.C. Wetlands Restoration Program and the Corps of Engineers agrees, this program charges $24,000 per acre for riparian wetlands. Otherwise you will need to locate a suitable site, develop an approvable mitigation plan, conduct the plan and carry out monitoring for five years to ensure success. Enclosed is a mitigation plan which addresses the avoidance and minimization alternatives for the subject project. Since the value of the various types of wetlands is somewhat subjective, we would appreciate knowing what these values may be for this project or the amount and kind of mitigation that would be considered acceptable. Mr. Poteat has held this property for several years with the intention of developing it into a water- based development. However as you well know, economics dictates most private undertakings. If the project cannot be made economically viable with a water-based development which includes mitigation, then Mr. Poteat and local planning officials need to know this in order to proceed in some orderly direction. Reginald Poteat WETLANDS MITIGATION PLAN Prepared for: REGINALD PO TEAT by: W. BURTON WELLS JANUARY 22, 1999 RACKGROUND This property consists of a 70-acre tract of mixed hardwoods and pines located adjacent to the Laurinburg City Limits in Scotland County, North Carolina (See attached map). The topography varies from flat to rolling to fairly steep. The soils are classified as Lakeland sands which are generally deep erosive sands. The entire tract is surrounded by roads and/or existing subdivided lots mostly with existing houses. About two thirds of the tract is bounded by Plantation Road, an unimproved dirt road. The property on the opposite side of Plantation Road has been subdivided and several houses have been built. The remainder of the tract is surrounded by Barnes Bridge Road (SR 1614) and Turnpike Road (SR 1105). These are both fairly heavily traveled two lane asphalt roads. The tract is separated from the two asphalt roads by single lots with existing houses. These lots are about 100 feet wide and 200 feet deep. The entire tract of land plus an additional 55 acres of adjacent developed land or a total of about 125 acres drain into the natural low area on this property which constitutes the 6 acres of wetlands. The wetland area is about 2000 feet long and averages about 130 feet wide. There is no defined stream through this area except at Plantation Road where the stream has been channeled into the pipe under the road. At the upstream end of the wetlands, the topography becomes very steep. At the downstream end of the wetlands is Plantation Road. Below Plantation Road is a constructed pond -of about 2 acres in size. The normal pool of this pond backs water up to the culvert underneath Plantation Road. The pond's pipe system is a small horizontal pipe through the dam with a vertical pipe riser to control the pool level. The applicant, Mr. H. Reginald Poteat owns the property described above and desires to develop a water-based subdivision. He wants to develop it in an environmentally friendly and pleasing manner with a minimum of disturbance and no more than two houses per acre. He plans to leave a common area between the building lots and the water for the enjoyment and use of all the property owners on the 70-acre tract. He hopes to attract potential property owners who will appreciate this more natural living environment and who will work with him to help keep it an environmentally friendly showplace of homes. In addition to providing the "water-base" for the development, the pond will also be utilized to control stormwater runoff from the area during and after development. U.S. Army Corps of Engineers (Corps) personnel visited the property on June 16, 1998 and were advised of the owners plans to develop the property as described above. On June 18, 1998, the Corps advised that the potential wetlands were considered "above headwaters" for jurisdictional purposes. The wetlands were then delineated by a private consultant and surveyed in September 1998. The Corps made a field review of the mapping on September 21, 1998. The wetlands map was certified by the Corps on October 9, 1998. WETLANDS MITIGATION PLAN AVOIDANCE To avoid affecting the wetlands, the following alternatives were evaluated: Alternative 1. Locate the pond outside the wetland area. Due to the topography of the land and the types of soil there are no other pond sites on this property. The topography is essentially flat except around the perimeter of the wetlands. According to the Scotland County Soil Survey, the highland soils on this property are classified as Lakeland Sand. These soils are deep sands not suitable for pond construction due to excessive seepage. Alternative 2. Develop the property the water-base feature. This does not meet Mr. Poteat's objective of a water-based development. If the property is developed without the water-base, it no doubt will be at a much higher density and even with best management practices the wetlands will be severely impacted. Alternative 3. Sale the property. This does not meet Mr. Poteat's objective. Mr. Poteat purchased this property approximately 15 years ago for the sole purpose of developing it into a desirable water-based subdivision. However it is a valid alternative, if the completion of this development becomes unrealistic or cannot be made economically feasible. M/N/M/ZAT/ON To minimize the amount of wetlands adversely affected, the following alternatives were evaluated: Alternative 1. Construct one dam at the downstream road and existing pond and leave some wetlands between the pool and the uplands. There is less than 12 feet of fall from the upper end of the wetland to the lower end. The minimum depth of a satisfactory impoundment at this location would be at least 10 feet at the dam. The pool would back water over most of the wetlands and maintenance of the upper end of the pond would be excessive. The remaining wetland area, if any, would be so small that it would provide very little filtering and wildlife values. Alternative 2. Construct a pond further upstream leaving some wetlands between this pond and the existing downstream pond. Constructing a satisfactory impoundment further upstream would leave only a very small area of downstream wetlands. These wetlands would be isolated between the two ponds and not be of sufficient size to provide very much filtration or wildlife value. This location also would not provide stormwater control for more than 50 percent of the tract. WETLANDS MITIGATION PLAN COMPENSATION There does not appear to be any way to avoid these wetlands and meet the applicants objective of developing a water-based development on this property. Also, there does not appear to be an alternative that will minimize the amount wetlands affected and leave enough of the wetlands so that the remaining wetlands would retain their value. Therefore, the applicant is willing to compensate for the 6 acres of wetlands most of which will be covered permanently by water if in so doing the project can remain economically feasible. In addition to or as a part of the mitigation, the applicant plans to reserve an area around the perimeter of the ponds which will not be disturbed. This area will be for the use and benefit of all the property owners, and will also provide filtration and shade along the edges of the pond which should benefit water quality and fish and wildlife. Keeping the density of housing to not more than about two houses per acre and providing some very strict restrictive covenants will also contribute to these values and help cause this development become more environmentally friendly and a more desirable place to live. The applicant understands that if this project is approved, mitigation could be in one or more of several forms. However, since either the NCDENR or the Corps will determine the value of this wetland and the required type and amount of mitigation, the applicant needs to know the kind of mitigation and the amount that will be required in order to know what options are available in order to proceed. The applicant respectfully requests a written response from the appropriate personnel of the appropriate agency so that he can orderly plan for the development or disposition of this tract of land prior to incurring any additional major financial resources. Based on this review, we have identified significant uses, which would be removed or degraded by this project. These uses are soluble pollutant removal and wildlife habitat. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold. Please provide us with information supporting your position that states your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically can you construct your pond with less than one acre of wetland impact? Any impact greater than one acre will require compensatory mitigation as described in 15A NCAC 2H .0506(h). the amount of this mitigation will vary depending on the distance these wetlands are located form blue line shown on USGS topographic maps. A minimum of 1:1 restoration or creation of riparian wetlands will be required. Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification. Also this project will require compensatory mitigation as described in 15A NCAC 2H .0506(h). Your mitigation proposal is insufficient because none was proposed. Please respond with three weeks of the date of this letter by sending a copy of this information to me and one copy to Mr. Ken Averitte Fayetteville Regional Office at Wachovia Building Suite 714 Fayetteville NC 28301. Action ID No. 199900013. The North Carolina Wildlife Resources Commission has reviewed the project for impacts to wildlife and fishery resources. A site visit was made on January 13, 1999. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), Section 401 of the Clean Water Act (as amended), and North Carolina General Statutes (G. S. 113 -13 1 et seq.). The applicant proposes to construct 2 ponds with a surface area totaling 9.6 acres in a wooded, natural ravine leading to Gum Swamp as part of a planned subdivision. A small stream with associated springs and wetlands occurs at the bottom of the ravine. Wetland vegetation includes red bay, red maple, black gum, and greenbriar. Site wetlands provide excellent habitat for raccoon, opossum, muskrat, mink, various reptiles and amphibians, and a number of songbird species. The project would fill 0.2 acre of wetlands, excavate 0.2 acre of wetlands, and flood 5.8 acres of wetlands for a total wetland impact of 6.2 acres. In our opinion, the quality of the Poteat, Inc. Ponds 2 1/15/99 aquatic habitat provided by the constructed ponds would not equal the quality of wetland habitat lost to filling, excavation, and flooding. Any attempts there might have been to avoid or minimize wetland impacts (i.e. go through the "sequencing process") are not described. According to the Public Notice, the applicant has indicated a willingness to mitigate for wetland impacts, but a mitigation plan was not included with the application. Based on these concerns, we recommend that permits not be issued for the project as proposed. A modified project demonstrating avoidance, minimization, and, if necessary, compensatory mitigation for wetland losses would receive a more favorable review from this agency. The following description of the work is taken from data provided by the applicant and from observations made during a site visit by a representative of the Corps of Engineers. Plans submitted with the application show the creation of two shallow water impoundments by constructing two earth embankments. Impoundments will be cleared by timber harvest equipment. Earth fill embankments will be constructed using earthmoving equipment such as trackhoes for excavations, pans or trucks for earthmoving and a bulldozer to spread and shape earth fill. Extensive use will be made of Best Management Practices (BMPs) to minimize and prevent sediment from leaving site. The applicant has indicated a willingness to mitigate for impacts to jurisdictional wetlands should a permit be issued. The site includes a linear, perennial, spring fed wetland, dominated by red bay (Persea borbonia), red maple (Acer rubrum), black gum (Nyssa s lvca), horse sugar (Symplocos tinctoria), cinnamon fern (Osmunda cinnamomea), netted chainfern (Woodwardia areolata), Ilex spp., Clethra sp., and Smilax sp., between upland sand ridges of loblolly pines (Pinus taeda) and turkey oaks ( uercus laevis). The soils are indicated as Aluvial and classed as hydric on the USDA soils map. Presently the soils are not drained and are commonly flooded. The top is covered with black mucky organic matter with some peat found and saturated sand. Hydrology was evident by the saturated soil condition. There is no evidence of ditching or channels and the drainage patterns are best defined as `dendritic', having small branches throughout the area. This wetland system is at the base of sandy hillsides and receives seep water and surface runoff from surrounding high ground. Before interfacing with Gum Swamp, this system travels under an unpaved road through a culvert into an existing 2-3 acre pond offsite. { -3- needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer decides that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to decide whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to decide the need for a public hearing and to decide the public interest of the proposed activity. Generally, the decision whether to issue this DA permit will not be made until the NCDWQ issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDWQ considers whether the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the DA permit serves as application to the NCDWQ for certification. The following description of the work is taken from data provided by the applicant and from observations made during a site visit by a representative of the Corps of Engineers. Plans submitted with the application show the creation of two shallow water impoundments by constructing two earth embankments. Impoundments will be cleared by timber harvest equipment. Earth fill embankments will be constructed using earthmoving equipment such as trackhoes for excavations, pans or trucks for earthmoving and a bulldozer to spread and shape earth fill. Extensive use will be made of Best Management Practices (BMPs) to minimize and prevent sediment from leaving site. The applicant has indicated a willingness to mitigate for impacts to jurisdictional wetlands should a permit be issued. The site includes a linear, perennial, spring fed wetland, dominated by red bay (Persea borbonia), red maple (Acer rubrum), black gum (Nyssa sylvatica), horse sugar (Symplocos tinctoria), cinnamon fern (Osmunda cinnamomea), netted chainfern (Woodwardia areolata), Ilex spp., Clethra sp., and Smilax sp., between upland sand ridges of loblolly pines (Pinus taeda) and turkey oaks ( uercus laevis). The soils are indicated as Aluvial and classed as hydric on the USDA soils map. Presently the soils are not drained and are commonly flooded. The top is covered with black mucky organic matter with some peat found and saturated sand. Hydrology was evident by the saturated soil condition. There is no evidence of ditching or channels and the drainage patterns are best defined as `dendritic', having small branches throughout the area. This wetland system is at the base of sandy hillsides and receives seep water and surface runoff from surrounding high ground. Before interfacing with Gum Swamp, this system travels under an unpaved road through a culvert into an existing 2-3 acre pond offsite. -3- needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer decides that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to decide whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to decide the need for a public hearing and to decide the public interest of the proposed activity. Generally, the decision whether to issue this DA permit will not be made until the NCDWQ issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDWQ considers whether the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the DA permit serves as application to the NCDWQ for certification. Construction of the shallow water impoundments prior to development will allow the ponds to serve beneficial purposes such as controlling stormwater discharge (quantity and quality) improving downstream water quality, wildlife and recreation opportunities, and provide an aesthetically pleasing amenity for future residents. 15.
