This project is referenced by the Raleigh Regional Office as NBR RRO- 094. As a result of that site visit, it was determined that there are no streams present on the ` property and that the feature present on this tract of land tract is an ephemeral/stormwater stream and therefore not subject to the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; i Protection and Maintenance of Existing Riparian Areas Administrative Code T15A:02B.0233 (NCAC 0233). We have determined no jurisdictional stream channels or wetland pockets exist on site. (See attached map). No wetlands or Waters of the U.S. were found anywhere on the tract. Findings Potential wetland areas on the site were evaluated for the presence of hydric soils and evidence of hydrology and vegetation. In these areas, hydrologic proof would be in the existence of hydric soils with oxidized root channels in the upper 12 inches of the "A" horizon. Other indicators of hydrology include; wager borne deposits, drift lines, scour marks, and regional indicators of soil saturation; etc, If you choose to have us perform additional work, the following is a listing of additional services. None are required b law unless impacts Are proposed, but recommends they be performed: Request that the Corps verify our wvtland delineation, Request DWQ verify our Neuse Buffer determination. Another purpose of this letter is to update you on the current status of the Neuse River Basin Buffer Zone rules. Additional site work wouldi be needed to illustrate the exact areas within your project that may be regulated. Any stream channel with or without wetlands could be. Soil/Site Evaluation ¦ Mapping and Physical Analysis ¦ Wetland Mapping and Mitigation ¦ Environmental Audits On-Site Waste Treatment Systems, Evaluation and Design NCUSe Basin Buffer Rules Basically, the buffer zone is made up of two sections which extend a total of 50 feet from the center of all channels and from the edge of all ponds and lakes surrounded by "forest vegetation". The inner section is 30 feet wide and must contain "forest vegetation i.e. only "high value limber" can he removed). The outer section measures 20 feel and can he selectively cleared of high value species but must be mainlalned as a forest environment. However, building and other construction type: activities (i.e. grading), with the possible exceptions of and road/utility crossings, are prohibited within both sections. Furthermore, sheet flow must he encouraged within both sections, and adjacent drainage ditches must be constructed so that water does not form channels through the buffer zone. At this time, all forested stream channels represented as blues lines on the most recently published USGS 7.5 minute quadrangles, within the Neuse River Basin, are subject to the new rules. Additionally, DWQ intends to use "site specific data" to establish buffer zones around areas of surface water that are not shown on the USGS quadrangles. Based on our recent site visits with DWQ staff, they intend to apply the buffer to an channel considered jurisdictional, regardless of size or acreage. We do not believe any areas on the tract are subject to the Buffer rules. Please call if you need further explanation.
