Brewer 515 West Ehringhaus St. Elizabeth City, NC 27904 Dear Mr. Brewer: You have our approval, in accordance with the attached conditions, to place fill material in 0.1 acres of wetlands or waters for the purpose of developing a home at Bucko Bay, as you described in your application dated October 29, 1998. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: The applicants propose to fill 4,320 square feet of non-coastal wetlands located within the estuarine shoreline area of environmental concern. Bucko Bay Bio Report Page Two George Jackson, Michael Twiddy and M. C. Brewer own Lot 4A of the Bucko Bay Subdivision 4 miles south of the Shiloh community in Camden County, North Carolina, adjacent the Pasquotank F The 3.75 acre lot can be accessed by turning off NC 343 onto Wickham Road (SR 1110), then procee straight onto Neck Road (SR 1111). The paved portion of Neck Road terminates directly in front of f designated subdivision entrance. A half-mile long gravel road leads to the subdivision. Lot 4A is locs approximately 180' south of the end of the gravel road. Elevation of the lot ranges .5'-4' above mean sea level. On two sides (south and west) the lot is bounded by the Pasquotank River which is classified SC closed to shellfishing. The height of the eros. scarp located along the 7,00', of unprotected shoreline ranges .5'-2.5' above normal water level. Scat height and lot elevation are lowest on the west side and along 150' of the western shoreline. There is x 90' area of coastal wetlands vegetated with Saw Grass (Cladium jamaicense) and Black Needlerush roemerianus). Along the southern shoreline where the scarp is higher, there are upland grasses growir 2' tall berm with a width of 12'-20'. Immediately landward of the berm are non-coastal wetlands loca low-lying, wet depressions ranging 50'-90' wide. Vegetation which was noted within the depressions includes heavy concentrations of cattail and common reed, with a mixture of sea myrtle, wax myrtle, s rush, small bald cypress and sweet gum. Landward (north) of the non-coastal wetlands, the landform slopes sharply upward to an elevatio above mean sea level. Most of these upland areas have been cleared of the understory and are vegetate large pine, sweet gum, oak, and willow. Within the upland area and approximately 150' from the watt the Pasquotank River the owners have stockpiled 500 cubic yards of fill material within a 50' x 100' rectangle. The improvement to this site is a 4' x 30' pedestrian bridge, which was constructed over wetland accordance with CAMA Minor Permit 11960801 issued 1 August 1996, The applicants are proposing to place 320 cubic yards of clean fill to a depth of two (2) feet withi 48' x 90' area of non-coastal wetlands. No delineation of jurisdictional wetland has been done on this the US Army Corps of Engineers; however, the applicants have flagged the corners of the proposed on( acre fill area. The 4,320 sq. ft. area abuts existing highground on the north and lies within the most landward portion of a larger oval-shaped area of non-coastal wetlands. This wet, low-lying oval area is located along the southern shoreline, landward of a 12'-20' berm and is vegetate with heavy concentrati cattail and common reed, with a scattering of sea myrtle, wax myrtle, soft rush, small bald cypress and gum. Silt fencing is to be placed along 186 linear feet of the fill site perimeter in order to prevent fill material from entering adjacent wetlands of the Pasquotank River. Fill is to be leveled, graded to a gra( slope, also subsequently seeded with fescue.
