After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3101 and 3103. These Certifications allow you to use Nationwide Permit Numbers 12 and 14 when the Corps of Engineers issues them. This Certification is also covered by the Neuse Buffer Rules (NBR). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. As shown on the drawings, this project will require that a road crossing, sanitary sewer crossing and a sanitary sewer corridor encroach within the Neuse River Buffer. These encroachments are addressed as follows: 1. Utility Lines - construction of new corridors: As shown on the Construction Drawings, a gravity sanitary sewer interceptor will be constructed within Zone 2 along the length of the riparian buffer area. No practical alternative exists due to the site's topography. If the gravity sanitary sewer interceptor were required to be constructed outside of the riparian area, the depth of the required construction would be prohibitively expensive. 2. Utility Lines - construction of new crossings: As shown on the Construction Drawings, gravity sanitary sewer crossings of the buffer will be constructed as a part of this project. No practical alternative exists due to the site's topography and the location of the existing gravity sewer facilities. If the gravity sanitary sewers were required to be constructed without new crossings, duplicate facilities would be required on each side of the buffer. 3. Storm sewer outfalls: As shown on the Construction Drawings, there are no storm sewer outfalls proposed in the riparian buffer area. The flows from the storm sewer outfalls will be dispersed into sheet flow before the runoff enters Zone 2 of the riparian buffer area. This will be accomplished through the construction of rip rap aprons at the end of all pipe outlet designed as dissipators. 4. Road crossings: As shown on the Construction Drawings, a single road crossing of the riparian buffer area will be constructed as a part of this project. No practical alternative exists due to the site's topography and the location of the existing roadway facilities. This project was required to provide a roadway interconnecting Stinson Avenue with Grigsby Avenue. Any such roadway interconnection must cross the riparian buffer area. The Town of Holly Springs has requested that we provide documentation from the NC Division of Water Quality that this Plan complies with the Neuse River Basin Regulations.
