Dear Mr. Wilson:
The Division of Water Quality has reviewed your plans for the discharge of fill material into 0.50
acres of wetlands and/or 800 feet of streams located at US 64 and NC 55 in Wake County for construction
of a Lowe's Building. Insufficient evidence is present in our files to conclude that your project must be
built as planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless
modifications of the proposal are made as described below, we will have to move toward denial of your 401
Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as incomplete until
we receive this additional information, we are requesting (by copy of this letter) that the U.S. Army Corps
of Engineers place your project on administrative hold.
Please provide us with information supporting your position that states your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters and/or
wetlands. Specifically can you construct your project with less than 150 feet of stream impact? If not, on
site stormwater management will be needed for this project. Also you will need to apply for this project
with seven copies of the PCN form. Any documentation such as maps and narrative that you can supply to
address alternative designs for your project may be helpful in our review of your 401 Certification.
Please respond with three weeks of the date of this letter by sending a copy of this information to
me and one copy to Mr. Danny Smith Raleigh Regional Office at 3800 Barrett Drive Raleigh NC 27609. If
we do not hear from you in three weeks, we will assume that you no longer want to pursue this project and
we will consider the project as withdrawn. I can be reached at 919-733-1786 id you have any questions.

December 10, 1998
On Monday, December 7, 1998, Mr. Benjamin V. Wilson, P.E. met with Mr. Danny Smith of
DEHNR Water Quality regarding the drainage feature on the Apex Lowe's site.
The purpose of this visit was to determine whether or not the drainage feature was actually a
steam under DWQ guidelines. At the site meeting, it was determined that it was. This letter is to
initiate the application for a 401-Permit for the site.
Enclosed are five sets of the required documents.
We have already obtained a 404-Permit for the site, a copy of which is attached.

1000 feet west of the intersection of US 64 and NC 55, in Apex, Wake County, North Carolina. The site
is adjacent to an unnamed tributary of Beaver Creek, above headwaters, in Cape Fear River Basin.
Description of Activity:
This permit authorizes mechanized landclearing, excavation, the installation of pipes, and the placement
of fill associated with the construction of a Lowe's building supply center. Impacts to wetlands and
waters authorized by this permit include 0.57 acre of wetlands.
Applicable Law: X Section 404 (Clean Water Act, 33 USC 1344) only.
Section 10 (River and Harbor Act of 1899) only.

Proposed impacts are not in the Neuse Basin and are not subject to the NBRs. The consultants
were not sure if they had a stream on the property. The RRO confirmed that they do have a
steam. Due to the linear footage of stream impact that they are proposing they will need a 401
Certification.
The RRO will not Request any stream mitigation for the proposed impacts, but this office will
require that they develop a storm water management plan for the site. (Please note: this is not a
401 project... this is pre -application request ... the need to fill out the PCN)

This letter will serve to request your determination of the need to obtain a 401 Water Quality Permit to
develop the above referenced site. The site is approximately 18.5 acres with a small drainage feature
running through the middle. The drainage feature was evaluated on site by ECS five times since August,
1998, including periods immediately subsequent to rainfalls. Based on our repeated evaluations, we are
convinced that there is no clearly defined channel and no water flow was evident on this site. We do
recommend stormwater piping of post-development drainage from the adjoining land. This site is in the
run-off basin to Beaver Creek which flows to the Cape Fear River Basin.
We also assessed the site for wetlands and noted a very small amount of wetlands vegetation in the
drainage feature. The delineated wetlands area is less than 0.5 acre. We reviewed the wetlands
delineation on the site with Todd Tugwell of the Corps of Engineers on November 2, 1998. Mr. Tugwell
indicated that we would not have a problem obtaining a NWP 26 for the "wetlands" on the drainage
feature.
We are requesting your determination of a need to obtain a 401 Water Quality Permit. Our clients
propose to develop the site as a retail center including Lowes Home Center and other retailers. I have
attached the site documentation including a photograph for your review. Should you decide to inspect
the site, please feel free to contact me. 1 appreciate your prompt attention to this matter.
